195641 2 ORDINANCE NO. 19,564 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE § 22 -213 (1988) TO 4 PERMIT MEMBERS OF THE ZOO BOARD OF GOVERNORS TO SERVE MORE THAN TWO 5 TERMS, OR MORE THAN EIGHT (8) YEARS; TO DECLARE AN EMERGENCY; AND FOR 6 OTHER PURPOSES. 7 WHEREAS, the Little Rock Zoo Board of Governors serves a vital function to assure the effi- 8 cient and effective operation of the Little Rock Zoo; and 9 WHEREAS, since the Little Rock Zoo Board of Governors has been in place the Little Rock Zoo 10 has received praise and accreditation from the Association of Zoos and Aquariums, and has not 11 had any problems with the accreditation process or with oversight problems from the U.S. De- 12 partment of Agriculture; and 13 WHEREAS, the different and unique demands on the Little Rock Zoo Board of Governors is 14 such that a general term limit for city boards and commissions is counterproductive; 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE 16 ROCK, ARKANSAS: 17 Section 1 . Little Rock, Ark., Rev. Code § 22-213 (1988) is hereby amended to read as fol- 18 lows: 19 A Little Rock Zoo Board of Governors is created to review, consult, and advise the 20 City on matters concerning the operation and maintenance of the Little Rock Zoo. 21 The board or governors shall consist of nine (9) members, appointed by the board 22 of directors, eight (8) of whom shall serve for staggered terms of three (3) years af- 23 ter the initial cycle of terms. One member of the board of governors shall be a sit - 24 ting member of the board of directors and shall serve at the pleasure of the board 25 of directors. The initial eight (8) members of the board of governors, other than the 26 board of directors member, shall draw lots to see which three (3) members shall 27 serve an initial term of three (3) years, which three (3) shall serve an initial term of 28 two years, and which two (2) shall serve an initial term of one year. The sole intent of this ordinance is to remove term limits 2 for members of the Little Rock Zoo Board of Governors, and nothing in the language of Section 3 1 above should be interpreted to require that a new board of governors be appointed. 4 Section 3. Severabi/ity. In the event any title, section, paragraph, item, sentence, clause, 5 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 6 declaration or adjudication shall not affect the remaining portions of the resolution which shall 7 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitu- 8 tional was not originally a part of the ordinance. 9 Section 4. Repealer. All laws and parts of laws inconsistent with the provisions of this 10 resolution are hereby repealed to the extent of such inconsistency including, but not limited to, 11 Little Rock, Ark., Rev. Code § 22 -213 (1988), and Little Rock, Ark., Resolution No. 8096 (Febru- 12 ary 1, 1989). 13 Section 5. Emergency Clause. The need to assure compliance with local, state and federal 14 regulations, the timely recommendation of budgetary matters, and the oversight of the Little 15 Rock Zoo is essential to the public health, safety and welfare; therefore, the Board of Directors 16 17 18 19 20 21 22 23 24 of the City of Little Rock, Arkansas, declares an emergency and this ordinance shall be in full force and effect from and after the date of its passage. CarpenterQf� Q City Attorney Re: Exemption of Little Rock Zoo Board of Governors from Board term limit policy for City boards & commissions DATE: 21 June 2006 At the end of the 20 June 2006 meeting of the Board of Directors, Director Cazort requested an ordinance which would exempt the Little Rock Zoo Board of Governors ( "Zoo Board ") from the two -term limitation for service. As noted at the time, this limitation is included not only in the ordinance which created the Zoo Board, it is also a long standing policy statement included in Little Rock, Ark., Resolution No. 8096 (February 1, 1989). Attached to this memorandum are the following: (1) A proposed ordinance to amend Little Rock, Ark., Rev. Code § 22 -213 (1988) to delete the term limitation for the Zoo Board; (2) A proposed resolution to amend Little Rock, Ark., Resolution No. 8096 (February 1, 1989) to exempt the Zoo Board from its provisions; (3) A copy of Little Rock, Ark., Resolution No. 8096 (February 1, 1989); Please let me know if you have any questions or need any additional material.
