OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room, City
Hall, Monday, February 19, 1951, at 2:00 P.M., with the following members
present:
Mr. Louis Tarlowski, Chairman
Mr. Warren Baldwin
Mr. -W. H. Marak
Miss Emily Penton
Mr. 0. D. Longstreth, Jr., the City* Attorney, attended the hearing
for a short time at the request of Mr. DuVal. The Mayor was also present
for Mrs. Gold's hearing.
Docket No. 4-51 - Elsie H. Gold, 1223 Welch, described as
Lot 7 (except the east 65 feet t.he-reof), Block 16, Masonic
Addition; -zoned 11C" Two -Family District; requesting waiver
of yard space to permit erection of a single-family residence
on west 91.73' of Lot 7, Block 16, Masonic Addition.
Mrs. Gold was present and was represented by her attorney, Mrs.
Gladys M. Brandon, who read the history of this property and its de-
scription. She stated that Mrs. Gold had been refused a building per-
mit to construct the residence. She has this vacant yard space on which
she is paying taxes and is deriving no income from it. She keeps the
property clean and free from all debris and has planted hedge along the
north property line. The proposed structure will be confined to one
story. She will be complying with Zoning Ordinance No. 5420, Section 11,
Mrs. Brandon said. There was some disagreement to this. Mr. DuVal re-
quested to put something in the record, and he read Section 2, Paragraph
4, Zoning Ordinance No. 5420.
There was some opposition to this petition, represented by Mr.
Albert J. DeMers, attorney. He stated that the whole neighborhood ad-
joining Mrs. Louise Early. (who was present) is opposed to this. She
sold the house and kept half the lot, and if her request is granted, she
will have a house in the .front and back yards both. He said there is
barely enough ground to walk around on now. This petition has been up
several times before --October 24, 1949, and June 26, 1950.
Mrs. Early remarked that when it was brought up last June she
understood it was denied, so she has remodeled her house spending over
$1,000. If this goes through, her property will depreciate very much
and will be a big loss to her. Mrs. Gold's back yard is right outside
of her bedroom window. She said she didn't think Mrs. Gold notified all
the property owners.
This petition was unanimously denied.

Docket No. 5-51 - W. H. Thompson and H. P. Barre, N. E.
corner of 7th and Sherman, described as Lots 4, 5, and 6,
Block 2, Stevenson's Addition; zoned "D" Apartment District;
requesting waiver of set -back requirements to build a 20-
unit apartment with ten -foot set -back on said property.
Mr. Barre was present with his attorney, Mr. Howard Cochranand
,
his architect, Mr. Tom Harding. Mr. Cochran gave a brief description of
the property and how valuable the apartment house will be. Pir. Harding
then presented his drawing of the property and explained that he would
like a 5-foot set -back. Captain Witherspoon of the Police Department
was present and he stated he would like to have 15 feet on both 7th and
Sherman. His interest is in the safety of the school children.
This petition was granted on condition the set -back be 9 feet on
7th and 15 feet on Sherman.
Docket No. 6-51 - D. F. Summers, 2814 Arch, described as
Lots 8 and 9, Block 4, Kimballs South Park Addition; zoned
"B" Residence District; requesting variance permit to re-
construct and enlarge existing non -conforming garage.
Mr. Summers was present. He stated that he will let the old
building stay there for the time being. The new building will be fire-
proof and all material will be steel structure.
There were no protesters present.
This petition was granted.
Docket No. 7-51 - W..P. Vanderburg, 3906 W. 5th Street, described
as Lots 6 and 7, Block 11, Plateau Addition; zoned "B" Resi-
dence District; requesting variance permit to convert existing
residence to duplex.
Mr. Vanderburg was present and stated that the house is already
a duplex. It was formerly occupied by him and his son.
There were no protesters present.
This petition was granted.

Docket No. 8-51 - G. C. Evans, Sr., north side of 15th
Street, west of Peyton, described as Lots 6 and 7, Block 9,
Sydney J. Johnson's Addition to the City of Little Rock,
Arkansas; zoned "B" One -Family District; requesting variance
permit to permit use for a storage building and storage yard.
Mr. Evans was represented by Mr. Cooper Jacoway, attorney. He
went into great detail describing Mr. Evans' business, its location,
and why he is wanting the permit. He stated that this business is of
great value to the people of Little Rock; approximately 90 to 95 percent
of his material he gets within the state. He is bringing into the city
and state a greet deal of revenue. He needs additional storage space
because his business is expanding, and the building he wants to use is
a Quonset but he bought in 1946 or 1947. The property will be used just
as it is being used now. Mr. Evans has built up the neighborhood with
his business. Mr. Jacoway went on to say he had ridden around in the
area there and he didn't see an excessive amount of smoke and the noise
was negligible.

All of these people agreed that Mr. Evans' business has created
a lot of smoke and dirt. It has made their homes smoky, also they don't
like to hang their clothes out to dry on account of the smoke. One pro-
tester said his home is a little over a year old and it needs repainting
already. The trucks that Mr. Evans has cause more traffic and is
dangerous for their children. There is also a lot of odor. They didn't
mind his business expanding, but not in that location where their homes
are.' They feel it is very detrimental to them.
Mr. Longstreth asked Mr. Jacoway how far this industrial area is
from any other industrial area. He replied that it is a long way.
Mr. DuVal also questioned Mr. Jacoway. He asked him if he thought
this affects the health and safety of the people in that neighborhood.
He said he could not say if it does or not. Also before he asked Mr.
Jacoway this, he asked one of the protesters the same question. This
protester firmly stated that he thought it does affect the health and
safety.

Docket No. 10-51 - Paul E. Talley, 2723 Abigail, described
as Lot 7 and the south 9 feet of Lot S, Block 3, Oak Grove
Square Addition; zoned "B" Residence District; requesting
variance permit to use an existing three-family house as such.
Mr. Talley was present with his attorney who made a brief statement
concerning this property. He said Mr. Talley purchased it from Mr. Speed
Reavis and had the house moved to its present location. Mr. Talley now
wants to use it as was used at its former site --a triplex. He plans to
to make some repairs, but the house itself will not be enlarged. He
pointed out it is still in the same neighborhood and it is only fair that
he be permitted to use this structure.
Mr. Talley then spoke at some length giving his reasons for moving
the house, what an asset he thought it would be to the neighborhood, and
he plans to keep it in good condition. However, he said he didnft want
to make the people around there angry.
Mr. Reavis was present and was questioned regarding the sale of
the property, also about the petition which he had previously filed and
was denied.

There/a number of protesters present, and Mrs. Roy Jones spoke
in their behalf. She presented a petition signed by the neighbors.
This petition was denied.
