PROPOSAL: A conditional use permit is
requested to allow for the
construction of an automobile
repair facility and
office/warehouses on this C-3 zoned
property. A portion of the
property is currently occupied by
two structures utilized by Head
Start as a day care center. There
would be four structures on the
property, if the proposal is
approved.
ORDINANCE DESIGN STANDARDS:
1. Site Location
The site is a 2.1 acre tract located on the south side of
Asher Avenue, approximately 230 feet east of its
intersection with Western Hills Avenue.
2. Compatibility with Neighborhood
The zoning and land uses in the immediate vicinity are
varied, ranging from R-2 and R-3 single family residential
to I-2, light industrial.
The property in question abuts C-3 and I-2.
There are two public facilities nearby, an elementary school
and a post office branch on Asher Avenue.
Immediately to the west of this site is a large tract of I-2
zoned land with several automobile service/repair businesses
on it.
In the immediate vicinity, there are several commercial
businesses fronting on Asher Avenue.
The proposed uses should be compatible with the
neighborhood.

3. On -Site Drives and Parking
The proposed auto repair building requires 19 on-site
parking spaces. Including the four spaces inside the
building, the applicant is proposing a total of 6 on-site
parking spaces for this building.
The applicant proposes to share parking with the Head Start
Day Care Center. If this is case, the applicant must submit
information regarding the number of required parking spaces
for the Head Start Center so that it can be determined if
there are any extra parking spaces which may be used by the
proposed auto repair facility. The office/warehouse
structure will be served by a parking lot with 15 parking
spaces. Access to this lot will be through the adjacent
property, to the west, which Mr. Davis also owns. There
should be a platted access easement through this property in
order to assure continued access to the office/warehouses.
4. Screening and Buffers
This site is surrounded by C-3 and I-2 zoned property. The
only perimeter screening/buffering required is along the
street side of the property. Compliance with the City's
landscape ordinance is required for any new vehicular use
areas and an upgrade in landscaping is required along Asher
Avenue.
5. City Engineer Comments
Dedicate right-of-way on Asher Avenue and make in lieu
contribution for Asher Avenue improvements. Show platted
access easement to warehouses from public
right-of-way.
6. Utility Comments
On-site fire service will probably be required. Contact
Little Rock Municipal Water Works about this requirement and
other additional water service requirements.
The sewer main is located on the north side of Asher Avenue.
Arkansas Power and Light Company is requiring a 10 foot
easement along the east property line.
7. Analysis
The proposed auto repair facility and office warehouse are
appropriate uses for this property and staff is generally
supportive of this proposal. The issue of platted access to
the rear of the site must be resolved and the question of
parking for the auto repair facility must be answered.

8. Staff Recommendation
Staff recommends approval of this application subject to:
1. Adequate parking being provided for the auto repair
facility.
2. An access easement being platted across the property to
the west to serve the office warehouse building.
3. Compliance with City Engineer and Utility Comments.
4. Compliance with the City's Landscape and Buffer
Ordinances.
SUBDIVISION COMMITTEE COMMENT: (JUNE 24, 1993)
The applicant, Atley Davis, was present. Staff presented the
item and outlined their concerns regarding parking for the auto
repair facility and access to the rear of the property where the
proposed office warehouse building is located.
Mr. Davis stated that he would provide a platted access across
the property to the west to serve the office warehouse building.
Mr. Davis was told to obtain information regarding the number of
children and teachers at the Head Start Center so that required
parking could be determined. This is necessary so that it can be
determined if there is any additional parking which may be used
for the proposed auto repair facility.
Discussion then turned to the required right-of-way dedication
and improvements on Asher Avenue. Mr. Davis stated that he would
dedicate the required right-of-way, but questioned the necessity
of contributing to an in lieu account for the Asher Avenue
improvements.
Bob Brown, Plans Review Specialist, then explained what
landscaping/buffering is required. Mr. Davis stated that he
would comply with ordinance requirements.
After a brief discussion, this item was forwarded to the full
Commission for final resolution.
PLANNING -COMMISSION ACTION: (JULY 13, 1993)
The applicant was present. There were no objectors present.
Dana Carney, of the Planning staff, presented the item and a
staff recommendation of approval.

Mr. Carney informed the Commission that the applicant has shown
that there is excess parking available from the other uses on the
property which may be used by the proposed auto repair facility.
The Head Start Day Care facility utilizes only eight of the
sixteen parking spaces located directly in front of it. As the
proposed auto repair facility is located on the same property as
the day care center, staff feels it would be appropriate to count
the remaining eight parking spaces toward the required parking
for the auto repair facility. The proposed 10,800 square foot
office/warehouse building is to be used as 10% office and 90%
warehouse, according to Mr. Davis. This would require a total of
eight parking spaces for the building. There are fifteen parking
spaces proposed for this use, leaving seven spaces which can also
be counted towards the auto repair business.
Added to the six spaces provided, this will give auto repair
facility a sufficient number of parking spaces.
Mr. Carney also informed the Commission that it will be necessary
for Mr. Davis to plat an access easement across the property to
the west prior to obtaining a building permit.
After a brief discussion, it was determined that there were no
outstanding issues and this item was placed on the Consent Agenda
for approval subject to compliance with all items as noted in the
staff recommendation.
The vote was 10 ayes, 0 noes and 1 absent.
