As can be seen by aerial photography and a viewing of the
surrounding areas, no residences in Pulaski County are located
within 600 feet of any part of the Treatment Facility. This
approximate 2 block area on the East, West and North of the tract
speaks of the lack of residential improvements in the immediate
area. To the South is the City Limits of Shannon Hills and with
the 50' to the South removed from the development tract, Shannon
Hills and Saline County residents have an approximate 200' strip
between their residences and any boundary of the tract upon which
the Constructed Wetlands is to be built. However, the unimproved
property abutting the tract to the East and the Saline County
residences, are within 200' of the improvement tract.
Aside from the psychological impact for an adjacent property owner
that a "Constructed Wetlands" Wastewater Treatment Facility is
within 200, of their property, this State of the Art Treatment
facility is designed, as shown by the engineering study, to emit
treated water more pure than the present flow of Otter Creek into
the City of Shannon Hills. Further, the present condition
contributed to by the lack of an adequate treatment facility for
the City of Shannon Hills, must be terminated.
Alternately, this site would be to provide a site South of the City
of Shannon Hills and still have the outflow through Otter Creek and
through the Otter Creek drainage area. Therefore, the emission
standard set by the Department of Ecology and Pollution Control,
although significantly lower than the discharge emission standards
granted the City of Little Rock, and the capability of this
Constructed Wetlands Facility to treat the sewage far below the
standards set, assure you, as a Planning Commissioner, and the
Board of Directors of the City of Little Rock, that all health
safeguards are in place and can be maintained through the operation
of the facility.

" Section 2 (a). That the discharge of wastewaters having an
excessive Biochemical Oxygen Demand (BOD) or Total Suspended Solids
Content (TSS) or Oil and Grease (O&G) constitute an added expense
in the operation and maintenance of the Utility's treatment
facilities and should be accompanied by payment of an Extra
Strength Surcharge to compensate for this added expense. Excessive
BOD and/or TSS is hereby defined as in excess of 300 mg/l, for
either parameter, and excessivie O&G is hereby defined as in excess
of loo mg/1, as determined in accordance with 'Standard Methods for
the Examination of Water and Wastewater', latest edition. The
Extra Strength Surcharge shall be 9.2 cents per pound of BOD in
excess of 300 mg/1, 5.83 cents per pound of TSS in excess of 300
mg/l, and 4.7 cents per pound of O&G in excess of 100 ing/l. The
Extra Strength Surcharge shall be computed separately for BOD, TSS
and O&G on the total discharge (consumption).
" Section 2 (b). There shall be a charge paid on all liquid
waste delivered to Adams Field Treatment Plant which is discharged
into the sewer system at that Plant, as follows:

Section 3. That Section 3 of Ordinance No. 13,982 of the
City of Little Rock, Arkansas approved February 17, 1961, as

the same hereby is amended to delete part of the second sentence
thereof, to wit, "Ark. Stat. Linn. 5 19-4113 (Rept. 1956) , a lien is
fixed upon the land for any unpaid sewer charge even though the use
of the sewer system is by a tenant or lessee instead of the owner
and ... to enforce the lien and ..." so as to read as follows:
" Section 3. That all bills for sewer service shall be
rendered monthly. Under the provisions of A.C.A. �- 14-235-223, if
any sewer charge is not paid within thirty (30) days after same is
due, suit may be brought to collect. the amount due, together with
a 10% penalty and a reasonable attorney's fee. "
Section 4. That Section 4 of Ordinance No. 13,982 of the
City of Little Rock, Arkansas approved February 17, 1981, as
amended by Ordinance No. 15,242 approved February 3, 1987, be and
the same hereby is amended in its entirety by deletion of the
existing provision contained therein and in substitution thereof as
Section 4 of said Ordinance, Section 4 shall read as follows:
" Sectio 4. Each user of the sewer system shall be
notified, at least annually by publication in a newspaper having
wide circulation in Pulaski County, Arkansas, in conjunction with
a regular bill, of the rate and that portion of the user charges
which are attributable to;waste water treatment services, in
compliance with 40 C.F.R. x.35.929 -2(f). "
Section 5. That all Resolutions and Ordinances and parts
thereof in conflict with Section 1, 2, 3, and 4 above, including
Ordinance No. 15,242 approved February 3, 1987 are hereby repealed,
provided, however, that all other parts of Ordinance No. 13,982
revising the procedure for adjustment of sewer charges and
establi,qhing a period of limitation, increasing industrial sewer
rates and consolidating and clarifying the existing ordinances
fixing rates for all other services rendered by the. Wastewater
Utility of the City of Little Rock, Arkansas, adopted on February
17, 1981, as amended by this Ordinance, shall in all respects
continue in full force and effect.

separable, and if a section, provision or phrase shall be declared

of Engineering on January 71, 1993 have been reviewed and are hereby
approved with the following conditions.
1. The Division of Engineering relied upon the statements and
representations made in tiie engineer's report, plans, and
specifications. IR case any statement or representation in
the aforementioned documents is found to be incorrect, this
Approval may be revoked,
2. There shall be no deviation from the plans and specifications
unless revised pians and specifications have been first sub-
mitted for review and written consent given.
3. The review and approval of the plans and specifications were
for functional and sanitary features and in no way constitute
an analysis of the structural design.
4. If construction on this project is not started within one
year of the date affixed hereto, this Letter of Approval is

5. As you are aware, this office has strongly recommended for
several years that Shannon Hills wastewater be treated by
Little Rock. The collection lines of S.I.D. 142 were built
with this purpose in mind as were certain capital
improvements in Shannon Hills.
Although the treatment plant is approved from a technical
standpoint, as proposed, it is our opinion► that it is in the
best interest of both Shannon Hills and the City of Little
Rock to reach an agreement in principle and price on the
treatment of Shannon Hills wastewater by Little Rock.
From Shannon 11111's standpoint, not having a treatment
facility will free up people, equipment, and utility costs
associated with operation and maintenance. Although the cost
analysis showed a slight advantage to Shannon Hills operating
its own facility, unforeseen and higher than anticipated cost
related to a treatment facility are a real possibility,
particularly as the facility ages.
From Little Rock's standpoint, connection of Shannon Hills
will eradicate the discharge of treated sewage into a stream
that traverses a large part of the city. All treated sewage,
regardless of the level of treatment, contains viable
pathogenic organisms. These organisms remain viable until
time and environmental factors result in their die—off.
Elimination of the effluent from a stream that travels
,w through, a population center makes only good sense.
We understand that Shannon Hills and the City of Little rock
are still negotiating over the provisions of providing
service. We strongly encourage Shannon Hills and Little Rock
to diligently pursue a service agreement. Such an agreement
is in the best interest of the citizens of both cities.
The plans and specifications are being retained for our files.

This permit is for the construction and operation of a
wastewater treatment facility. The components of said
facility are shown on the enlcosed site plan.
