ORDINANCE NO. 19,598
3 AN ORDINANCE TO ABANDON A PORTION OF MARSHALL
4 STREET, LOCATED BETWEEN WEST 8TH AND WEST 10TH
5 STREETS, AND A PORTION OF MARYLAND AVENUE (60 FEET
6 BY 300 FEET), LOCATED BETWEEN MARSHALL AND BISHOP
7 STREETS, IN THE CITY OF LITTLE ROCK, AS A PUBLIC RIGHT -
8 OF -WAY; AND FOR OTHER PURPOSES.

10 WHEREAS, a request was made to abandon a portion of Marshall Street, located
11 between West 811 and West 101h Streets, and a portion of Maryland Avenue (60 feet by
12 300 feet), located between Marshall and Bishop Streets, in the City of Little Rock,
13 pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54-
14 104;
15 WHEREAS, the Board has determined that the abandoning of this public right-
16 of -way will not have an adverse impact on the adjacent property owners nor the local
17 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed
18 for corporate purposes, except as otherwise noted below.
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
20 OF THE CITY OF LITTLE ROCK, ARKANSAS:
21 Section 1. The Board of Directors hereby releases, vacates, and abandons a
22 portion of Marshall Street, located between West 8th and West 1011, Streets, and a portion
23 of Maryland Avenue (60 feet by 300 feet), located between Marshall and Bishop Streets,
24 together with the right of public in general, in the City of Little Rock, Pulaski County,
25 Arkansas.

I Section 2. The City specifically retains the entire area of the abandonment as a
2 utility easement.
3 Section 3. A copy of this ordinance duly certified by the City Clerk, shall be filed
4 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of
5 Pulaski County, Arkansas.
6 Section 4. Severability. In the event any title, section, paragraph, item,
7 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
8 or unconstitutional, such declaration or adjudication shall not affect the remaining
9 portions of the ordinance which shall remain in full force and effect as if the portion so
10 declared or adjudged to be invalid or unconstitutional was not originally a part of the
11 ordinance.
12 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same
13 that are inconsistent with the provisions of this ordinance are hereby repealed to the
14 extent of such inconsistency.
