15838 1 RESOLUTION NO. 15,838 2 3 A RESOLUTION TO AMEND LITTLE ROCK, ARK. RESOLUTION NO. 4 15,820 (NOVEMBER 15, 2022), TO AMEND THE REVISED CONTRACT 5 PURCHASE PRICE WITH VERMEER MIDSOUTH,IN AN AMOUNT NOT 6 TO EXCEED ONE MILLION, FIVE HUNDRED THOUSAND, ONE 7 HUNDRED SIXTY-SIX AND 79/100 DOLLARS ($1,500,166.79), PLUS 8 APPLICABLE TAXES AND FEES,TO ACCOUNT FOR THE INCREASED 9 COST FOR ONE (1) TG7000 TUB GRINDER FOR THE PUBLIC WORKS 10 DEPARTMENT LANDFILL DIVISION; AND FOR OTHER PURPOSES. 11 12 WHEREAS,on November 15,2022,the Mayor and Board of Directors approved the purchase of one 13 (1) TG7000 Tub Grinder to replace an older unit that has caused excessive maintenance costs and 14 down-time from Vermeer MidSouth for the Public Works Department, Landfill Division,with Little Rock, 15 Ark. Resolution No. 15,820; and, 16 WHEREAS,the contract approved was for the purchase of purchase one(1)TG7000 Tub Grinder for 17 an annual amount not to exceed One Million, Three Hundred Ninety Thousand, Forty-Three and 95/100 18 Dollars($1,390,043.95),plus applicable taxes and fees; and, 19 WHEREAS, the exorbitant price of heavy equipment has necessitated an increase in the contract 20 amount to a revised purchase price of One Million, Five Hundred Thousand, One Hundred Sixty-Six and 21 79/100 Dollars ($1,500,166.79), which is an increase of One Hundred Ten Thousand, One Hundred 22 Twenty-Two and 80/100 Dollars($110,122.80). 23 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK,ARKANSAS: 25 Section 1. The City Manager is authorized to amend the purchase contract with Vermeer MidSouth 26 to increase the amount paid by the City for one(1) TG7000 Tub Grinder in an amount not to exceed One 27 Million, Five Hundred Thousand, One Hundred Sixty-Six and 79/100 Dollars ($1,500,166.79), plus 28 applicable taxes and fees. 29 Section 2. Funds for this purchase are allocated in the American Rescue Plan Act, Account No. 30 271409-72200-G0601 AR40A. 31 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 32 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 33 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and [Page 1 of 21 1 Dollars($1,012,633.00)to provide Property and Casualty Insurance for City Buildings and Structures for 2 the term July 1,2022,to June 30, 2023. 3 Section 2. Funds for this agreement are available as a 2022-2023 Budget Line Item for Property 4 Insurance. 5 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 6 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 7 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 8 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 9 resolution. 10 Section 5. Repealer.
