PLANNING CONSIDERATIONS:
No adverse comments have been received from any reviewing
agency on this request. The property falls within the Rock
Creek annexation area, which is considered Little Rock's
first attempt to zone a large area in accordance with a plan
which tried to anticipate future growth needs. In that
process, hundreds of acres were zoned for multifamily,
office and commercial uses in this general area. Five years
later, probably 95 percent of that previously zoned land
remains vacant. Since that time there have been at least
four requests for additional zoning in this area, two of
which were for existing developed properties which had been
left out of the original zoning effort, and two of which
were vacant properties. At this time, one of the developed
properties is not in use, and neither of the vacant
properties has been developed.
The proposal for development of this property is somewhat
sketchy at this time. The initial indication is that
apartments will be constructed, but there has been mention
of condominiums. Of course, from a land use and zoning
standpoint, there is very little difference between the two.
Staff feels that there is not a reasonable demand for this
zoning, relying upon the existing vacant apartment land in
this area as that indicator. In addition, there is concern
for the potential adverse impacts upon surrounding
properties in the future.
STAFF RECOMMENDATION:
Staff recommends denial.

COMMISSION ACTION!
The applicant was present, and there was one objector.
There were two letters of objection delivered to the
Planning Commission also, one from a neighboring resident
and the other from Winrock Development Company. The
concerns expressed by the objectors were mostly relating to
the potential damage to the neighborhood. The applicant
discussed the issues that had been raised by staff,
specifically the access and the speculative nature of the
request. The applicant stated that access would be from
Timber Ridqe Road which the owner would be required to
develop his half of at the time this project were developed.
He stated further that the owner did have a project in mind.
He did not have it all sketched out in engineering drawings,
but did have in fact a specific proposal to develop the
property.
There was a lengthy discussion of the Rock Creek Annexation
and Zoning Plan and the issues raised in the meeting. After
this discussion, the Commission moved to approve the
application as filed. The motion failed on a vote of
0 ayes, 8 noes and 3 absent.
