Z-3899 Staff AnalysisOctober 26, 1982 Item No. 5 - Z-3899 Owner: Applicant: Location: Request: Purpose: Size: Existing Use: Ray and Nancy Richardson Ray Richardson 7410 Stagecoach Road Rezone from "R-2" Single Family to 11I-2" Light Industrial Conformity with Existing Use 5 acres + Contractor Office and Storage Yard SURROUNDING LAND USE AND ZONING: North - Vacant, Unclassified South - Residential, Zoned "R-2" East - Vacant, Zoned "R-2" West - Residential, Zoned "R-2" PLANNING CONSIDERATIONS: No adverse comments have been received from any reviewing agency concerning this request. The request is not compatible with the Suburban Development Plan, which shows this area for future single family development. The applicant has an existing industrial use on the property which is comprised of several, interrelated engineering and contracting businesses. There is no current residential use of the property although the office for the businesses is housed within a former single family dwelling. The purpose in this application is to obtain a building permit to construct another storage building on the property. The applicant has a major investment in this property, but the property is included in an area shown on the plan for residential use. Staff believes there is a definite hardship in this case but does not feel comfortable with the prospect of zoning this property industrial, because such action could easily lead to a loss of the remaining residential properties in the area. This property is sufficiently buffered by the surrounding land area which is mostly floodplain, making this a somewhat isolated tract of land. Staff will support allowing the Board of Adjustment to permit expansion of this October 26, 1982 Item No. 5 - Continued nonconforming industrial use under the hardship considerations of the ordinance. Staff bases its support for this proposal on the fact that this is an isolated circumstance with true hardship factors. STAFF RECOMMENDATION: Staff recommends withdrawal of the application without prejudice and transfer of the request to the Board of Adjustment without further filing requirements including fees and notice. COMMISSION ACTION: The applicant was present, and there were no objectors. There was a brief discussion of the withdrawal of the application and the future of the application before the Board of Adjustment. After all of the various aspects of the matter were explained to the applicant, the applicant agreed to withdraw the application without prejudice from the Planning Commission Agenda. The Board moved to accept withdrawal, and the motion passed: 9 ayes, 0 noes and 2 absent.
