3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO.
4 15,638 (MARCH 15, 2022), TO ADD AN OPTION TO EXTEND THE
5 CONTRACT FOR A THIRD YEAR WITH THE ARKANSAS REGIONAL
6 COMMISSION, FOR HOUSING OPPORTUNITIES FOR PERSONS
7 WITH AIDS (HOPWA); AND FOR OTHER PURPOSES.

9 WHEREAS, the Mayor and Board of Directors of the City of Little Rock, Arkansas ("City"),
10 recently approved a Sub Award to the Arkansas Regional Commission ("ARC") in the amount of One
11 Hundred Six Thousand, One Hundred Eighty Dollars ($106,180.00) in Little Rock, Ark., Resolution No.
12 15,638(March 15,2022); and,
13 WHEREAS, the funds are from the City's annual allocation of Housing Opportunities for Persons
14 with AIDS ("HOPWA") Funds from the United States Department of Housing & Urban Development;
15 and,
16 WHEREAS, Resolution No. 15,638 authorized the City to provide funding for ARC for a one (1)-
17 year term with the option to renew the term one(1)-time in a one(1)-year increment; and,
18 WHEREAS,the City should have been granted the option to renew the funding for two (2) terms in
19 one (1)-year increments (as indicated in the "Whereas" clause but not in the body proper of the
20 resolution).
21 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
22 OF LITTLE ROCK,ARKANSAS:
23 Section 1. Section 2 of Little Rock, Ark., Resolution No. 15,638 (March 15, 2022), is hereby
24 amended to read as follows:
25 The Board of Directors hereby approves funding to the Arkansas Regional Commission of
26 One Hundred Six Thousand, One Hundred Eighty Dollars($106,180.00)for a one(1)-year
27 term, with an option to renew the term for two (2) additional terms in one (1)-year
28 increments.
29 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
31 adjudication shall not affect the remain portions of this resolution, which shall remain in full force and
32 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
33 resolution.

1 Section 3. Repealer. All laws, ordinances and resolutions, or parts of the same, including but not
2 limited to Little Rock, Ark., Resolution No. 15,638 (March 15, 2022), that are inconsistent with the
3 provisions of this resolution,are hereby repealed to the extent of such inconsistency.
