The City Beautiful Commission met on Monday, December 19,
1988 in the Riverfront Park Activity Center for a pre -agenda
meeting on the First United Methodist Church Child Care
Facility Parking Lot on 9th Street. The Public Hearing was
called to order at 9:30 a.m., and the regular meeting was
called to order at 10:00 a.m. Jim vonTungeln, chairman,
presided.

1. Pre -agenda meeting. Bob Brown explained the variance
request to members of the Commission, and asked Mr. Bob
Price for his comments. The commission members discussed
the proposals and various options.
The pre -agenda meeting was adjourned.
2. Chairman Jim vonTungeln called the Public Hearing to
order for the purpose of hearing CBC-535, First United
Methodist Church, 314 West 9th Street. (See Attached).
A quorum was found (6 of 8 present) .
Jane Rogers moved that the First United Methodist Church
be granted the variance according to staff
recommendation. The motion was seconded by Joe Frankin.
Motion carried by a vote of 6 ayes and no noes.
Chairman vonTungeln called the public hearing closed at
9:35 a.m.

purpose of the Landscape Awards Program. Jim introduced
special guests Mayor Lottie Shackelford, Asst. Mayor
Buddy villines, and City Director Sharon Priest. Plaques
were presented to the following entities.

Rivercliff Apartments, Federal Aviation Administration
Building, Shoney's Restaurant on Geyer Springs Rd.,
McDonald's Restaurant on Geyer Springs Rd., Quality

Parham Place, and the Little Rock Corporate Center.

Ordinance Requirement:
Must provide a three (3) foot peripheral landscaping strip along the
west and north property line of proposed parking lot with a shrub
every ten (10) feet and a tree every forty (40) feet.
Variance Request:
Deletion of west and north property line peripheral landscaping
strips.
Findings:
This property currently has an abandoned liquor store on it which
applicant plans to remove and provide parking for employees of the
First United Methodist Church Child Development Center. -The parking
lot is approximately 250 feet south of the Child Care Center. The
lot is immediately abutted on the west and north by buildings with
zero (0) setbacks.
Staff Recommendation:
Since this lot is abutted by buildings to the west and north with
zero (0) setbacks making plant survival difficult because of the
reflection factor in hot weather and, because of the extra street
landscaping the applicant is providing, which is much more visible,
staff recommends the peripheral delection be granted.

BOARD ACTION:
The applicant was represented by Mr. Bob Price. There were
no objectors present. After a discussion, a motion was made
by Jane Rogers that the variance be granted to First United
Methodist Church as per staff recommendation. The motion was
seconded by Joe Franklin. The motion carried by a vote of 6
ayes and no noes.
There being no further business before the board for land-
scape variances or related matters, the public hearing was
adjourned.

The Little Rock City Beautiful Commission held its regular
meeting Monday, November 21, 1988 at 10:00 a.m. in the River -
park Activity Center. Jim vonTungeln, Chairman, presided.

2. Approval of Minutes: Minutes of October meeting approved
as mailed.
3. Reports of Committees:
A. City Beautiful Kids - Bert Parker moved that the
Commission sponsor the City Beautiful Kids Program
again in 1989, motion was seconded and the vote was
unanimous. Bert Parker said that we need to find
another volunteer to work with Rip Rowan.
B. Litter Ordinance - It was noted that a letter had
been sent to the new police chief requesting that
litter ordinances be enforced. Joe Franklin
requested that the committee on litter legislation
meet prior to the next meeting.

C. Capitol Avenue - Bob Callans reported that the
Capitol Avenue Task Force had met with Robert McNulty
of Partners for Livable Places when he was in Little
Rock in October. They felt they had a very
successful meeting. The task force is going to try
to hire Mr. McNulty to do a proposal for strategy
development. This will probably cost up to $20,000,
but will be paid for with private donations.
4. Nomination of 1989 Officers. Jim vonTungeln reported
that he had forgotten to appoint the nominating committee
at the October meeting, but had appointed it later by
phone. The members of the committee are A. J. Almand,
Ken Bernard, and Bert Parker. Bert reported the recom-
mendations of the committeelas follows:

Bob Callans moved that the report of the nominating com-
mittee be accepted and the nominees be elected by
acclamation. Ken Bernard seconded the motion and the
motion carried unanimously.

Bert Parker moved that the list be accepted in its
entirety, Ken Bernard seconded the motion, vote was
unanimous. Jim vonTungeln asked Gayle to notify the
winners. Jim asked for a motion to appropriate money to
buy plaques and to pay for refreshments for the
reception. Tim deNoble moved that no more than $500 be
spent for plaques and refreshments, Bob Callans seconded
the motion, and the vote was unanimous.

6. Glad Bag-A-thon - After a discussion, it was decided by
Commission members that the Commission has to much to do
in 1989 to take on another project.
7. January and February Meeting Dates. Jim told the_
commission members that due to the January and February
meetings falling on city observed holidays that we would
need to change our meetings. The January and February
meetings will be held on the second Monday (January 9 and
February 13) in lieu of the third Monday.
8. Miscellaneous.
A. Bob Callans distributed a copy of an ordinance from
the City of Keene, New Hampshire relating to the
Keene Memorial Tree Fund. Members of the Commission
were asked to look it over to see if it were
something that we might -be interested in.
B. Landscape Ordinance - Jim recognized Richard Wood who
then introduced Mrs. Ruth Bell of the League of Women
Voters. Jim told the Commission members that the
Board of Directors had instructed the Commission to
look at the a proposed ordinance by the Planning
Commission for the City Beautiful Commission's input.
Jim said that he and Bert Parker had met with Richard
Wood regarding the Planning Ordinance.
C. Bob Callans said he would be meeting with Don
McChesney the next day at noon on the Landscape
Ordinance. Mrs. Bell said that the League would like
to be in on the revision of the Landscape Ordinance.
D. Jim welcomed Ellen Yeary, who is an intern from the
Leadership Institute and will be attending the City
Beautiful Commission meetings.
E. Members asked Bob Brown for updates on various land-
scaping projects around town.

5. Approval of Minutes. Minutes of the September meeting
were approved as mailed.
6. Reports of Committees:
A. Capitol Avenue Improvement Project. Bob Callans
reported that Mr. Robert McNulty of Partners with
Livable Places would be in Little Rock and had
reserved time for the Capitol Avenue Committee. He
reported that the committee was looking into having a
study performed on the Capitol Avenue Project.
B. Litter Legislation - Joe Franklin reported that a
copy of the model litter ordinance and the Little
Rock litter ordinances were being reviewed by the
City Attorney's office.
Bert Parker again asked about a letter being sent to
the Police Department requesting enforcement of the
litter laws that we do have. Gayle told him that we
were waiting for the new police chief to come in and
the letter would be sent soon after his arrival.
C. Tulip Project. Members of the commission remarked on
the tulip project, and said there seemed to be more
publicity this year.
D. Irish Spring Development Judging. Gayle reported
that Ken Bernard had gone out and judged the Irish
Spring Development and that he had awarded a tie.
7. Jim vonTungeln told the members that Commissioner Connie
Whitfield had been named to the Planning Commission,
therefore we have a vacancy on the Commission.
8. Glad- Bag-A-Thon. A letter had been received asking
Little Rock to participate in the Glad Bag-A-Thon. The
members asked that this item be deferred until the
November meeting.

9. Landscape Awards. Jim vonTungeln reminded members that
nominations for landscape awards are due and members
should be prepared to make them during the November
meeting. It was mentioned that Park Plaza had done an
excellent job and they should receive an award. Members
were reminded that the criteria calls for the landscaping
to be in for one year. It was decided that a letter
would be sent to Park Plaza commending them on their
excellent landscaping.
10. Miscellaneous:
A. A. J. Almand asked about the landscaping on the new
parking lot at 2nd and Main Streets. Bob Brown said
that there is a landscape plan and that the work
be started within the next couple of weeks. It had
been determined that it would be easier to pave the
lot and then cut the paving out where the landscaping
was to go.
B. A. J. recommended that we explore the possibility of
lighting the Broadway Bridge similar to the way the
Mississippi River Bridge is lit in Memphis. Members
felt this was a good idea. Jane Rogers state that
there were many people interested in this project.

based on surrounding property expected to be rezoned for
industrial use.
STAFF RE OMMENDA. TION:
Since the surrounding property does not appear to be
suitable for residential use the staff recommends a waiver
of the screening requirement be granted. Because of the
magnitude of the site the staff feels 'trees would be more
effective than shrubs and recommends planting pine trees at
least b feet in height every 20 feet or 8 feet in height
every 30 feet in lieu of the shrubs.

Congratulations on being selected as Little Rock's new police
chief. I am sure from what I have read that the Civil
Service Commission made an excellent choice.
I am sure that you have found Little Rock to be a quality
city with one or two exceptions: there is far too much
litter, too much dumping on private and public property, and
too much debris being scattered by uncovered trucks.
The Board has adopted ordinances against these acts that mar
this city's beauty, but enforcement has not always received a
high priority.
The members of the City Beautiful Commission join with me in
urging that the enforcement of these laws be given the same
attention as any other law.

B. Tulip Bulbs - Jim asked Gayle to report on the tulip
bulb project. Gayle said that 15,000 bulbs had been
ordered and were scheduled for delivery that week.
The bulbs will again be distributed through the
Pulaski Heights Merchants and Professional Assoc.

will be responsible for promotion and distribution.
C. Flag Competition - Jim reported that we had received
approximately 24 letters of intent to enter. The
competition will end October 7, and we will need to
judge the entries during the week of October 10. A
special meeting was scheduled for October 12 at 5:30
in the Riverfront Park Activity Center.
D. Litter Legislation - The members were not ready to
discuss the model ordinance that had been
distributed. Julius told them that a copy had been
sent to the City Attorney for comparison to what we
now have.
4. Irish Spring Development - The Commission had been asked
to send someone out to judge a competition that was
sponsored by the developers to encourage property owners
to landscape their property. Ken Bernard, Connie
Whitfield and Bob Callans volunteered to go out and
judge.
5. Membership - Members whose terms expire in October are
Tim deNoble, Jim vonTungeln, and A. J. Almand. Gayle
said that A. J. had expressed a desire to remain on the
commission. Tim deNoble and Jim vonTungeln also
expressed a desire to remain on the Commission. Gayle
said she would send a memo to the board requesting that
these members be reappointed.
6. Landscape Ordinance - Bob Brown of Environmental Codes
told the members of the Commission that consideration was
being given to lowering the $100 fee for landscape
ordinance variance requests. Members of the commission
expressed their view regarding this. Bob also told the
commission that he had received a request for a public
hearing for the next City Beautiful Commission meeting.
Bob told the members that this request is quite
complicated since it involves a 26 acre tract. The
request is from Freightways.

Bob also discussed the cutting of trees on Rodney Parham
Road in front of the Market Place Center. He had been
requested by a member of the Commission to look into this
action. It was found that when trees are taken out of
the street right-of-way, a permit is required. In this
case Market Place had not obtained a permit. Their
reason for cutting the trees were that they created a
traffic hazard. The Traffic Department recommended that
the trees not be replaced.
7. Miscellaneous.
A. Jim vonTungeln reminded the members that nominations
for Landscape Awards are due soon and they should
start making notes for their nominations.

The City Beautiful Commission held its regular meeting,
Monday, September 19, 1988 in the Riverfront Park Activity
Center, Jim vonTungeln, chairman, presided.

A. Capitol Avenue - Bob Callans reported that the Task
Force had met on September 14, 1938 at the Legacy
Hotel. A committee was formed at that meeting to
contact property owners along Capitol Avenue, members
of the committee are: Jim Summerlin, Sue Bryant,
Steve Stephens, Ron Newman, and Bob Callans. Bob
reported that Ken Bernard of Arkansas Waste, Inc had
sponsored half of the luncheon and that Virginia
Bailey had sponsored half. Bob said that there were
some small bills and asked that the Commission pay
these. Gayle reminded the members that there was
money in the Special Account for Capitol Avenue. Ken
Bernard moved that Bob's expenses be paid, motion was
seconded by Tim deNoble, motion carried by a
unanimous vote.

B. Tulip Bulbs - Jim asked Gayle to report on the tulip
bulb project. Gayle said that 15,000 bulbs had been
ordered and were scheduled for delivery that week.
The bulbs will again be distributed through the
Pulaski Heights Merchants and Professional Assoc.

C. Flag Competition - Jim reported that we had received
approximately 24 letters of intent to enter. The
competition will end October 7, and we will need to
judge the entries during the week of October 10. A
special meeting was scheduled for October 12 at 5:30
in the Riverfront Park Activity Center.
D. Litter Legislation - The members were not ready to
discuss the mpdel ordinance that had been
distributed. Julius told them that a copy had been
sent to the City Attorney for comparison to what we
now have.
4. Irish Spring Development - The Commission had been asked
to send someone out to judge a competition that was
sponsored by the developers to encourage property owners
to landscape their property. Ken Bernard, Connie
Whitfield and Bob Callans volunteered to go out and
judge.
5. Membership - Members whose terms expire in October are
Tim deNoble, Jim vonTungeln, and A. J. Almand. Gayle
said that A. J. had expressed a desire to remain on the
commission. Tim deNoble and Jim vonTungeln also
expressed a desire to remain on the Commission. Gayle
said she would send a memo to the board requesting that
these members be reappointed.
6. Landscape Ordinance - Bob Brown of Environmental Codes
told the members of the Commission that consideration was
being given to lowering the $100 fee for landscape
ordinance variance requests. Members of the commission
expressed their view regarding this. Bob also told the
commission that he had received a request for a public
hearing for the next City Beautiful Commission meeting.
Bob -told the members that this request is quite
complicated since it involves a 26 acre tract. The
request is from Freightways.

Bob also discussed the cutting of trees on Rodney Parham
Road in front of the Market Place Center. He had been
requested by a member of the Commission to look into this
action. It was found that when trees are taken out of
the street right-of-way, a permit is required. In this
case Market Place had not obtained a permit. Their
reason for cutting the trees were that they created a
traffic hazard. The Traffic Department recommended that
the trees not be replaced.
7. Miscellaneous.
A. Jim vonTungeln reminded the members that nominations
for Landscape Awards are due soon and they should
start making notes for their nominations.

Approval of Minutes of July, 1988 meeting: Minutes
approved as distributed.
Reports of Committee:
A, City Beautiful Kids. Connie reported that the CBK
program would end on .August 19. There will be an
awards program held at the Robinson Centre at 11:00
a.m., and KSSN is sponsoring a fish fry for 1--he CBK
at 11:00 a.m. at the Riverfront Parr Activity Center.
The City Beautiful Kids picked up 120 tons of trash
and litter, and cleaned approximately 130 miles of
streets. They worked in parks and also cleaned
numerous alleys.
B. Flag Competition. Flag Competition rules were handed
to the commission. Bob Callans moved that the
document be accepted, Bert Parker seconded the
motion, motion carried unanimously.
A discussion was held as to how to get the word out,
It was suggested that the competition rules be sent
to the school district, and to the press.

