Site Location Abundant Grace Apostolic Church - Conditional use Permit 3419 Avery Road Abundant Grace Apostolic Church/ Robert Jones, Agent A conditional use permit is requested to allow for the expansion and remodeling of an existing church on this R-2 zoned property. The applicant proposes to construct a new 250 seat sanctuary and.to remodel the existing building, converting the existing sanctuary into classrooms. The applicant also requests that the paving requirement be deferred for a period of 3 to 5 years, and is requesting a waiver of the $125.00 filing fee. The site is located on the south side of Avery Road, approximately 400 feet east of Scott Hamilton Drive. 2. Compatibility with Neighborhood The uses in the immediate vicinity are varied, ranging from single family homes to industrial maintenance yards. Directly north of this site is a large area of I-2 zoning. within this area of I-2, the City of Little Rock has its large maintenance facility and the Terrace Green multifamily housing project. Adjacent, to the south of this site, is a nonconforming storage yard for a forklift sales and maintenance company. There are single family residences on either side of the church property. The church is a nonconforming use, existing at this location prior to this area's annexation in 1985. June 1, 1993 SUBDIVISION ITEM NO.: 9 Continued FILE NO_: Z-5684 With proper attention given to adequately screening the adjacent residences, this proposed expansion should be compatible with the neighborhood. 3. On -Site Drives and Parkin A sanctuary, with a seating capacity of 250, requires 63 parking spaces. A site plan has been submitted, showing 52 on-site parking spaces, two of which are indicated as handicapped. The church has a current membership of approximately 100 and has a weekly average attendance of 50±. The applicant is requesting a deferral of the paving requirement for a period of 3 to 5 years. 4. Screening and Buffers Compliance with the City's Landscape and Buffer Ordinances is required. There are single family homes adjacent to both the east and west. These homes must be screened from the church parking lot, either by sufficient plantings of trees and shrubs or by an opaque screening fence. S. city Engineer Comments Dedicate right-of-way on Avery Road to 25 feet from centerline. Provide street improvements on Avery Road to 27 feet wide with curb, gutter and sidewalk. 6. qLLiity comments Little Rock Waste Water Utility states a sewer main extension is required, with easements. Little Rock Water Works states a water main extension will be required (approximately 500 linear feet) in order to provide water service to this property. 7. Analysis The site plan, as submitted, utilizes virtually every available square foot of the property for building expansion, landscaping and parking. It is basically in compliance with ordinance requirements. The one area of shortfall in required landscaping and buffer is along the south perimeter which, though zoned R-2, is not utilized as single family residential. Attention must be given to screening the single family homes adjacent to both the east and the west. 2 June �, 19 3 SUBDIVISION ITEM NO.: 9 ontinu d FILE O.: Z-568 If a deferral of the paving requirement is granted by the Planning Commission, staff feels that the required screening on the east and west perimeters should be put in immediately. 8. Staff Recommendation Staff recommends approval of this application, subject to compliance with the City Engineer and Utility Comments and compliance with the City's Landscape and Buffer Ordinances. Staff does not recommend approval of the request to waive the $125.00 filing fee. SUBDIVISION COMMITTEE COMMENT: (MAY 13, 1993) Robert Jones was present representing Abundant Grace Apostolic Church. Staff presented the item and noted the City Engineer and utility Comments. Staff also expressed concern that the residences adjacent to the east and west be adequately screened. Tad Borkowski, of the City Engineer's Office, informed the Committee that an additional 7 feet of right-of-way is required to comply with the Master Street Plan. Mr. Jones responded that the church would be willing to dedicate the needed right-of-way, but would be requesting a waiver of the required street improvements. He was advised that the Planning Commission could not grant that waiver, that an appeal must be filed with the Board of Directors. After a discussion of the requested deferral of the paving requirement, it was decided that even if the deferral was granted, the required 'screening on the east and west would have to be completed immediately and that some type of border would need to be put in to contain the gravel. Mr. Jones agreed to these conditions. A committee member asked about the height of the proposed building and if there was to be any steeple structure. Mr. Jones stated that the height would be less than 35 feet and that there would be no steeple structure. After a brief discussion, the Committee forwarded this item to the full Commission for final resolution. 3 acne 1, 1993 SUBDIVISION ITEM NO.: 9 Continued FILE NO.: Z--5580 PLANNING COMMISSION ACTION: (JUNE 1, 1993) Robert Jones was present representing Abundant Grace Apostolic Church. There were no objectors present. Dana Carney, of the Planning staff, presented the item and informed the Commission that the City Engineers Office, after further review, has determined that the applicant should dedicate the needed right-of-way, but that street improvements are not required. He informed the Commission that staff recommends approval of this application and a deferral of the parking lot paving requirement for a period not to exceed three years or at such time as the church expands beyond this conditional use permit, whichever comes first. Mr. Carney further stated that staff was recommending that the required screening on the west and east, adjacent to the residential property, be installed immediately. The Commission was also informed that staff did not recommend approval of the request to waive the $125.00 filing fee. A commission member asked if the applicant had agreed to these conditions and was informed that he had. Commissioner Oleson asked if the applicant had agreed to pay the $125.00 filing fee. She was told that the applicant was requesting a waiver, but would pay the fee if the Commission instructed him to. After a brief discussion, it was determined that there were no outstanding issues and this item was placed on the Consent Agenda for approval as recommended by staff, including requiring the payment of the filing fee. The vote was 9 ayes, 0 noes and 2 absent. The application was approved. 4
