In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. We are unable to attend on this date due to business travel. Please allow this letter to represent us. We have two primary concerns that we hope are discussed as part of the planning discussions. The property requesting change was vacant when we purchased the adjoining property. Since then it has been used sparingly. In October of last year we had some drainage work on our property. At that time the owner of the property, NPlusl Data Solutions, stated that the property was difficult to sell since the septic system drains toward our property. This has not been an issue due to the limited use; however, we now understand that they wish to use the property as a full- time school for Pursue Arkansas Christian Academy. We are concerned that the property and structure size is not adequate for a full time school for pre-K through 5'h grade. We are also concerned the septic system will leach into our property with the heavier volume of usage. The second concern is the existing fencing connected to the building to protect children. We recently added an in ground pool within view of the fenced area. The fence is quite low and we have concerns about the safety of children playing outdoors close to the pool. In addition, there is a discrepancy in the survey line between the two properties. There are two Iron Pins in the road indicating the property line; however, one has been slightly bent over. This draws more concern about the location of septic system and the corner of the property fence. Overall we are primarily concerned the property is insufficient for the new, proposed usage.
