Staff Analvsis: This issue is before the Board of Adjustment because of an enforcement action by the City. The owners of 12 Clement Drive initiated construction on a carport prior to receiving the necessary permit, and they were given a courtesy notice. (It was the owner's understanding that a building permit was not needed if they did the work themselves.) The request is to grant a variance to allow the carport to encroach into the front yard setback approximately 12 to 13 feet. The proposed setback varies slightly because the lot is situated at the beginning of a curve. Twenty-five feet is the required front yard setback in the R-2 district. The construction of the carport is wood frame and will be painted the same color as the house. The roof has a small pitch to it and none of the sides will be enclosed. The dimensions of the carport are 10 feet by 17 feet, the size necessary for a single vehicle. 1 November 25, 1991 Item No. 1 Cant. What is being proposed by the applicant is found throughout the neighborhood; the lot to the west has a carport attached to the front of the house. Therefore, the construction is not introducing a new structural element to the immediate area. The design is unobtrusive and, after the carport is painted, it will almost look like it was built at the same time as the residence. The location is the most reasonable because it does not completely alter the appearance of the front yard and will not restrict access to the rear of the residence. C. Staff Recommendation: Staff recommends approval of the front yard variance subject to the carport never being enclosed except for that side which is attached to the residence. BOARD OF ADJUSTMENT ACTION: (NOVEMBER 25, 1991) The applicant was in attendance. There were no objectors present.. Staff stated the new recommendation, and Mrs. Bonnette said that she had no problems with the recommendation. A motion was then made to approve the front yard variance per the staff recommendation. The motion passed by a vote of 7 ayes, 0 noes and 2 absent. - E
