DEAR DANA,
THE CHURCH WOULD LIKE TO DEFER IMPROVEMENTS TO THE WESTERN
PARKING AREA FOR A PERIOD OF THREE YEARS. THIS WILL ALLOW THEM TO
PROCEED WITH CONSTRUCTION OF THE NEW ADDITION AND EASTERN PARKING
AREAS AT THIS TIME.
ALL AREAS EAST AND SOUTH OF THE CHURCH WOULD BE IMPROVED TO
CURRENT STANDARDS AND LANDSCAPED. NEW SIDEWALK WOULD BE
CONSTRUCTED ALONG 12TH STREET AND MADISON.
MADISON WOULD BE WIDENED TO 1/2 OF 27 FT WIDE STREET AND SIDEWALK
CONSTRUCTED. DRIVEWAY AND STREET TURNOUTS ALONG 12TH WHICH ARE
NOT PART OF THE NEW CONSTRUCTION WILL BE REMOVED.
ATTACHED ARE THREE COPIES OF THE REVISED SITE PLAN AND THREE COPIES
OF THE PROPERTY SURVEYS.
PLEASE PLACE THIS ITEM ON THE AGENDA FOR THE NEST MEETING OF THE
BOARD OF ADJUSTMENT.

Staff Report:
A. Public Works Issues:
1. 12`h Street is a minor arterial with reduced standards on
the Master Street Plan. Dedicate right-of-way to 35 feet
from centerline with a 20 feet radial dedication at
intersection.
2. Improve alley to allow width for two way traffic, if
desired for church access to parking.
3. Remove old aprons and repair curb and gutter and
construct V2 street improvements to Madison Street to
residential standards.
4. Improve sidewalk to current City standards and ADA
standards.
5. Stormwater detention ordinance applies to this property.
6. All driveways shall be concrete aprons per City
Ordinance.
7. Plans of all work in right-of-way shall be submitted for
approval prior to start of work.
8. Improve corner curb radius to 31.5 feet radius with
construction (existing corner radius is 10 feet).
B. Staff Analysis:
On June 24, 1996, the Board of Adjustment approved a
variance to allow Holy Cross Baptist Church to construct a
4,381 square foot classroom addition with a reduced rear
yard setback. The site plan approved by the Board also
included the upgrading of the church parking lots located to
the east and to the west of the church building. The
applicant is now prepared to begin construction of the
addition. All improvements required to the east and south
of the church, including proper paving, landscaping and
street improvements, will occur through this construction
project. The applicant is requesting a three year deferral
of the required improvements to the parking lot located to
the west of the church.
Historically, staff has opposed deferrals of the type
requested for any longer than 12-18 months. However,
circumstances particular to this issue have caused staff to
support the requested variance.
The parking lot located to the west of the church, including
a portion of closed Monroe Street, is now mostly paved with
concrete and asphalt. There is very little, if any, of the
site which is not paved with some material. The area is now
and has been used for church parking. Staff's main
opposition to variances of this sort mainly comes when the
area is unimproved at all, gravel or dirt for instance.

At the end of three years, the parking lot will be brought
into full compliance including proper saving of all
vehicular use areas, landscaping and street improvements.
The properties adjacent to the north and west of this
parking lot are owned by the City and are undeveloped and
overgrown.
C. Staff Recommendation:
Staff recommends approval of the requested three year
deferral subject to compliance with Public Works Comments.
HOARD OF ADJUSTMENT
(JUNE 30, 1997)
Tim Daters was present representing the application. There were
no objectors present. Staff presented the item and a
recommendation of approval, subject to compliance with Public
Works Comments.
Mr. Daters stated that all required improvements on the east side
of the property will be made as a part of the building expansion
and the parking lot on the west side will be brought into
compliance within 3 years.
David Scherer, of Public Works, discussed the Public Works
Comments and stated that the Public Works staff was satisfied
with the Plan submitted by the applicant. He stated that there
were some minor revisions to Public Works Comments.
A motion was made to approve the requested three year deferral
subject to compliance with the revised Public Works Comments.
The motion was approved by a vote of 8 ayes, 0 noes and 1 absent.
