Courtney Location: Sibley Hole Road (North of I-30) Request: Rezone from R-2 to 0-3 Purpose: Office Size: 10.09 acres Existing Use: Vacant SURROUNDING LAND USE AND ZONING North - Vacant and Single -Family, zoned R-2 South - Vacant, Funeral Home and Industrial, zoned C-4 and I-2 East - Vacant and Commercial, zoned R-2 West - Vacant and Single -Family, zoned R-2 STAFF ANALYSIS 9219 Sibley Hole Road is currently zoned R-2, and the request is to rezone the site to 0-3. The proposal is to utilize the property for the headquarters (offices) of the Baptist Missionary Association of America. In addition to the office use, there is also a possibility of some ancillary activities, such as cottages for furloughing missionaries. (Item No. 7 on this agenda is a multiple building site plan review for the property.) The site is located between I-30 and Baseline Road to the north. The property is vacant. Zoning is R-2, C-4 and I-2, with the property abutting C-4 and I-2 land along the southern boundary. Land use found in the area includes single family, commercial, a funeral home, outdoor amusement and a cemetery. On the south side of I-30, there are several industrial uses. Some of the nearby land is vacant at this time. The Otter Creek Plan identifies the 10 acres as part of a large mixed office and commercial area. Therefore, the proposed 0-3 reclassification conforms to the adopted plan and staff supports the request. An 0-3 rezoning would provide a good transition from the C-4 and I-2 to an area shown on the land use plan for residential development. January 26, 1993 ITEM NO.: 19 Z-5652 Cont. ENGINEERING COMMENT Dedication of additional right-of-way for Sibley Hole Road, a collector, is required because the existing right-of-way is deficient. The right-of-way standard for a collector is 30 feet from the centerline. STAFF RECOMMENDATION Staff recommends approval of the 0-3 rezoning as requested. PLANNING COMMIS .-ION ACTION: (JANUARY 26, 1993) (Items No. 7 and 19 were discussed together. The site plan, Item No. 7, was discussed first.) Terry Burruss was present and said he was representing the applicant. There were several interested residents in attendance. Mr. Burruss primarily addressed the site plan and said the 0-3 rezoning is compatible with the neighborhood. Carman Breeding, 9215 Sibley Hole Road, spoke and said he is opposed to the use and rezoning. Mr. Breeding said that he lives next door to the site and the rezoning would impact his property and cause some problems for the area. Charlie Barnhill, a resident on Sibley Hill Road, spoke and said there are only three residences on Sibley Hill Road, and he would like the area to remain residential. Mr. Barnhill said the proposed use would increase traffic and garbage. He went on to describe other uses in the area and said Sibley Hill Road is in poor condition. Mr. Barnhill described the site and said there could be potential problems with drainage and erosion. Mr. Barnhill continued by saying that there are other sites which are more suitable for the use and envisions water and drainage problems. Mr. Barnhill also added that Sibley Hill Road could not handle heavy traffic loads. Terry Burruss reminded the Commission that the rezoning was to 0-3, and agreed to the street improvements. Mr. Burruss said the association currently has nine employees and has not grown very much over a period of 40 years. Mr. Burruss then described the development plan and said there would be less than 20,000 square feet of building on 10 acres. There was some discussion about the land use plan for the area and buffers. 2 January 26, 1993 ITEM NO.: 19 Z-5652 Cont. Don Collins, Director of the Baptist Missionary Association, said the use would be a small office operation, and would be very quiet. There was some additional discussion about various issues, including concerns raised by the residents and property values. A motion was made to approve the 0-3 rezoning and the site plan as filed. The motion passed by a vote of 10 ayes, 0 nays and 1 absent. 3
