MINUTES OF THE MEETING
OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room,
City Hall, `,ionday, April 16, 1951, at 2:00 P.M., with the following
members present:
Mr. Louis Tarlowski, Chairman
Mr. Warren Baldwin
Mr. W. H. Marak
Miss Emily Penton
Docket No. 24-51 - Mrs. Vallie Wooten, 2615 Broadway,
described as Lot 4, Block 4, Retans Addition; zoned
'IC" Two -Family; requesting variance permit to con-
struct outside stairway and enclose rear porch.
Mrs. Wooten was present and she stated she wants to put steps
up the outside. There is no outside entrance at all, and the people
have to come through her living room. Also in case of fire, she thinks
they would be beneficial and she believes there is some kind of law that
calls for an outside entrance. She was asked how many occupants lived
in her house, and she replied "three besides myself." She said she
would not increase the number of occupants.
There was some opposition represented by Firs. A. F. I-ionrotus,
2608 Broadway. She stated that Mrs. Wooten bought the house under false
pretenses. During the war the owner had five families in the house, and
when the war was over she brought suit. Nobody could park there it was
so crowded. They want to keep it two-family, so it will remain a nice
neighborhood. She remarked that all the neighbors are opposed. Others
present who were opposed to it were Mr. John A. Godfrey, 2523 Broadway,
Mrs. Foster Vineyard, 2614 Broadway, and Mr. M. Z. Bair, 2522 Broadway.
Mr. Marak moved it be denied; seconded by Hiss Penton. The
motion carried.

Docket No. 25-51 - Dr. J. 0. Porter, Jr., Pine Valley
Road at Greenwood, described as Lot 194, Kingwood
Place Addition; zoned "A" One -Family; requesting
waiver of ,yard requirements due to odd -shaped lot.
Mr. Paul Stinson of Bralei Homes represented Dr. Porter who was
unable to be there. Mr. Stinson said all the owners had been notified
except Mr. Moody who has leased his place and is out of the city, and the
tenant did not feel that he should sign. He was unable to contact Mr.
Moody. He said the house complies with the building restricti6ns, but

described as Lot 5, Block 8, Fields Addition;
zoned "B" Residence; requesting variance permit
to build new house. Applicant plans to leave
existing house there until new house is finished.
rIr. Stroud was present; and he stated that he is ready to
start on the new house except for the building permit. He stated that
he will either tear down the old house or move it. He might buy another
lot and move it there. His present house is prefabricated, and would
have to come down in sections. When asked what proof the Board would
have that he would move or tear down the old house, 14r. Stroud stated
that he would either sign an affidavit or put up bond.
This petition was granted on condition that the applicant sign
an affidavit to be a condition upon which the granting of a building per-
mit for the new house is to be issued. The said affidavit to be attached
to and made a part of such permit to the effect that applicant agrees to
remove from the premises the present house situated thereon within 30 days
after the completion of the new house, and failing to comply with this
condition applicant agrees that the City of Little Rock, through its duly
constituted officials may take such action as may be necessary against
him, without notice -to the applicant, and without extension of time -to
proceed to remove such present structure from the premises.

were no Protestants.
Mr. Baldwin moved it be granted; seconded by jvr. Marak. The
motion carried.
Docket No. 26-51 - Lewis E. White, 5302 I Street,
described as east 46 2/3' of west 932', Lots 3, 4,
and 5, Block 9, Hollenberg Addition; zoned "A" One -
Family; requesting waiver of yard space in order to
enlarge existing garage.
Mr. White was present and he stated that his house sets up on
a. terrace and you cannot see his garage from the street. It is in bad
condition, so he is going to build a new one but it will be larger than
the present one. He stated the garage now isn't large enough for his
car, so he wants to extend it back toward the property line instead of
coming forward. He said there was no objection from the property owner
back of him.
Miss Penton moved it be granted; seconded by Mr. Marak. The
motion carried.

Docket No. 27-51 - Ketcher & Company (By Knox D. Gill),
southeast corner of I -lest 5th and Rice, described as
Lots 4 and 5, Block 27, Capitol Hill Extension Addition;
zoned "B" Residence and "J" Light Industrial; request-
ing extension of the "J" District to the entire lot.
No one was present to represent this petition. After some dis-
cussion Mr. Baldwin moved it be granted; seconded by Mr. T arak. The
motion carried.

Docket No. 28-51 - W. P. Stephenson, 2806 West 7th,
described as Lot 11, Block 5, Ferndale Addition; zoned
"B" Residence; requesting permission to operate a work
shop in the rear of his residence. (Referred by Council).
Dr. James Ray Penix was present to represent sir. Stephenson.
He said he became interested in the shop and he helped him get the
machinery. He stated it would be operated for the public. 10hen asked
how long the building has been there, he replied, "it has been there for
some time." He applied for application because he wanted to make sure
he was in the right. The name of the shop is the Acme Building and

Cabinet Company. Dr. Penix said he did have the place in North Little Rock.
It is a frame building, but he doesn't known if it was orginally built for a
work shop. Dr. Penix went on to say that 14r. Stephenson has been in ill
health for a number of years, and he nearly lost his sight. This would
offer him a means of support. Dr. Penix cited a few other places in the
neighborhood that have similar shops - one at 2822 !,,Test 7th and another
in the 2900 block. He said there was no objection from the neighbors.
There was some discussion by the members whether they had any
jurisdiction over this case. Since the building is already built and he
wants permission to operate, they thought it might be a matter for the
Council to handle. After some discussion, Mr. Tarlowski said he would
write the City Attorney for a ruling on it. In the meantime, we could
Fro ahead and vote on it. So Miss Penton moved it be approved; seconded
by Ir. 1viarak. The motion carried.
Docket No. 29-5l'- 'Mrs. Pearl Robinson, 2304 Rice,
described as Lot 20, Block 21, Adams Addition; zoned
"B" Residence; requesting permission to operate barber
and beauty shop.
Mrs. Robinson was present and she stated that the building was
built last year by the Magnolia Art and Charity Association. She said
she has everything lined up to start operating. There were no objections
from the surrounding property owners.
The same problem arose in this case as in that of Mr. Stephenson.
But it was decided to go ahead and vote on it and then get a ruling on it.
Miss Penton moved it be approved; seconded by Mr. Marak. The motion carried.

John E. Stanton (By W. S. Mitchell), Rockwood Road,
described as Lot 299, Kingwood Place Addition; zoned
"A" One -Family; ,requesting waiver of side yard re-
quirements.
Both Mir. Stanton and Mr. Mitchell were present. 11r. Mitchell
stated that the Bill of Assurance requires a side yard of 7-'- feet on each
side. Mr. Stanton cannot erect type of house he wants to with the 7-2�- feet.
He wants a waiver so as to have 6 feet on each side. There will be no
violation of the Bill of Assurance as the house has been changed to con-
form to it.
