Z-5588-A ApplicationORDINANCE NO. 17,190 1 2 AN ORDINANCE REAFFIRMING 3 PREVIOUSLY APPROVED SINGLE USE 4 PLANNED UNIT DEVELOPMENTS IN 5 THE CITY OF LITTLE ROCK, AND 6 FOR OTHER PURPOSES . 7 WHEREAS, Little Rock, Ark., Ordinance ("LRO") No. 16,823 8 (December 28, 1994) reaffirmed the Little Rock Board of 9 Directors' approval of single use planned unit developments 10 ("PUD") which were approved by the Board prior to the 11 decision in City of Little Rock v. Pfeifer, et al., 887 S.W.2d 296 (1994), a case which invalidated that portion of 12 Little Rock's zoning ordinance as it relates to single use 13 PUDs; and 14 WHEREAS, LRO No. 16,798 (December 20, 1994) amended the 15 zoning ordinance to allow single use PUDs in compliance with 16 the Pfeifer ruling; and WHEREAS, Section 2 of LRO No. 16,823 allowed the 17 reaffirmation of single use PUDs approved prior.to September 18 1, 1994 by the filing of a written request by the owner or 19 agent of the owner within 90 days of the effective date of 20 the ordinance; and WHEREAS, in response to notices published by the 21 Department of Neigborhoods and Planning of the City, the 22 following owners have requested such action and the Board 23 hereby reaffirms the single use PUDs enumerated below. 24 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 25 OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION •1. EMERGENCY CLAUSE. The ruling in City of Little Rock v. Pfeifer, et al., 887 S.W.2d 296 (1994), has impacted the validity of previously approved single use PUDs. The City has amended its zoning ordinance to clearly authorize single use PUDs in compliance with Pfeifer. In order for the above-named developments to continue to operate in compliance with the current PUD regulations, an emergency is declared to exist and this ordinance shall become effective immediately upon its approval for the health, safety and welfare of the citizens of the City of Little Rock. Easements for Public Utilities and Drainage. Easements for the installation, maintenance, repair and replacement of utility services, sewer and drainage have heretofore been donated and dedicated, said easements being of various widths, reference being hereby made to the Plat filed herewith for a more specific description of width and location thereof. No trees, shrubbery, incinerators, structures, buildings, fences or similar improvements shall be grown, built or maintained within the area of such utility or drainage easement. An easement is also hereby granted to the public for access to the lots in the case of an emergency created by fire, public safety, or other occurrence necessitating access to a lot by any public utility, fire department, police department or other public agency. Additionally, Deltic hereby grants to the public utilities the right to use these areas for utility and drainage easements provided such public improvements are maintained by said public utilities. Fences. No fences, enclosure or part of any building of any type or nature whatsoever shall ever be constructed, erected, placed or maintained closer to the front lot line than the building setback line applicable and in effect as to each lot, provided, however, that chain link or similar fences are in all events strictly prohibited and shall not be used under any circumstances; provided, further, that it is not the intentions of this paragraph to exclude the use of evergreens or other -shrubbery to landscape the front yard.
