The requested zoning does not conform with the adopted Heights/Hillcrest plan which shows this area for residential use. All of the nonresidential properties along Kavanaugh have a front door relationship with Kavanaugh. This property does not and it is within a block which is strongly committed to residential use. STAFF RECOMMENDATION Staff recommends denial. COMMISSION ACTION: The applicant was present and presented a brief synopsis of his proposal for use of the property. There were 23 opponents present. Among them, Ralph Brodie, representing members of his family owning a duplex to the west of the applicant's property, spoke in opposition and presented a petition with 10 signatures. Brian Tilley, an attorney representing other neighbors, presented a petition with 93 signatures. In addition, another neighbor spoke briefly in opposition. July 28, 1981 Item No. 3 - Continued The Commission, the applicant and neighbors went into a lengthy discussion of the proposed zoning, the Heights/Hillcrest Plan and other factors regarding this request, and after the discussion, the Planning Commission moved to approve the application as filed. The motion failed on a vote of 0 ayes, 10 noes and 1 absent. The application was declared to have been denied.
