Z-3805 Staff AnalysisMarch 30, 1982 Item No. 11 - Z-3805 Owner: Bill Sharp Applicant: Nancy Newell Location: 3205 Kavanaugh Request: Rezone from "R-2" Single Family "C-1" Neighborhood Commercial Purpose: Antique Store Size: 4,200 square feet + Existing Use: Single Family SURROUNDING LAND USE AND ZONING: North - St. Mary's Academy, Zoned "R-2" South - Single Family, Zoned "R-2" East - Duplex, Zoned "R-2" West - Single Family, Zoned "R-2" PLANNING CONSIDERATIONS: No adverse comments have been received from any reviewing agency regarding this request. A major problem with this site is its limited size and the applicant's inability to provide off-street parking. The Heights/Hillcrest Plan shows this area to remain single family with the area to the west, beginning at the alley, to be developed with multifamily uses as has been started. Staff feels that this property simply is not suitable for nonresidential use because of its size, limited access, and location. The existing commercial uses to the west were zoned a number of years ago and are inappropriate for the area. STAFF RECOMMENDATION: Staff recommends denial. PLANNING COMMISSION ACTION: The applicant was present, and there were four to five objectors. The applicant stated that the proposed use of the property was for an antique shop, primarily gift items and clothing items. There was a considerably long discussion of the parking problems, the applicant indicating that she thought four or five cars could be parked on the March 30, 1982 Item No. 11 - Z-3805 - Continued property. It is staff's contention that there could be probably no more than two cars parked on the property under ordinance minimum standards. A neighbor spoke and presented the Planning Commission with a petition in opposition to the zoning with 18 signatures of neighboring residents calling for it to remain as a residential property. Other property owners also spoke in opposition. After some discussion, the Planning Commission moved to approve the application as filed. The motion failed on a vote of: 0 ayes, 8 noes and 3 absent.
