3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH OAKLEY FERTILIZER, INC., IN AN
5 AMOUNT NOT TO EXCEED THREE HUNDRED THOUSAND DOLLARS
6 ($300,000.00),FOR THE PURCHASE OF ROCK SALT IN BULK FOR THE
7 PUBLIC WORKS DEPARTMENT STREET OPERATIONS DIVISION;
8 AND FOR OTHER PURPOSES.

10 WHEREAS, the Public Works Department Street Operations Division utilizes bulk De-Icing Rock
11 Salt during adverse winter weather to remove snow and ice from the roadways; and,
12 WHEREAS, the Public Works Department has obtained a bid quote from Oakley Fertilizer,Inc.,being
13 One Hundred Thirty-Five Dollars($135.00) per ton for Pre-Treated Rock Salt and One Hundred Twenty-
14 Three Dollars ($123.00) per ton for Untreated Rock Salt as needed, and has also consulted with the
15 Arkansas Department of Transportation, (ArDOT Bid Contract No. H-23-220H) with Oakley Fertilizer,
16 Inc., being the lowest responsible bidder meeting specifications.
17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a contract with
20 Oakley Fertilizer, Inc., for the purchase of Rock Salt in bulk for the Public Works Department Operations
21 Division at a cost of One Hundred Thirty-Five Dollars($135.00)per ton for Pre-Treated Rock Salt and One
22 Hundred Twenty-Three Dollars($123.00)per ton for Untreated Rock Salt per ton as needed, in an amount
23 not to exceed Three Hundred Thousand Dollars ($300,000.00) for a period of one (1)-year, with an
24 additional one (1)-year extension, if so agreed to by both parties, to be utilized during adverse winter
25 weather events to remove snow and ice from the roadways.
26 Section 2. Funds for this purchase are allocated in Account: Streets & Drainage Maintenance No.
27 #204003 -61020.
28 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
32 resolution.
33 Section 4. Repealer. All laws,ordinances, resolutions,or parts of the same,that are inconsistent with
34 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
