PLANNING CONSIDERATIONS:
No adverse comments have been received from any reviewing
agency regarding this application. The applicant intends to
use the property for a swimming pool sales and supply
business. He plans to display three or four models of above
ground swimming pools and hot tubs. Those purchased will be
sent to the customer from separate warehousing facilities.
This use is specifically listed in the "C-4" and "I-2"
Districts. It is permitted as a conditional use in the
"C-3" District.
The applicant chose the rezoning route to lessen the time of
approval. He had previously tried to use a site on South
University only to learn that it could not be used for his
purpose. Staff realizes that Cantrell is a highway and
normally suited for "C-4" zoning; however, staff is
concerned about access and the proliferation of curb cuts
along Highway 10. There are a number of "C-4" type uses
along this segment of Cantrell, including the gas station
immediately to the west of this site, but staff feels that
these uses are misplaced.
STAFF RECOMMENDATION:
Staff recommends denial.

PLANNING COMMISSION ACTION:
The applicant had written reuuestinq that this item be
withdrawn. He stated that the owner of the property had
sold the property to another individual and, therefore, he
would not be using the property. Staff recommended the
withdrawal he permitted. The Commission moved to withdraw
the application. The motion passed: 7 ayes, 0 noes and
4 absent.
