Site Location Baptist Missionary Association - Conditional Use Permit 10,505 Chicot Road Winrock Development Company/ Baptist Missionary Association, Stanley Baird To construct a church with seating capacity of 223 on this R-2 zoned 5.5 acre tract. The applicant is also requesting to utilize a 24 foot by 54 foot temporary mobile church building and gravel parking lot until the permanent building and parking lot are completed. The site is located on the east side of Chicot Road, south of Yarberry Road. 2. Compatibility with Neighborhood Although the predominance of the immediate vicinity is R-2 single family residential, there are other uses nearby, including a nonconforming industrial plumbing and heating company and a large mobile home park. This property sits at the intersection of a principal arterial and collector street. With proper attention given to screening/buffering the residential subdivision to the east, this proposed use should be compatible with the neighborhood. 3. On --Site Drives and Parkina A church having a sanctuary with a seating capacity of 223 requires 56 parking spaces. The applicant is proposing a parking area with 94 spaces, four of which are designated as handicapped. 4. Screening and Buffers and Lighting Compliance with the City's landscape and buffer ordinances is required. Attention should be given to screening the east perimeter of this project, which is adjacent to several residences of the Deer Meadow Subdivision. The site plan January 26, 1993 SUBDIVISION ITEM NO.: 16 Con in e FILE Z-5655 needs to include a lighting plan for the drives and the parking lot with lighting designed to be directed away from adjacent residential properties. 5. City Engineer Comments Master Street Plan improvements and right-of-way dedication are required on Chicot Road. Construct sidewalks on Yarberry Road. 6. Utility Comments Southwestern Bell telephone requires a 5 foot easement along the entire length of the east property line extending north and south. 7. Analysis Staff feels that this is an appropriate proposal and is generally supportive, but feels that a couple of issues need to be addressed. First, a lighting plan needs to be submitted showing the height and design of any lighting for the drives and parking lot to assure that there will be no impact from the lighting on the residences adjacent to the east. Secondly, there should be a phasing plan submitted giving the time frame for construction in order to determine a reasonable length of time for approval of the temporary building and gravel parking lot. It would not be appropriate to approve use of temporary facilities without some assurance that the permanent structure and parking lot will be completed within a reasonable time frame. Third, there needs to be written assurance that the temporary building and gravel parking lot will be removed immediately upon occupation of the permanent building. 8. Staff Recommendation Staff recommends approval of this application subject to: 1. Compliance with City Engineer and Utility Comments 2. Compliance with City landscape and buffer ordinances 3. Submission of a lighting plan for the drives and parking lot. 4. Submission of a phasing plan giving the time frame for construction. Written assurance that the temporary building and gravel parking lot will be removed immediately upon occupancy of the permanent building. SUBDIVISION COMMITTEE COMMENT: (JANUARY 7, 1993) Joe White of White-Daters and Associates was present representing the Baptist Missionary Association. Staff presented the item and outlined the issues as noted in the staff analysis and recommendation. Mr. White stated that he felt that there would be no problem complying with each issue noted other than the Master Street Plan improvements to Chicot Road. He stated that a waiver of improvements may be requested of the Board of Directors. After a brief discussion, the Committee forwarded this item to the full Commission for final resolution. PLANNING COMMISSION ACTION: (JANUARY 26, 1993) The applicant was present. There were no objectors present. Dana Carney of the Planning staff presented the item and a staff recommendation of approval with the conditions as noted. Mr. Carney informed the Commission that the applicant had submitted a revised site plan addressing those concerns as follows: 1. The total right-of-way required for Chicot Road will be dedicated during Phase I. 2. The improvements to Chicot Road will be constructed in two phases, tied to the phasing of the development. 3. The sidewalk on Yarberry Road will be built during Phase I. 4. The temporary building and gravel parking lot will be in place a maximum of 24 months, after which they will be removed. The Commission was informed that the notices to adjacent property owners had been sent out 14 days prior to the meeting, and not 15 days as required by Planning Commission bylaws. After a brief discussion, a motion was made to waive the bylaw requirement and to approve the application as recommended by staff. The motion passed by a vote of 10 ayes, 0 noes and 1 absent. 3
