15847 1 RESOLUTION NO. 15,847 2 3 A RESOLUTION TO STATE THE INTENDED USES OF THE 4 REMAINING PORTION OF THE SECOND TRANCHE TO THE CITY OF 5 LITTLE ROCK, ARKANSAS, ALLOTMENT OF LOCAL FISCAL 6 RECOVERY FUNDS THROUGH THE AMERICAN RESCUE PLAN ACT; 7 AND FOR OTHER PURPOSES. 8 9 WHEREAS,the American Rescue Plan Act(ARPA), which was signed into law on March 11, 2021, 10 provides fiscal relief funds to State and Local Governments and other program areas aimed at mitigating 11 the continuing effects of the COVID-19 Pandemic; and, 12 WHEREAS,ARPA provides support to local governments in responding to the impact of COVID-19 13 and in their efforts to contain COVID-19. It created several eligible uses of the funding including one to 14 address lost revenue for cities and towns; and, 15 WHEREAS, the United States Department of Treasury on January 6, 2022, issued a Final Rule 16 regarding the use of ARPA Funds; and, 17 WHEREAS,the City of Little Rock,Arkansas(City),has received,and has on deposit,approximately 18 Eighteen Million, Eight Hundred Thousand Dollars ($18,800,000.00) in the second tranche allotment of 19 Local Fiscal Recovery Funds through ARPA, and has stated intended uses for approximately Thirteen 20 Million,Three Hundred Fifty Thousand Dollars($13,350,000.00)of that,the intended uses of the remaining 21 Five Million,Five Hundred Thousand Dollars($5,500,000.00)should be stated. 22 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS: 24 Section 1. Subject to the provisions of Section 6 below,the Mayor,the City Manager,City Clerk and 25 any City signatories required to do so,are authorized to apply for,obtain,or otherwise assure authorization 26 of the receipt or use of ARPA Funds as set forth in this resolution. 27 Section 2. As set forth more fully below, the Board of Directors expresses its intent to expend these 28 funds for eligible, immediate needs within the categories below: 29 a) Expenditure of Lost Revenue on Governmental Services; 30 b) Public Health Measures to Respond to the COVID- 19 Pandemic; 31 c) Premium Pay; and, 32 d) Indirect Costs. 33 Section 3. Expenditure of Lost Revenue on Governmental Services. It is the intent of the Board of 34 Directors that funds from the second tranche of the ARPA Funds be prioritized and expended for 35 government services as follows: [Page 1 of 2] a) Little Rock Fire Department Capital Needs: Including a new station with a residential look 2 and feel in West Little Rock and an updated apparatus bay at Station 16: Estimated at Two 3 Million, One Hundred Thousand Dollars($2,100,000.00) 4 b) Public Works Capital Needs: Estimated at Two Hundred Thousand Dollars($200,000.00) 5 c) Information Technology Upgrades: Estimated at Two Hundred Thousand Dollars 6 ($200,000.00) 7 d) Drainage Projects as Targeted Community Development: Estimated at One Million Dollars 8 ($1,000,000.00) 9 e) Infrastructure as Economic Development: Estimated at Seven Hundred Fifty Thousand Dollars 10 ($750,000.00) 11 f) Capital Improvements at Museum of Discovery,which is a component unit of the City of Little 12 Rock: Three Hundred Seventy-Five Thousand Dollars($375,000.00) 13 g) Capital Improvements at City-Owned Baseball Fields located at 2500 Cantrell Road, also 14 known as Junior Deputy Baseball Park: Eight Hundred Seventy-Five Thousand($875,000.00) 15 Section 6. Compliance with the American Rescue Plan Act. The City will ensure compliance with 16 prevailing Federal Law, regulations, bidding requirements, and guidance, at the time the funds are 17 committed to expenditures. 18 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 19 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 20 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 21 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 22 resolution. 23 Section 8. Repealer.
