Mississippi Street. Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required 4Ordinance Resolution Approval Information Report Submitted By Bruce Moore The applicant is appealing the Planning Commission's recommendation of denial for a rezoning request for this site from PD -0 to POD to allow the placement of a 120 -foot cellular tower on the site in addition to the previously approved allowable uses. None. Staff recommends approval of the requested POD zoning. The Planning Commission voted to recommend denial of the requested zoning by a vote of 5 ayes, 4 noes and 2 absent. The Planning Commission reviewed the proposed POD request at its November 10, 2005, meeting. There were registered objectors present. The Merriwether Neighborhood Associations, all property owners located within 200 -feet of the site and all residents who could be identified located within 300 -feet of the site were notified of the public hearing. BACKGROUND On November 1, 2004, the Little Rock Board of Directors approved a rezoning request for this site to PD -0 to allow the use of the existing church kitchen facilities as a commercial catering business. The Little Rock Planning Commission reviewed this request on October 7, 2004, and made a recommendation of approval of the request. The applicant proposed to rezone the existing church site to PD -O to allow a commercial catering company to operate from the existing church kitchen facilities. The applicant indicated there would not be any exterior modifications to the structure and there would not be any activities on the site other than the preparation and cooking of the food. The applicant stated there would not be any consumption of food or pick-up service available on the premises. The applicant also indicated the days and hours of operation would be limited to normal business hours of 8:00 am to 5:00 pm daily with the exception of special events. The applicant indicated there would be no more than four employees of the business and no more than four vehicles parked on the site during operation. The applicant is proposing a revision to the current PD -0 zoning to POD to allow the placement of a cellular tower on the site. Verizon Wireless Communications is proposing to lease a 75 -foot by 75 -foot site from St. Mark's Episcopal Church for the placement of a 124 -foot monopole and communications facility. -The applicant has indicated the monopole is a state of the art telecommunication tower that will create minimum intrusiveness into its surrounding neighborhood while providing critical telecommunication services to the residents of Little Rock. The applicant has indicated the successful construction and operation of the tower is critical to the completion of Verizon Wireless's network. The applicant has stated the tower will fully comply with Article X11 of the City Zoning Ordinance with regard to landscaping. The tower will be constructed utilizing "stealth technology" giving the tower the appearance of a flagpole. 2 BACKGROUND CONTINUED The applicant has stated Verizon Wireless has made every effort to find a suitable structure to locate or collocate its antennas upon. The applicant has indicated suitable structures have not been located that would allow for the completion of the Verizon Wireless's network. The applicant has provided staff with a letter of intent to allow collocation for proposed wireless telecommunication facilities when collocation at the tower site is commercially feasible and collocation is feasible within engineering parameters. The applicant's statement indicates the proposed tower has the capability of providing collocation for additional tenants. The application includes a statement from the Radio Frequency Engineer indicating the site's Equivalent Isotropically Radiated Power (EIRP) for this installation is 890 watts or less. According to the applicant, the current FCC rule (reference: Code of Federal regulations, Title 47 - Telecommunications, Chapter 1 Federal Communications Commission, Part 24 — Personal Communications Services, Subpart E- Broadband PCS, Section 24.232 — Power and antenna height limits) permits up to 1640 watts EIRP for this type of installation. Please see the attached Planning Commission minute record and site plan for the applicant's specific development proposal and the staff analysis and recommendation. ORDINANCE NO. Mississippi Street is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 5. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Mississippi Street Dear Members, It has come to my attention that St. Mark's Episcopal Church has plans to develop more of their property located at 1204 N. Mississippi Street. I am a resident of the Leawood subdivision and my property is located at 6 Thad Lane. This property backs up to the woods located west and south of the church. I am STRONGLY opposed to any plans the church has to develop more of this property. When they enlarged their parking lot 6 years ago, my property and my neighbors' property all experienced severe flooding problems. I experienced damage to the structure of my house, my deck, flooding in my downstairs, and loss of land. Two neighbors lost several feet of their backyards because the water load was too great for the drainage ditch. We were never compensated for any damage and we were told, "It wasn't their responsibility just because they were up hill." Correct me if I'm wrong, but is there not a property law that states "...any changes the man at the top of the hill makes in his property that effects or damages the property of his neighbors below that man is responsible..." St. Mark's did not follow the recommendations to prevent such problems six years ago. If they develop here again, who is to say they will follow the required measures this time? Will we experience similar problems again? Thad lane is a dead end street, which enables the residents to enjoy very little traffic and a safe, quiet living environment. We want to keep it that way! If the church must add another building to their property, PLEASE do not let them do it on the south or southwest side!!!! They have plenty of room to develop on the northwest side of their property, located next to the