3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH CXT, INC., IN AN AMOUNT NOT TO
5 EXCEED ONE HUNDRED FIFTEEN THOUSAND DOLLARS
6 ($115,000.00), PLUS APPLICABLE TAXES AND FEES, FOR
7 CONSTRUCTION SERVICES FOR THE WESTERN HILLS RESTROOM
8 PROJECT; AND FOR OTHER PURPOSES.

10 WHEREAS, Citizens in the Western Hills Neighborhood and the surrounding area have supported
11 this project for many years and are excited to see continued construction towards the completion of the
12 development of a neighborhood park; and,
13 WHEREAS, the Parks and Recreation Department requests a contract with CXT, Inc., for
14 Construction Services of a Prefabricated Restroom Structure for the Western Hills Park; and,
15 WHEREAS, funds will be provided by the Western Hills Park 3/8-Cent Capital Improvement Sales
16 Tax Funds,Account No. 326459-TS45A20 and Legacy Grant Funds,Account No. 270459-G23147; and,
17 WHEREAS,the project shall be purchased through the Sourcewell Cooperative Purchasing Program,
18 Contract No. 081721-CXT, for a cost of One Hundred Fifteen Thousand Dollars ($115,000.00), plus
19 applicable taxes and fees.
20 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF I'HJ CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The City Manager is authorized to execute a contract with CXT,Inc., in an amount of One
23 Hundred Fifteen Thousand Dollars($115,000.00),plus applicable taxes and fees,for Construction Services
24 of a Prefabricated Restroom Structure for the Western Hills Park.
25 Section 2. Funds will be provided by the Western Hills Park 3/8-Cent Capital Improvement Sales Tax
26 Funds,Account No. 326459-TS45A20 and Legacy Grant Funds, Account No. 270459-G23147.
27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
31 resolution.
32 Section 4. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
33 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
