AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
OFFICE DISTRICT TITLED 1416 -1500 ALDERSGATE
ROAD SHORT -FORM POD (Z- 8088), LOCATED AT 1416
— 1500 ALDERSGATE ROAD, LITTLE ROCK,
ARKANSAS, AMENDING THE OFFICIAL ZONING MAP
OF THE CITY OF LITTLE ROCK; AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from 0-3 and MF -24 to POD:
Part of the NW 1/4 NW '/4, Section 10, T -1 -N, R -13 -W, Little Rock, Pulaski
County, Arkansas, being more particularly described as follows: Beginning
302.87 feet North of the center of NW '/4 of Section 10; thence
S02 °06'00 "W, a distance of 75.1 feet; thence S88 °28'00 "W a distance of
143.62 feet; thence NO2 °15'30 "W a distance of 74.76 feet; thence Easterly a
distance of 149.22 feet to the point of beginning.
AND
Part of the NW '/4 NW '/4, Section 10, T -1 -N, R -13 -W, Little Rock, Pulaski
County, Arkansas, being more particularly described as follows:
Commencing at the SE corner NW '/4 NW '/4 Section 10 -TIN, R13W;
thence N88 °44'46 "W 25.01 feet to the point of beginning; thence continuing
N88 044'46 "W 140.86 feet to the East right of way line of Interstate
Highway 430; thence N15 °30'19 "E 121.65 feet; thence continuing along
said east right of way line NO1 °36'27 "W 113.49 feet; thence N89 °27'44 "E
124.23 feet; thence S3 °07'00 "W 235.26 feet to the point of beginning said
tract containing 0.662 acres more or less.
SECTION 2. That the approval of the 1416 -1500 Aldersgate Road Short-form
POD (Z- 8008), located at 1416 —1500 Aldersgate Road is subject to compliance with the
following additional conditions:
• That the preliminary site development plan/plat be approved as submitted,
including all staff comments and conditions as outlined in the Planning
Commission Agenda Staff Report.
• The approval is for the sole benefit of the current applicant Tavakol
Ronaghi and is not a transferable use to any future property owner.
• All landscaping materials used for display must be permanently planted in
the ground.
SECTION 3. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 4. That the change in zoning classification contemplated for 1416-
1500 Aldersgate Road Short-form POD (Z- 8008), located at 1416 — 1500 Aldersgate
Road is conditioned upon obtaining a final plan approval within the time specified by
Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances.
SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 6. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 7. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
