boa_03 19 1951(copy)MINUTES OF THE MEEPING OF THE BOARD OF ADJUSTMENT The Board of Adjustment met in the Mayor's Conference Room, City Hall, Monday, March 19, 1951, at 2:00 P.M., with the following members present: Mr. Louis Tarlowski, Chairman Mr. Warren Baldwin Mr. W. H. Marak Mr. Bruce Anderson Docket No, 11-51 - F. L. Knight, 2903 West 27th, described as Lot 2, Block 91 C. E. Gallagher's Addition; zoned "B" Residence District; requesting variance permit to complete new duplex dwelling already started. (Referred by Council). Mrs. Knight was present and she stated that they want to finish a duplex which they have started, but at first they wanted to build a house. They got a building permit to build the house last October, and then she went back after that to get a permit for the duplex. They re- ferred her to the Planning Co=Ission. She said that Council, gave them permission to ;o ahead with the buildinC pending action on the zoning. Rezoning was denied by Council on recommendation of the Planning Com- mission. Welton, Jr., 3023 West llth Street, described as Lot 6, Block 6, Jones & Worthen Addition; zoned "C" Two -Family District; requesting permission to add one room to existing duplex. Mr. Welton was present and he stated that he had received his orders to report back into the Navy. He wants to get a place fixed for his family to live in before 1, testants to this. e leaves. He said there were no Pro - This petition was granted. -2- Docket No, 14-51 - Mrs. Dell Ferguson, 100 Denison, described as Lot 1, Block 3, Capitol View Addition; zoned "B" Residence District; requesting variance permit to convert existing dwelling to duplex. Mrs. Ferguson was present and she stated that she would like to add a room on back of her house in order to make another apartment. When asked how her house is now, she replied that it is a triplex; it was a triplex when she bought it. She stated that she talked with all the neighbors, and they didntt object. She was questioned about the parking space, and she said there isn't much place to park around there. The people usually park in an alley next to her house, and she has a garage. Mr. Baldwin made a motion; seconded by Mr. Marak that this petition be disapproved. The motion carried. Docket No. 15-51 - F, IT. Kornmeyer, 3917 Maryland, described as Lot 50 Block 6, Forest Hill Addition; zoned "B" Residence District; requesting waiver of set -back requirements in order to erect a car porte. Mrs, Kornmeyer was present and she stated that she had changed her mind about her set -•back requirements, She heal an architect to come out, and they decided to let the porte start even with the porch; it would look much nicer. They want it to correspond with the slope of the roof on the house. She pointed out that they do keep up their property. When asked about protests from the neighbors, she replied that there were none. This petition was approved on condition that the front of the ports be even with the front of the main dwelling; otherwise, disapproved, Docket No. 16-51 - Lora B. Cloninger Bates, 4418 West llth Street, described as Lot 6, Block 6, Rif.fel & Rhoton Addition, and east 3.4' of Lot 2, Block 17, Cunningham's Addition; zoned "B" Residence District; requesting variance permit to convert existing residence to duplex. Mrs. Bates was present. She said it is occupied by one family now. However, diagonally across the street is a duplex and third door to the east is a triplex, but she didn't know what procedure they followed to get them. She stated that there were no protestants. Mr. Marak made a motion this be approved; seconded by Mr. Baldwin. The motion carried, -3- Docket No. 17-51 - First Baptist Church, 1224 Louisiana (By A. N. McAnnich), described as Lots 7 and 8. Bloch 169, Original City; zoned "E" Apartment District; requesting waiver of front, side, and rear yard space to complete educational building. Mr. MCAnnich was not present, but Mr. Duval explained the case stating this building is well on the way to completion. Mr. Marak made a motion this be approved; seconded. by Mr. Baldwin. The motion carried. Docket No. 19-51 - Mrs. Eugene W. Hilton, 3417 Kavanaugh, described as part of Lots 1, 2. and 3, Block 49, Pulaski Heights Addition; zoned "A" One -Family District; requesting variance permit to convert existing residence to duplex, Mrs. Hilton was present. She said that she wants a duplex now and if she leaves the city, she wants to keep it with the idea of moving back if she wa-nts to. She explained that her husband is an Army officer, and he will be going soon to the west coast to train troops for overseas duty. She said he would possibly be sent to Korea or Germany. When asked how long she has owned this property, she replied that they had just bought it. A. Mr. and Mrs. Purifoy Gill, 3415 Kavanaugh, were there to pro- test this petition. They presented names of two other protestants with their written protests. They are Virginia J. Leach, 3501 Kavanaugh, and Hr. A. Samtaons, 5200 "1" Street. Mr.. Gill stated that he bought his property 10 years ago and he has improved it. If this property next door is converted into a duplex, it will add to crowded conditions. The yard space is small; there is only 36" to the corner of their house to Mrs. Ililton's lina. The sewerage facilities are inadequate, and he has just had the sewers fixed last week. Mrs. Hilton stated that if her petition does not go through, she Will sell the property„ Mr. Baldwin made a motion this petion be disapproved. Mr. Marak seconded it. The motion carried. -4- Docket No. 20-51 - R. B. Johnson, 800 South Van Buren, described as the east 701 of Lot 9., Block 8, Cunningham's Addition; zoned "B" Residence District; requesting appeal from decision of the Building Commissioner for apprcal of plot plan to erect a dwelling. Mr. Johnson was present, and he stated that the FHA would not approve his present plans. So he proposed to move the house for- ward to alter the plot plan as submitted in order to provide 25 feet clearance in ba4kyard and five feet on the south side of the house, leaving frontage of 18 feet. He remarked that this is all right with the neighbors. Mr. Baldwin made a motion that this be approved on these conditions. Mr. Marak seconded it. The motion carried. Docket No. 22-51 - L. C. Seago and Paul L. Seago (By Hugh Humphreys, Jr.), 320 and 322 West 14th, described as the east 94.501 of Lots 5 and 6, Block 194, Original City; zoned "D" Apartment District; requesting waiver of area requirements in order to build two duplex units. There was no one present to represent this petition. Mr. DuVal explained the situation. He stated there is almost 2500 square feet, which are the requirements, and this is why they are asking for a waiver. He stated that only one duplex will be built now; the other later.
