3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A SETTLEMENT AGREEMENT WHICH INCLUDES PAYMENT
5 OF EIGHTY-FIVE THOUSAND DOLLARS ($85,000.00) TO AARON
6 MANNING TO RESOLVE ALL CLAIMS CURRENTLY IN LITIGATION;
7 AND, FOR OTHER PURPOSES.

9 WHEREAS, during the period of greatest concern about the COVID-19 Pandemic, a City 911
10 Dispatcher decided not to work for a period of time because a co-worker had traveled outside the State of
11 Arkansas to transport a relative who had been removed from a cruise ship for an unrelated reason;and,
12 WHEREAS,because of the critical nature of 911 Dispatchers to the public health, safety and welfare,
13 the 911 Dispatcher was ordered back to work, and after refusing to return,was terminated;and,
14 WHEREAS,the State Court Litigation of Aaron Manning v. City of Little Rock,Arkansas, No.60CV-
15 20-2727, Pulaski Circuit Court,was filed in which the plaintiff sought various compensatory damages and
16 other relief; and,
17 WHEREAS,the parties have agreed upon a settlement to this litigation that has been presented to the
18 Little Rock Board of Directors in compliance with Little Rock, Ark., Rev. Code § 2-241 (1988), and is
19 subject to approval by resolution at this time.
20 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. After consideration of this matter through communication with the Office of the City
23 Attorney,the Board of Directors authorizes the City Manager to make a payment of Eighty-Five Thousand
24 Dollars($85,000.00)as the total monetary settlement of the claim raised in Aaron Manning v. City of Little
25 Rock, Arkansas, No. 60CV-20-2727, Pulaski Circuit Court; further, it is agreed that this payment includes
26 all costs and attorney's fees which Mr. Manning owes to his attorney—Mr. Scott E. Poynter,Arkansas Bar
27 License No.90077.
28 Section 2. The Board of Directors furthers agree that the termination of Aaron Manning can be
29 modified to show that it is a resignation.
30 Section 3. All documents necessary to be executed by the City Manager,or other City personnel,that
31 have been approved by the City Attorney, shall be executed in accordance with this resolution.
32 Section 4. Severability. In the event any section, paragraph, item, sentence, clause, phrase or word of
33 this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication

1 shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the
2 portion so declared or adjudged invalid or unconstitutional were not originally part of this resolution.
3 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
4 the provisions of this resolution are hereby repealed to the extent of such inconsistency.
