3 AN ORDINANCE TO ABANDON A PORTION OF WEST 16TH
4 STREET, LOCATED IN BLOCKS 13 AND 14, HICKS INTERURBAN
5 ADDITION, AS A PUBLIC RIGHT -OF -WAY; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, a request was made to abandon a portion of West 161h Street,
9 adjacent to Lots 12 and 13, Block 13, and Lots 12 and 13, Block 14, Hicks Interurban
10 Addition, pursuant to the City's general police power authority under Ark. Code Ann.
11 § 14 -54 -104;
12 WHEREAS, the Board has determined that the abandoning of this public right -
13 of -way will not have an adverse impact on the adjacent property owners nor the local
14 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed
15 for corporate purposes, except as otherwise noted below.
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
17 OF THE CITY OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons a
19 portion of West 16th Street adjacent to Lots 12 and 13, Block 13, and Lots 12 and 13,
20 Block 14, Hicks Interurban Addition, together with the right of public in general, in the
21 City of Little Rock, Pulaski County, Arkansas.
22 Section 2. The City specifically reserves the public utility easements within the
23 former right -of -way.
24 Section 3. A copy of this ordinance duly certified by the City Clerk, shall be
25 filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder
26 of Pulaski County, Arkansas.

Section 4. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged to be invalid or unconstitutional was not originally a part of the
ordinance.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