Evergreen entrance, or between the basketball court and the Boy Scout building just off Mississippi Street. Pg.2 Any development approved by you as a board, that would take place in the woods south and west of St. Mark's Episcopal Church, will most likely cause serious problems with water run off,put more pressure on the new drainage ditch recent) installed south of Thad Lane and decrease the property value of the homes next to any new development We enjoy living on a dead end street and the woods are an important buffer for the noise that comes from the high traffic on Mississippi Street. Please help preserve what little natural space is left in central Little Rock. Please think of the many residents of Leawood that will be affected by any new buildings on the south and west sides of St. Mark's property. I am referring to the proposed cell tower behind St. Marks Episcopal Church. I am a Leawood resident and drive by that location a few times every day. In fact, most residents in Leawood do. Evergreen at Mississippi is most likely the most used entrance into Leawood and as such is kind of a gateway into this nice neighborhood. Right now at this intersection, there are three very nice churches with generous shady lots. St. Marks is the most attractive of these in my opinion. The intersection makes for a nice entrance to the neighborhood. Aesthetics is my profession. I am an architect. I know well the things that can establish a pleasant ambiance and also the kind of things that can erode or diminish one. The 120' cell tower will be an offensive addition and will negitivly affect the whole area served by that intersection. The cell tower proposed is one of the uglier ones I've seen. They do make cell towers that look like trees and those are often required in locations that are concerned about not destroying the character of a setting. Those are installed when budget isn't the only consideration. What is proposed kind of a slap in the face. Most of my neighbors have been shocked when I have told them about the tower. Only those within 200' were notified. It will be visible and destroy views from a lot farther away than that. It will probably negativly affect property values in the immediate area. (Would anybody want a house that this when you step outside, you look up at one of these?) It will cast a shadow hundKeds of feet long in the afternoon, morning and when the sun is low in winter months. To make the visual impact worse, it will sit on a hill! All of these requirements have been met and provided to you by letter dated October 24, 2005. With regard to Item no. 2, the planning staff has requested that we provide an overall site plan showing the church property and the location of the tower in relation to the property lines and to existing improvements. The survey includes a drawing the location of the tower in relation to the property lines and the overall parent tract. We believe this drawing should satisfy your requirement. With regard to Item no. 3, the planning staff has inquired whether this site is appropriate to pull the antenna close to the body of the tower using stealth technology as used in other parts of the City. Do we need to actually submit drawings to reflect a stealth pole consistent with the type that was approved at Chenal Parkway? With regard to Item no. 4, the staff has recommended the tower be painted to blend into the area. It is my understanding from the subdivision committee meeting that the standard gray color would be preferred. The Planning Staff Comments provides that Central Arkansas Water indicates that "a license agreement will be required for the installation of utilities and roadway across the existing raw water right-of-way. Detailed plans must be submitted to and approved by Central Arkansas Water. This right of way which is owned in fee by Central Arkansas Water, should be shown on the plans. Care must be taken to protect existing raw water facilities in the vicinity of the proposed access road to this site." According to Verizon Wireless' survey, Verizon Wireless' access and utility easement will not cross an existing easement in favor of Central Arkansas Water. Therefore, there should be no need for a separate agreement with Central Arkansas Water. Do you agree? After careful review of this matter, we are confident that you will agree with your planning staff and the majority of the Planning Commission that Verizon Wireless is entitled to approval its WCF application for the following as well as other reasons: (1) Under the Little Rock WCF Ordinance; Verizon Wireless is entitled to approval as a matter of law. The WCF Ordinance clearly allows the proposed WCF in this area so long as the WCF meets the Ordinance's setback limitations, landscaping requirements and height restriction. The Planning Commission Staff has confirmed the WCF is in compliance with such requirements through their recommendation for approval.. All of these requirements have been met and provided to you by letter dated October 24, 2005. I am attaching hereto another copy of my October 24, 2005 letter and related enclosures to you for your convenience. With regard to Item no. 2, the planning staff has requested that we provide an overall site plan showing the church property and the location of the tower in relation to the property lines and to existing improvements. I am attaching hereto a copy of our survey that was submitted with our application materials. The survey includes a drawing the location of the tower in relation to the property lines and the overall parent tract. We believe this drawing should satisfy your requirement. With regard to Item no. 3, the planning staff has inquired whether this site is appropriate to pull the antenna close to the body of the tower using stealth technology as used in other parts of the City. Care must be taken to protect existing raw water facilities in the vicinity of the proposed access road to this site." According to Verizon Wireless' survey, Verizon Wireless' access and utility easement will not cross an existing easement in favor of Central Arkansas Water. Therefore, there should be no need for a separate agreement with Central Arkansas Water. Do you agree?
