Unified Development Code Commercial Tree Pruner/Service
EXISTING ORDINANCE
167.0 7; Commercial Tree Pruner/Service Certificate And Insurance Required
(A) Certificate required. Before cutting, pruning, removing, or trimming any tree within the City of
Fayetteville, the owner and supervisory personnel of each business performing commercial tree work
shall obtain a city issued commercial tree pruner/service certificate.
(B) Liability insurance. Each business performing commercial tree work, to include tree surgery,
within the City of Fayetteville, shall be required to carry liability insurance in the following minimum
amounts:
(1) General aggregate: $1oo,000.00
(2) Personal & advertising: $1oo,000.00
(3) Each occurrence: $1oo,000.00
Proof of coverage shall include the name of the insurance company issuing the policy, the name
of the insured, the policy number, effective and expiration dates, and the signature of an
authorized representative of the insurance
company.
(C) Workshop. Owners and supervisory personnel shall attend an educational workshop on basic tree
science and the proper techniques of tree pruning; or shall demonstrate sufficient knowledge of basic
tree science and the proper techniques of tree pruning by scoring 75% or higher on a test provided by
the International Society of Arboriculture (M.A.).
(D) Cervij icate issuance. A certificate shall be issued when an individual has successfully completed
the workshop or scored adequately on the test.
(E) Job site. It shall be the responsibility of the business owner to ensure that a copy of the certificate
is maintained at each job site.
(F) Supervision. All persons engaged in the business of trimming trees shall be under the supervision
of a certified tree pruner/service.
(G) Worker's compensation. Those individuals performing commercial tree work on public grounds
shall comply with all worker's compensation requirements as set forth under Arkansas law and shall
hold a city issued commercial tree pruner/service certificate.
(H) Licensure. Those individuals performing tree surgery shall comply with licensure requirements as
set forth under Arkansas law.

i67.07; Tree Care Professional Certification Card and Insurance Required
(A) Any person acting in self-employment or as an employee of a company engaged part or full-time
in tree pruning, tree root pruning, tree removal and/or stump grinding whether as an actual tree
worker or ground crew shall be bound by this code. This shall include but not limited to tree services,
landscape companies and property management companies.
(B) Certification Card required. All supervisory personal, tree workers and ground crew personnel
providing, for -hire work on trees within the City of Fayetteville shall obtain a city issued tree care
professional certification card prior to commencing any work.
(1) For an individual to obtain a Certification Card they must attend a City of Fayetteville
training workshop and pass an exam.
(2) Exemption to workshop and exam requirements;
Persons that currently hold a Tree Worker Certification, Certified Arborist, Utility
Specialist and/or Board Certified Master Arborists certifications from the
International Society of Arboriculture are automatically certified and do not need to
attend the workshop or take the exam. Persons that currently are Consulting
Arborists so designated by the Society of Consulting Arborists are automatically
certified and do not need to attend the workshop or to take the exam. Proof of
certification from the issuing agency is required.
(C) Workshop. All supervisory personnel, tree workers and ground crew personnel shall attend an
educational workshop on basic tree science and the proper techniques of tree care and/or shall
demonstrate sufficient knowledge of basic tree science and the proper techniques of tree care by
scoring 75% or higher on a test based on the International Society of Arboriculture (I.S.A.)
educational materials, American National Standards (ANSI), Occupation Safety and Health
Administration (OSHA) or other materials deemed appropriate by the Urban Forester. The test must
be taken within 3 days of the workshop. There may be several versions of the test in use at any one
time. The test and its various versions shall be updated from time to time but at least every three years
to reflect updates in technology, techniques and standards.
(D) Certification Card issuance. Within 3o days after an individual has successfully completed the
workshop and/or scored adequately on the test a free certification card shall be issued. New or
replacement cards will be issued as needed for a fee. Certification cards are non transferable.
(E) Job site. It shall be the responsibility of the business owner, general manager, site supervisor or
crew foreman to ensure that the original or genuine copy of each workers certification card is
available for inspection by the client, general public, law enforcement, code compliance officers, the
Urban Forester or his/her designee at each job site.
