19622ORDINANCE NO. 19,622 AN ORDINANCE TO AMEND A PORTION OF ARTICLE VI OF CHAPTER 30 OF THE LITTLE ROCK CODE OF ORDINANCES TITLED "BOUNDARY STREET IMPROVEMENTS AND RIGHT - OF -WAY DEDICATIONS" TO PROVIDE AN EXEMPTION TO PROPERTY IN THE LITTLE ROCK PORT INDUSTRIAL PARK; AND FOR OTHER PURPOSES. WHEREAS, Article VI of Chapter 30 of the Little Rock Code of Ordinances (commonly referred to as the `Boundary Street Ordinance ") generally requires developing properties to make improvements to one half of the abutting street as necessary to meet Little Rock Master Street Plan requirements (hereinafter referred to as "Boundary Street Improvements ") ; and WHEREAS, the requirement to construct Boundary Street Improvements have been found by the Little Rock Port Authority to be an impediment to recruiting, attracting and retaining industries at their Industrial Park facility; and WHEREAS, the Little Rock Port Authority has traditionally been successful in obtaining state and federal grant money to build roads in their facility and has not relied on Boundary Street Improvements to enhance the road network at their Industrial Park facility; and WHEREAS, exempting property in the Little Rock Port Industrial Park from the requirements of the Boundary Street Ordinance will not have a negative impact on the road system of the City of Little Rock or the Little Rock Port Industrial Park. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Subsection (c) of Section 30 -281 of Article 6 of the Little Rock Code of Ordinances is amended to read as follows: (c) There shall be 3 exclusion zones within areas zoned or used for industrial purposes which shall be exempt from some or all of the provisions of this Article as follows: (1) The West 65th Street Industrial Park and the Airport Industrial Park shall be exempt from the requirement to construct sidewalks except as described and provided for in Section 31- 175(4).; and (2) The Little Rock Port Industrial Park in an area described in Section 31- 175(4)c. shall be exempt from all requirements of this Article.
