Right-of-way will be required on Mabelvale Cutoff. The western 1.5 acres of this owner's property is presently occupied by a commercial use, which was zoned "C-3" in the south central island zoning, and he plans to expand this development to the east on the remaining 3.5 acres which are the subject of this request. The South Central Island Plan shows this property for multifamily use with the major commercial commitment being located on the northwest corner of this intersection. STAFF RECOMMENDATION: Staff recommends "MF -18" Multifamily. PLANNING COMMISSION ACTION (March 30, 1982): The applicant was present, and there were no objectors. The applicant stated that two grocery chains had expressed an interest in his property. He stated that while he owned all five acres on the corner of Chicot and Mabelvale Cutoff, only the 1 1/2 acre portion immediately on the intersection had been zoned under the South Central Island Zoning plan. He stated that it was his intention to enlarge the existing commercial facility there and expand with a grocery store.of some magnitude. By Planning Commission bylaws, this matter was automatically deferred to the April 27 Planning Commission meeting. STAFF COMMENT: Since the March meeting, staff requested that the owner A provide information regarding the commercial facilities jhat were planned for this site. In answer to that request, Thomas F. James, the owner, wrote a letter to Mr. Griffin stating that plans were underway, and had been since 1976, for construction of a supermarket in the 40,000 square foot range. Mr. James stated that negotiations had been underway with the tenant so that the proposed construction could start in late 1982 or early 1983. He indicates in his letter that all of these plans were predicated upon a letter written by Jim Finch, at that time Chief Planner for the City of Little Rock, which indicated that the property would be zoned commercial at the appropriate time. Mr. James indicates that there are two different grocery chains involved. He does not specify which companies are involved. A copy of this letter is enclosed with the agenda packet for your information. Staff still is not willing to support this application and continues to recommend its denial. PLANNING COMMISSION ACTION (April 27, 1982): The applicant was unable to attend the meeting and had called the staff shortly before noon requesting that this item be deferred to the May 25 Planning Commission meeting. 'Staff recommended that the request for deferral be granted. The Commission moved to defer this matter to May 25, an the motion passed: 7 ayes, 0 noes and 4 absent. PLANNING COMMISSION ACTION: The applicant failed to show and since the matter had been deferred on two prior occasions, the Commission moved to withdraw the application from its agenda, waiving the one year waiting period for refiling.