(F) Supervision. All persons engaged in the business of tree care should be under the supervision of
an I.S.A. Certified Arborist, Municipal Specialist, Utility Specialist or Board Certified Master Arborist;
or a Consulting Arborist designated by the American Society of Consulting Arborists or Society of
American Forester's - Certified Forester.

(G) Industry Standards. Those individuals or companies engaged in tree care should be aware of and
adhere to industry standards as developed by the Tree Cage Industry Association (T.C.I.A.). All tree
work and the work areas shall be governed by this code and its policies, ANZI A300/Z133.1 Standards
and all Occupational Safety and Health Administration safety rules and protocols. And/or any such
Federal, State and local laws in effect prior to this ordinance being adopted or that may be
promulgated after adoption.
(H) Liability insurance. Each individual or companies engaged in professional tree care work, to
include tree pruning, tree root pruning, tree removal and/or stump grinding within the City of
Fayetteville, shall be required to carry liability insurance in the following minimum amounts:
(1) General aggregate: $loo,000.00 (may wish to check this as it has not been updated
(2) Personal & advertising: $1oo,000.00 since 2002, suggest $300,000)
(3) Each occurrence: $100,000.00
Proof of coverage shall include the name of the insurance company issuing the policy, the name
of the insured (the name shall match the individual or company name or have a doing business
as, d.b.a. statement; under no circumstances will proof of insurance be accepted when the
applicant is acting as a third party under another companies insurance), the policy number,
effective and expiration dates, and the signature of an authorized representative of the
insurance company. The liability statement shall also state the coverage is for tree service work.
Landscaping, construction and other liability insurance will not be accepted.
(G) Worker's compensation. Those individuals or companies performing professional tree care work
shall provide proof of tree service workers compensation and shall comply with all workers'
compensation requirements as set forth under Arkansas law.
(H) Withholding Certification Card or Listing. Any individual who has attended the workshop and
passed the test or passed the test alone shall comply with all of the insurance requirements before
being issued a certification card or being placed on any City approved certification list. If insurance
lapses prior to the expiration of the certification card the City reserves the right to remove the
certified pruner from the certification list. It shall be the responsibility of the tree care professional to
keep the insurance current and on -file with the City.
(I) Licensure. Those individuals performing for -hire tree care work shall comply with any licensure
requirements for the City of Fayetteville or as established by Washington County or as set forth under
Arkansas law. Those advertising as Tree Surgeons must provide documentation that you are licensed
through the State Plant Board.
W Policies. From time to time the Urban Forester may develop or amend policies to enforce this
section of the Tree Preservation and Protection Chapter. These polices will be added to the Urban
Forestry Technical Manual. Being reference here gives them the force of law. (this needs to be flushed
out more)
(K) Revocation. At any time within the certification period the Urban Forester has the right to
withdraw certification from an individual or group of tree care professionals when singularly or in
unison he/she or they violate the Tree Preservation and Protection code, ANSI standards, OSHA
requirement or act recklessly to endanger the health and safety of the public welfare.

(I-) Advertisement. It shall be a violation of the intent of this section for companies to advertise that
the company is certified by the City of Fayetteville.
(1) Certification is for individuals only. Companies shall not advertise the company is certified.
The Urban Forester shall set sample advertising language within the policies of the Urban
Forestry Technical Manual or a copy of the complete advertisement may be submitted to the
Urban Forester for approval prior to advertisement. The City shall not be responsible for any
costs, time delays, change order fees or other costs/fees incurred by the certification holder
and/or the company he/she is employed by in advertising.
(2) At no time shall the use of City certification be used in the same advertisement as improper
arboricultural practices.
(M) Violations. [add language as need. It should reflect punitive daniages (penalties) for topping,
other improper arboricultural practices, mis-uses of certification etc. as well as curative damages
(money used to fix the problem)]
Something else to consider - there are many professions that affect trees not just tree services.
Many utilities such as telephone and cable work in the street ROW trenching or boring.
Plumbers connect new or repair sewer and water lines from the house to mains damaging yard
trees and street trees. Landscape companies trimming trees somehow think they are exempt
since they area a "landscape company" not a tree service. This is not true an Section (A) above
tries to clarify that.
Also, what about companies that fertilize yards and trees. Should they be looked at for the
potential damage to tree vitality and water quality they can do?

