PLANNING CONSIDERATIONS
No adverse comments have been received from any reviewing
agency. The request is not compatible with the adopted
Suburban Development Plan which shows this area for
multifamily use. Prior to December 16, 1980, this area was
shown on the Suburban Development Plan for commercial use
and the amendment adopted on the above referenced date was
prompted by the application for Gilliam Brothers Ready Mix
Company. This property is occupied by an antique store and
this requested zoning would make it a conforming use.
STAFF RECOMMENDATION
On the basis of the Suburban Development Plan, staff
recommends denial.
COMMISSION ACTION
The applicant was present, and there were the same objectors
as on Z-3718. The applicant stated that this property had
been purchased in October of 1977, and the improvements to
the property had been made from that date and that from that
date the property had been used for an antique store. In

discussing the surrounding land use, the applicant cited the
ratio of residences to businesses along Highway #10 in this
general area and presented a petition containing 44
signatures of both business people and residents of the area
in support of the application. Lloyd Phillips, President of
the Highway #10 Business Association and owner of Lloyd's
Country Store, spoke in support of this application, and a
Mrs. Giggleman, a neighbor, spoke in favor.
Mrs. Miller spoke in opposition to the request and stated
the same arguments as stated in the earlier case.
Gene Pfeifer also spoke in opposition, restating his earlier
concerns and suggested that perhaps the answer in this case
would be the Board of Adjustment's approving an expansion of
the nonconforming use.
After this lengthy discussion, the Commission moved to
approve the application as filed. The motion was passed:
