3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO.
4 15,420 (APRIL 6, 2021), TO AMEND THE CONTRACT WITH SUMMIT
5 TRUCK GROUP OF ARKANSAS, LLC, TO REFLECT ITS PURCHASE
6 BY RUSH TRUCK CENTERS OF ARKANSAS, INC.; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, pursuant to Little Rock, Ark. Resolution No. 15,420 (April 6, 2021), the Board of
10 Directors approved the purchase of three (3), Twelve (12) Cubic-Yard Dump Trucks with Auxiliary
11 Hydraulics capable of operating existing snow removal equipment for the Public Works Department Street
12 Operations Division; and,
13 WHEREAS, on December 13, 2021, Rush Truck Centers of Arkansas, Inc., acquired the operating
14 assets of Summit Truck Group of Arkansas,LLC; and,
15 WHEREAS,the Fleet Services Department has completed the process to receive and outfit one(1)of
16 the Dump Trucks to the specifications of the Public Works Department and seeks authorization to submit
17 invoices for payment under the new entity name of Rush Truck Centers of Arkansas, Inc., due to its
18 purchase of Summit Truck Group of Arkansas, LLC's, operating assets to complete the purchase of the
19 Dump Trucks.
20 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The City Manager is authorized to amend the contract with Summit Truck Group of
23 Arkansas, LLC,to reflect the purchase of their operating assets by Rush Truck Centers of Arkansas, Inc.,
24 to complete the purchase of three (3), Twelve (12) Cubic-Yard Dump Trucks with Auxiliary Hydraulics
25 capable of operating existing snow removal equipment for an amount not to exceed Four Hundred Forty-
26 Six Thousand, Five Hundred One and 95/100 Dollars($446,501.95).
27 Section 2. Funds for this purchase are available in the Public Works Street Department Account No.
28 205409-72300-S40B639 with payment directed to Rush Truck Centers of Arkansas, Inc.
29 Section 3.Severability. In the event any title,section,paragraph,item,sentence,clause,phrase,or word
30 of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication
31 shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the
32 portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution.
33 Section 4. Repealer. All laws, ordinances and resolutions, or parts of the same, including, but not
34 limited to Little Rock Resolution No. 15,420 (April 6,2021), that are in consistent with the provisions of
35 this resolution,are hereby repealed to the extent of such inconsistency.