C. Capitol Avenue Improvement Project. Bob Callans
reported that he had been working on the luncheon for
the Capitol Avenue Improvement Task Force. Luncheon
is to be held Wednesday, September 14 at the Raddison
Legacy Hotel. Bob read the list of Task Force
members.
D. Litter Legislation. Copies of current city litter
ordinance and a model litter ordinance were handed to
members of the commission. Members were asked to
look over this material for discussion at the next
meeting.
4. Miscellaneous
A. Bob Brown the Environmental Review Coordinator in the
Environmental Codes Division of Public Works
Department was introduced. He will be working with
the Landscape Ordinance in the future. Bob said he
looks forward to working with the Commission and the
members of the Landscape review committee. Bert
Parker said that the members of the Landscape Review
Committee is himself, Tim deNoble and Jim vonTungeln.
B. Bert Parker discussed the new trash containers that
the city is using and said he did not like them. He
thought they were unsightly, especially when they
were left out on the street. He said many people
were not removing them after the Sanitation Dept.
picked up the trash.
C. Bert Parker asked that the minutes of this meeting
reflect a break down of attendance by Commissioners.

D. Ken Bernard requested that a copy of the letter to
Senator Pryor be sent to Charlene Hardcastle.

A. City Beautiful Kids. Gayle reported that the Kids
program is in full swing. She said that a Media
Event, Operation Criss Cross, is being planned for
July 27 & 28 in the Central Ii.igh area. She also
reported that KSSN is going to sponsor a fish fry for
the Kids and the Sponsors. This will. be on August
19. More details will follow.
B. Capitol Avenue Improvement Project. Bob Callans
reported that he had been in contact with State Rep
Bill Foster who is highly interested in the project.
It has been suggested that a Task Committee be set zap
and that the initial meeting be a luncheon. Bob said
he possibly had a partial sponsor for the luncheon.
Ken Bernard offered to sponsor either in part or
whole the luncheon. Bob requested that Gayle send
out the invitations.

4e Jim vonTungeln noted that we have had correspondence from
the Sierra Club requesting that the Commission write a
letter to Senator David Pryor supporting clean air legis-
lation coming up this year. The Commission discussed
this and it was the members' thoughts that they did not
want to sign the proposed letter, but would draft one of
their own. Ken Bernard said he would draft the letter
get it to Gayle for typing.
5. Miscellaneous:
A. Ken Bernard asked if there is a possibility of asking
the mayoral candidates to come to a commission
meeting to discuss their views on items of interest
to the Commission. It was agreed that the candidates
would be invited prior to the election.
B. Bob Callans discussed the condition of the parks.
A. J. Almand said that the commission should express
appreciation and thank you to Julius Breckling for
all that he has done and ask the city to support a
stronger maintenance program.
C. Bob Callans brought up attendance of members and said
that those who were not coming to the meetings should
be notified and reminded of the attendance policy of
the City.

