PLANNING CONSIDERATIONS:
No adverse comments have been received from any reviewing
agency concerning this request. Nonresidential uses in this
neighborhood are limited to the blocks to the north and west
between 12th and 13th Streets and the institutional use to
the immediate east. The applicant proposes to construct a
new retail store on this vacant site.
The proposed zoning while being at least partly compatible
with the zoning to the west is not compatible with
surrounding land uses. This request would then apparently
constitute spot zoning.
STAFF RECOMMENDATION:
Staff recommends denial.
COMMISSION ACTION:
The applicant was present, and there were two objectors.
The applicant stated that he was planning to purchase the
property and construct a new liquor store on the site. He
stated that his present store at 12th and Battery was being
closed. There was a fairly lengthy discussion. The two
objectors, one Kay Kirkland and another at 1312 Wolfe
Street, both expressed their opposition to the zoning. The
Board voted on the application as filed, and the vote
failed: 0 ayes and 11 noes. The application was declared to
have been denied.
