15672 1 RESOLUTION NO. 15,672 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO 4 APPROPRIATE SEVEN HUNDRED THIRTY-TWO THOUSAND, FOUR 5 HUNDRED SIXTY-SEVEN AND 64/100 DOLLARS ($732,467.64) FROM 6 THE CITY'S 3/8-CENT CAPITAL SALES AND COMPENSATING USE 7 TAX PROCEEDS TO THE ARKANSAS LIVESTOCK SHOW 8 ASSOCIATION FOR CAPITAL IMPROVEMENTS TO THE ARKANSAS 9 STATE FAIRGROUNDS; AND FOR OTHER PURPOSES. 10 11 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 13,343 (July 11, 2011), the Board of 12 Directors directed proceeds be set aside in the amount of Three Million Dollars ($3,000,000.00) for 13 Expansion and Improvement of Facilities to enhance the Arkansas State Fairgrounds; provided the Fair 14 remain at its current location within the City of Little Rock on Roosevelt Road; and, 15 WHEREAS, the Arkansas Livestock Show Association announced its intention to keep the Fair in 16 Little Rock for the foreseeable future; and, 17 WHEREAS, pursuant to Resolution No. 14,770 (April 17, 2018), the City authorized the formal 18 agreement between the City and the Arkansas State Fair Association, also referred to as the Arkansas 19 Livestock Show Association, which ratified earlier payments by the City and formalized the contractual 20 terms of the relationship; and, 21 WHEREAS,pursuant to Resolution No. 13,577 (October 12,2012),an appropriation of Ninety-Eight 22 Thousand, Seven Hundred Dollars ($98,700.00) was made for improvements to Barton Coliseum; and, 23 pursuant to Resolution No. 13,874 (April 15, 2014), an appropriation for Ninety-Five Thousand Dollars 24 ($95,000.00) was made to assist with additional improvement costs to the Coliseum and Administration 25 Building;and,pursuant to Resolution No. 15,058(September 3, 2019),an appropriation of Three Hundred 26 Ninety-One Thousand, Three Hundred Thirty-Eight and 85/100 Dollars ($391,338.85) was made for 27 Capital Improvements to the Fairgrounds; and, pursuant to Resolution No. 15,207 (April 21, 2020), an 28 appropriation of Three Hundred Seventy-Two Thousand, Four Hundred Sixty-Eight and 72/100 Dollars 29 ($372,468.72) was made for capital improvements; and, pursuant to Resolution No. 15,543 (October 5, 30 2021), an appropriation of Ninety-Eight Thousand, Four Hundred Thirty-Nine Dollars ($98,439.00) was 31 made for Capital Improvements to the Fairgrounds; and, 32 WHEREAS, the Interim General Manager of the Arkansas State Fair Association has requested 33 funding of an amount not to exceed Seven Hundred Thirty-Two Thousand,Four Hundred Sixty-Seven and 34 64/100 Dollars ($732,476.64) for capital improvements to include fencing and gate projects along [Page 1 of 2] 1 Roosevelt Road and Schiller Street, a Paging System, associated electrical work, and other facility 2 improvements needed,and which are the final funds in the Capital Improvements Sales and Compensating 3 Use Tax Fund available for the Fair. 4 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 5 OF LITTLE ROCK,ARKANSAS: 6 Section 1. The sum of Seven Hundred Thirty-Two Thousand, Four Hundred Sixty-Seven and 64/100 7 Dollars ($732,467.64) is hereby appropriated from the proceeds of the 3/8-Cent Capital Sales and 8 Compensating Use Tax to reimburse the Arkansas Livestock Show Association for improvement of 9 facilities, including the fencing along Roosevelt Road and Schiller Street, a Paging System, associated 10 electrical work,and other facility improvement. 11 Section 2.Funds for this appropriation are available in Account No.326459-TS45A09. This is the 3/8- 12 Cent Capital Project Fund—State Fair Activity. 13 Section 3. With the appropriation set forth in Section 1 of this resolution, no more funds for the 14 Arkansas State Fair, or Arkansas Livestock Show Association, will remain; this is the final appropriation 15 pursuant to Little Rock, Ark., Resolution No. 14,770(April 17,2018). 16 Section 4.Distribution of Tax proceeds from the City to the Association. Before any distribution of 17 Tax proceeds by the City to the Association occurs, the Association shall provide the City a detailed 18 statement of the specific capital improvements of a public nature that will be funded with the proceeds,the 19 expected cost associated with such improvements, and a reasonable time frame in which the funds shall be 20 expended by the Association. 21 Section 4. Severability. In the event any section, paragraph, item, sentence, clause, phrase or word of 22 this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication 23 shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the 24 portion so declared or adjudged invalid or unconstitutional were not originally part of this resolution. 25 Section 5. Repealer.