The City Beautiful Commission held its regular meeting Thursday, March 3rd, 2011, at
11:30 a.m. at Curran Hall. Vice -Chair Dicker called the meeting to order.

Motion: Commissioner Warren made a motion to accept the CBC minutes from the February
meeting with
changes noted.
Second: Commissioner Bell seconded the motion and it passed unanimously.
OPEN PUBLIC MEETING:
TREASURER'S REPORT: No report; treasurer resigned; Commissioner Tatum will
continue trying to reach her.
The floor opened for volunteers for CBC treasurer. Commissioner Bell volunteered.
Motion: Commissioner Warren made a motion to accept Commissioner Linda Bell as treasurer.
Second: Commissioner Cole seconded the motion and it passed unanimously.
COMMITTEE REPORTS: UPDATES:
OLD BUSINESS:
Landscape Awards -(Cole, Homeyer, Wise) -Commissioner Homeyer showed the new 2011
Landscape Award signage. Commissioner Cole will send out an email to hke
and Commissioner Wise for its launch. It was also noted for the press release we would need to J
work with one of the 2010 Landscape Award winners for the Public Service Announcement
(PSA).
Eye of the Beholder (Tatum)- Commissioner Homeyer noted he would bring some of the signs
for the Eye Award to the next meeting. It was noted more cards are needed. CBC keep your
eyes open for nominations throughout the city.
Community Pro'ects
I-630 Trees -(Jennings, Dicker, Marvel) -meeting was cancelled due to inclement
weather. Committee will reschedule.
Website (Warren) -Commissioner Warren continues working with Jan from Aristotle. The
training is planned for early April; plans are to debut the new page in April too. Changes
planned include photos of the Little Rock area that rotate with the season(s). A date of May 2r'd
was discussed for a website debut. The newspaper could possibly cover the announcement of the
site.
Library Exhibit- Tatum -Commissioner Tatum noted being overwhelmed and asks for any
volunteers to help. Commissioner Wise and Commissioner Bell both stated they'd help.
Commissioner Tatum noted the exhibit needs some updating.
Joe Arnold arrived.
Brochure- (Bellj_Commissioner Bell received data from Lynn of prior work done on
informational pamphlets. A decision needs to be made prior on whether to produce anything
depending upon the need(s), audience, etc. Commissioner Tatum mentioned the use of business
cards. On the cards information such as the CBC Logo, the history, awards, mission statement,
etc could be added. City staff noted recently doing three cards on a website and will mock
something up for the CBC to review. A 3 X 5 card size was discussed.
NLRB Jennin s - no report.
Ada t-A-Street Jennie s - Commissioner Jennings noted working on the list of current
adopters of streets. It is taking longer than expected. It was noted the contracts are for a five (5)
year duration.
Communications -(Cole) -Commissioner Cole noted making various media contacts and awaiting
responses. It was noted that the website debut and award information can be advertised; inform
Commissioner Cole of any advertising needs and she will try to help.
Awards Committee Warren Wiedower - Commissioner Warren distributed a handout with a
synopsis of the CBC awards; please review for next months meeting.
NEW BUSINESS:
Catherine McDonald and Joe Arnold addressed the CBC regarding the issue of smoking and
using tobacco products in public spaces; including public parks. It was noted the Parks
Commission had adopted a "Policy". It was noted additional signage was needed. It was noted
the City of Conway banned smoking in city parks in March of 2010 that includes a twenty-five
dollar ($25.00) fine. Enforcement is needed. Commissioner Warren noted that with all the
recent changes smokers might be beginning to feel ostracized. Commissioner Warren noted that
the CBC needs to be sensitive to these individuals too. Commissioner Homeyer inquired what
the CBC is being requested. The guests noted they would appreciate the support of the CBC for
an ordinance for a smoke free (tobacco free) ordinance.
Motion: Commissioner Homeyer made a motion to table this issue until next months CBC
meeting for further discussion.
Second: Commissioner Young seconded the motion and it passed unanimously.
Over pruning of city trees: (Warren)- Commissioner Warren noted she'd recently spoke with
Mr. Robbie Hudson, City Urban Forester regarding the requirement of a "pruning certification".
