1. A perimeter planting strip is required along any side of a vehicular use area that abuts
adjoining property. This strip shall be at least nine (9) feet wide.
2. The city official may grant not more than a twenty-five (25) percent reduction of these
provisions for developments within mature areas; Section 15-85 (c.)
VARIANCE REQUESTED:
Reduction of a portion of the required northern perimeter landscaping strip.
FINDINGS:
The property is located at 12,206 West Markham Street. The site encompasses 2.96 acres of
land and is currently zoned PCD and was utilized as an automotive dealership, Ellis Infinity.
The adjoining lot was used as an auto body repair shop. A single drive serves both lots extending
from West Markham Street. On January 51h of this year the Planning Commission approved to
revise the PCD; allowing the property's use to be changed adding a restaurant, retail, and
business office uses. The applicant is proposing to remodel the existing building; which is to be
used as C-3, general commercial uses. The development will also consist of the construction of a
single story building located directly to the west of the existing structure that will house a 7,377
square foot building. This building is planned to house a restaurant use. The development was
also approved to include the future construction of a 20,000 square foot, two-story office
building in the northeast corner of the property. A total of 164 parking spaces will serve the
three buildings.
The applicant has worked hard with city staff to bring this site into compliance. The only
outstanding issue is the perimeter landscape strip along a portion of Markham Street. The
applicant has indicated the location of utilities and other facilities which was less stringent when
the property was first developed and is fearful of any construction on this specific portion of the
parking area. Within the title search, the applicant discovered several occasions where special
conditions had been made to this property to accommodate utilities. The ordinance requirement
for this area is a nine -foot (9') wide perimeter landscape strip between the parking lot and
Markham Street. The existing condition of the area reflects a landscape strip that is
approximately six feet (6') near the entrance drive reducing down to near two feet (2') near the
eastern end of the existing parking. The required perimeter landscaping, plant material is being
proposed. There is also substantial green space within the right-of-way area; therefore, it appears
green within the street perimeter. The required shrubs are all within the perimeter landscaping
strip; however, the trees are located within the public right-of-way. A franchise application has
been filed with the Public Works Department for these trees to be planted within this area.
Overall, it is an upgrade to an existing site and staff feels the applicant has worked hard to come
into compliance in all the other areas on the site; therefore, staff is supportive of the requested
variance.
STAFF RECOMMENDATION:
Staff recommends approval of the requested perimeter landscape strip variance.

VARIANCE REQUESTED:
a. Alteration to the approved landscape plan.
FINDINGS:
The UU zoned property along the south side of W. 3`d Street, between Center and
Louisiana Street. This site now a parking lot which serves the Hatcher Agency, which is
located in the office building within the southeast portion of this block, and Vratsinas
Construction Company, which is located in the office building across W. 3`d Street to the
north. The parking lot on the west side of the alley contains 40 paved parking spaces, with
the lot on the east side of the alley contains 48 spaces. The lots are enclosed with a six (6)
foot high iron fence, with masonry columns. Vehicle entry gates (rolling gates) for each lot
are located along the alley right-of-way.
The applicant previously :requested and was granted variances from the City Beautiful
Commission; however has since decided they didn't want to install the street trees due to
the expense involved.
Staff is not supportive of the requested variance and thus recommends denial of the
application.
STAFF RECOMMENDATION:
Staff recommends denial of the requested application.
