Linde Mark Linde Lots 18 and 19, Block 1 Midland Hills Addition Rezone from "R-3" Single Family to "R-4" Two Family Duplex Construction 14,020 square feet + Existing Use: Vacant STIRROUNDING LAND USE AND ZONING: North - Duplex, Zoned "R-4" South - Apartment, Zoned "I��3" East - Deaf School, Zoned "R-2" West - Single Family, Zoned "R-4" PLANNING CONSIDERATIONS: No adverse comments have been received from any reviewing agency concerning this request. The applicant proposes to construct two duplexes on these two lots. In doing so, he will have to construct an extension of Berry Street which is platted and constructed to the western boundary of this property. The surrounding zoning and land uses are compatible with the request. STAFF RECOMMENDATION: Staff recommends approval. PLANNING COMMISSION ACTION: The applicant was present, and there were seven objectors. The objectors expressed concern about parking problems in the area. These parking problems are presently existing and result from the fact that many multifamily uses existing in the area do not provide off-street parking. At least one of the objectors admitted to having a three -unit dwelling which May 25, 1982 Item No. 11 - Continued uses on -street parking. The argument centered around the fact that the applicant would be required to extend Berry Street in order to provide access to his proposed development. The extension of Berry Street will eliminate, or at least move the present stub end which is being used for parking area for this neighborhood. It was explained that the applicant would be required to provide off-street parking for his development, and that it was unfair to penalize the applicant for a problem which he had no part in creating. After a lengthy discussion, the Commission moved to approve the application as filed. The motion passed - 7 ayes, 3 noes, 1 absent.