It was recommended to get some verbiage from the City of Fayetteville and model something to
present to the City Board of Directors and the Mayor. Perhaps, a one -day event for training and
it would also need a fining mechanism for violations. Commissioner Warren noted she would
check with other cities and get back to the CBC next month.
Motion: Commissioner Cole made a motion to table to the Mission Statement re -write until the
next months CBC meeting.
Second: Commissioner Warren seconded the motion and it passed unanimously.

COMMISSION
The City Beautiful Commission (CBC) was established in 1947 and is responsible for ensuring a high level
of visual aesthetic quality in the Capital City. The goal of the Commission is to raise the level of
community expectations for the quality of their environment and these community awards help with
this goal.
Three awards were identified as the main focus for the City Beautiful Commission at this time:
1. Landscape Award
Description: This award is the Commission's oldest annual award and was introduced in 1979 by
Bob Brown, former Landscape Administrator in the Planning and Development Department to
recognize new developments that went beyond the city requirements to develop or improve
their new landscape. The first awardee was Trellis Square Shopping Center. Currently, the award
recognizes the "Top Three Best of the Best" from that year's nominations.
Award: The winners are recognized in front of the Board of Director's meeting in the Fall with a
framed annual poster, long-stemmed red rose (symbolic of the commission's logo) and a yard
sign to display for a year at their development.
Nomination: This award is open to public nominations but primarily comes from the Planning
and Development Department. Nominations are open from May until August and voting occurs
at the September commission meeting.
2. Eye of the Beholder Award
Description: This award was introduced in 2002 by former Commissioner Ann Ivey and is two-
fold: It recognizes residents in the city that have promoted and improved the landscape in the
City and it recognizes beautiful residential yards and that resident's dedication and hard work to
improve the landscape of our City. It is a very popular award with the recipients.
Award: The winners receive an attractive certificate signed by the commission and the mayor
and a yard sign to display in their yard for 1-2 months. The yard sign can be recycled by the
awardee when done in their curbside recycling bin. The award time frame is typically open from
March through October.
Nomination: This award is open to public nominations but primarily comes from the
Commission
I Sec. 15-30. Aims and goals.
2 The city beautiful commission is accountable directly to the board of directors and under the general
3 supervision of the city manager. The commission shall be responsible for the establishment and
4 maintenance of plans to ensure a high level of visual aesthetic quality. The goal of the city beautiful
5 commission shall be to raise the level of community expectations for the quality of its environment.
6 Sec. 15-31. Role, duties and responsibilities.
7 (a) The role of the city beautiful commission is to be responsible for the establishment and maintenance
8 of plans to control litter, weeds, abandoned vehicles and appliances, soil erosion and to otherwise ensure a
9 high level of visual aesthetic quality, specifically including but not limited to the visual appearance of
10 parks and open spaces, streams and other bodies of water, drainage ditches, structure, hillsides,
riverfronts, utilities, signs, vehicle parking and, sales lots, outdoor storage, trees and other natural
12 vegetation, natural landscaping, streets and railroads.
13 (b) The commission has the following duties, responsibilities and powers:
14 (1) To promote public interest in the general improvement of the appearance of the city.
15 (2) To prepare and transmit to the board of directors recommended policies implementing the plans
16 prepared by or for the commission.
17 (3) To establish, subject to approval of the board of directors, regulations of aesthetic quality for public
18 and private lands and improvements.
19 Sec. 15-32. Fiscal procedure.
20 The city beautiful commission is subject to all fiscal procedures of the city.
21 Sec. 15-33. Funding.
22 The planning and development department shall be responsible for relaying budget requests of the city
23 beautiful commission to the city manager and board of directors. The commission shall have the authority
24 to accept any and all donations, and the city shall establish and maintain separate accounts to receive such
25 funds.
26 Sec. 15-34. Committees.
27 The city beautiful commission may appoint any number of citizens to serve on committees as ex officio
28 members.
29 Sec:15-35. Article cumulative.
30 This article shall not in any manner supersede the authority or duties of any other commission, board or
31 agency duly established by ordinances or resolutions of the board of directors, and shall not in any
32 manner be interpreted to interfere with such duties that have been established by such ordinances or
33 resolutions of any such commission, board or agency.