Dear Senator Pryor:
We are writing to you to seek your assistance in ending the congressional
stalemate over legislation to clean up our nation's air pollution problems.
On November 20, 1987, the Senate Environment and Public Works Committee
reported legislation to strenthen the Clean Air Act. But the Senate
Majority Leader, Senator Robert Byrd, has refused to schedule this critical
public health legislation. Further delay will subject Americans to
unnecessary lung disease, birth defects, and cancer.
This legislation will not move forward unless Senators such as yourself
speak out for it. We urge you to call publicly for the U.S. Senate to act
NOW to consider this legislation. Specifically we urge you to support the
Environment Committee's bill, S.1894, which offers feasible solutions to
our nation's air problems. This legislation is urgently needed because
even though Arkansas is a relatively small contributor to the problem, we
share equally in suffering it's adverse effects. Arkansans will benefit
moreso from the protection this bill provides us from heavy polluting
industries in other states than any costs we would incurr in keeping our
industries clean.
Acid Rain falls in Arkansas. In April 1988, Little Rock had rainfall with a
pH level of 4.6, which is 10 times more acidic than normal rain. Sherwood
had a pH level of 5.1 and Roland had a pH level of 4.9 which is approx.
5 to 7 times more acidic than unpolluted rain. If this acid rain continues
for an extended period of time, or worsens as it has in other parts of the
country, Arkansas will face an economic and environmental threat coming
from outside its own borders. Why not legislate and enforce strict
national clean air standards so that Arkansas will not have to absorb the
pollution caused by industries outside our borders.
CLEANUP IS POSSIBLE AND AFFORDABLE
The Senate Environment Committee bill S.1894 can solve these problems. It
contains provisions to clean up urban smog, stop acid rain and curb toxic
air pollution. It includes a new program to accelerate the identification
and control of toxic air pollutants from routine and accidental releases.
And it includes a 50% reduction in the pollution which causes acid rain.
This kind of cleanup program is the only way to stop acid rain pollution
from blowing into our state from other parts of the country.
The costs of these programs are affordable. The estimated costs of the new
controls on automobiles to clean up urban smog in other parts of the
country are $55-100 -- about the price of a hubcap. The program to control
toxic pollution is expected to cost polluter's less than $1 billion a year.
Because Arkansas is a clean state, the acid rain control program will cost
each citizen about $.20 a week.
We are extremely disappointed that Arkansas Power and Light has exaggerated
the costs of the acid rain provisions of the bill. The installation of
scrubbers would not be necessary for our state to come into compliance.
Historically, we have either intermittenly met or have been close to
meeting the standards set out in S.1894. We compliment AP&L in their past
and present efforts. However we can do better by meeting these standards
consistently. We are anticipating the results of the test burn on Arkansas
lignite presently being conducted. Since it takes more of the fuel to
produce the same amount of energy as coal, we will be watchful as to what
burning more of this fuel will do to our air.
Once again we urge you to reject the arguments of Arkansas Power &
Light and understand that Americans require a Clean Air Bill of Rights.
These rights can be guaranteed by enactment of S.1894. We hope that you
will co-sponsor this much needed public health legislation. This issue is
a mainstream issue that affects all Americans and the quality of our lives.
Our hope is you will consider it as such.

2. Approval of Minutes. Minutes of the April meeting approved

A. Arkansas Conference on Beautification. Jim vonTungeln
reported the conference was a huge success and that we
did make some money on it. We do not have an accurate
count at this time. We had approximately 75 people
there and 24 cities represented.
B. City Beautiful Kids. Connie Whitfield reported that 120
youth have been hired. We currently have 15 sponsors
and Rip is looking for five more. She asked Rip if he
had anything to report. Rip said that we have six
committed, and still need six. We are hoping that the
City will come through with some of what we need. Rip
told the Commission that he had hoped that the program
could be expanded this year, but we still have only 1.20
kids. He told the Commission of the warm reception that
he received from the local businessmen that he has
called on and that everyone is very proud of the City
Beautiful Kids Program.

C. Litter Legislation. Joe Franklin reported that letters
had been sent to about 25 states requesting information
on their litter legislation. Answers are beginning to
come back. Joe and Ken will study these legislative
acts and then make recommendations.
D. Capitol Avenue Improvement Project. No report, Bob
was leaving town due to a death in his family. The
Commission expressed its sympathy.
E. Riverfest Display. Tim deNoble reported that Riverfest
will definitely be using the Belvedere as a meeting
place for volunteers. The," Commission decided that it
would be best not to use the Belvedere for a display.
4. Miscellaneous:
A. Jim von Tungeln told the Commission members that they
had been requested to hold a design competition for the
selection of a City of Little Rock Flag. Members agreed
sponsor the competition. More details will be available
at the June meeting.
B. It was reported that landscaping is being done at 6th
and Broadway.
C. Due to the City Beautiful Kids program starting on June
20, 1988, the next meeting will be held in the
2nd floor conference room at City Hall.
