Site Location FTLE N Z-5660 Kimrey Accessory Dwelling - Conditional Use Permit 710 Clarkson Street Elona Kimrey The applicant is requesting a conditional use permit to allow for the conversion of an existing 340 square foot two-story garage structure into an accessory dwelling on this R-2 zoned property. This site is located at the northwest corner of the intersection of "F" Street and Clarkson Street, one block west of North Van Buren Street. 2. Comnatibility with Neighborhood The zoning in the immediate vicinity is R-2 and R-3, with single family residential being the predominant use. Fair Park Elementary School is located one block southwest of this site. Mount St. Mary Academy and Holy Souls School are located three blocks to the north. This proposed use appears to be compatible with the neighborhood. 3. On -Site Drives and Parking The single family dwelling and proposed accessory dwelling each require one parking space. There is an existing driveway on the site which will provide two on-site parking spaces. 4. Screening and Buffers None required. 5. Utility Comments Little Rock Municipal Water Works reports that an additional water meter will have to be installed to comply with Arkansas Department of Health regulations. 7. Analysis The applicant is proposing to convert an existing 10 foot by 17 foot, two story structure into an accessory dwelling. Until 7 or 8 years ago, this structure was used as a single car garage with an office above. It has been used only as a garage/storage since then. The structure sits well off the street and the proposed use does not appear to negatively impact the neighborhood. 8. Staff Recommendation Staff recommends approval of this application subject to compliance with utility comments. SUBDIVISION COMMITTEE COMMENT: (FEBRUARY 18, 1993) The applicant was not present. Staff presented the item and outlined the proposed use of the structure. After a brief discussion, the Committee forwarded this item to the full Commission for final resolution. PLANNING COMMISSION ACTION: (MARCH 9, 1993) The applicant, Elona Kimrey, was present. There were several objectors present. Dana Carney, of the Planning staff, presented the item and a staff recommendation of approval. He informed the Commission that there is a potential title problem on a portion of this property that the applicant will need to work out with the adjacent property owner and the Pulaski County Circuit Clerk. Ms..Kimrey then addressed the Commission and briefly outlined the proposed use. Joyce Arick, of 5206 "F" Street, addressed the Commission in opposition to the proposed accessory dwelling. She presented the Commission with a letter and photographs supporting her position. Ms. Arick stated that the proposed accessory dwelling would infringe on her privacy due to its relationship to her backyard. She stated that the wall of the accessory structure is only about 7 feet from the wall of her home. 2 March 9, 1993 SUBDIVISION ITEM NO.: 8 [Continued) FILE NO.: Z-5660 Gary Flack, owner of the property at 712 Clarkson Street, addressed the Commission in opposition to the application. He told the Commission that 710 and 712 Clarkson share a single driveway and allowing the accessory dwelling would create a parking problem on his property. Mr. Flack further stated that he feared allowing an accessory dwelling at 710 Clarkson would devalue his property. Pat Akin, also of 5206 "F". Street, addressed the Commission in opposition to the proposed accessory dwelling. She expressed her fear that allowing the accessory dwelling would infringe on her privacy and would create a noise problem as her bedroom is approximately 7 feet from the accessory structure. Ms. Kimrey stated that the previous property owner had used the upper floor of this structure for an office, and that she would not have noisy tenants. Shirley Flake addressed the Commission in opposition to the application. She stated that the proposed accessory dwelling would create a parking problem and fire hazard, and would devalue the adjacent properties. After further discussion, Chairman Walker called for a vote. The vote was 0 ayes, 8 noes, 1 absent and 2 abstentions (Putnam, Nicholson). The application was denied. Kl
