boa_10 20 1952MINUTES OF THE WErING OF THE BOARD OF ADJUSTMENT The Board of Adjustment met in the Mayor's Conference Room, City Hall, Monday, October 20, 1952, at 2:00 p.m., with the following members present: Mr. Bruce Anderson, Chairman Mr. Warren Baldwin Mr. W. H. Marak Miss Oily Penton Docket No. 54-52 - Herbert Rodgers, 1024 South Oak Street, described as parts of Lots 10, 11, & 12, Block 10, Forest Hills Addition, zoned "B" Residence District; requesting a waiver of lot area in order to build a house on sub- standard lot (4500 square feet). Mr. Rodgers was present and stated that he wanted to construct a house on a sub -standard lot which is 45' x 97' in size. In order to build the house, Mr. Rodgers needed a waiver of lot area. Mr. Rodgers explained to the members that he was not trying to place two houses on one lot for he actually has more lot area on this lot than the one on which his home is located. He added that his home was a nice one and naturally he planned to build a nice house on this sub -standard lot for he didn't want to decrease the value of his property. Mr. Rodgers said some of the neighbors seemed to think he was going to construct a two room shot gun house and he wanted to clear their minds on that point for he planned to erect a nice little house. He has lived in his present home for seven years and said that he certainly wanted a nice house placed on the lot. Mr. Rodgers explained to the members that earlier three property owners would not sign the notice of hearing but later signed it. Mr. Butler was a spokesman for a group of eight people present to protest the petition. He explained to the Board members that at the pre- sent time there are actually two houses located on two sub -standard lots. One is on the northwest corner of llth and Oak streets. There is a hou se on the back of this lot. Mr. Rodgers did own the house but sold it; thus creating a sub -standard lot. Originally the lot was platted to face the east but the house was built to face the south. Mr. Butler brought out the fact that if Mr. Rodgers is granted his petitioned waiver of lot area to construct another house then it will actually be a case of three houses on two sub -standard lots. The surrounding neighbors felt this would create a health hazard and possibly a fire hazard. Mr. Butler mentioned two property owners living within 140' of Mr. Rodger's pro- perty who had petitioned for waivers before the Board of Adjustment previously and were denied the waivers so he felt they should be con- sistant in denying Mr. Rodger's petition. One of these earlier petitions was for a garage and garage apartment on the rear of his lot during World War II due to the housing shortage. Another was for a carport. (he thought) Mr. Butler stated that he felt Mr. Rodger's had utilized his property enough now and thought the petition should be denied. Mr. Rodgers then stated that he thought the neighbors were object- ing because they had wanted to pave the street by him and he didn't want to invest that much omney in it because his lot ran the wrong way and it wouldn't benefit him. -2- Mr. Morton, one of the protestants, then stated that the matter was not a personal one for he wanted to be friends. Mr. Morton was object- ing because he felt it was for the best interest of the community and he wanted to keep within the zoning regulations. He thought if the petition is granted then it will decrease the property in the neighborhood. Mrs. Morton stated that Mr. Rodgers has approached her husband to sign the notice of hearing and explained to him that he planned to erect a 26' x 281 house on the sub -standard lot. Mr. Morton didn't want to sigh the notice because he felt it Would decrease the value of his pro- perty if the petition was granted. Mr. Rodgers approached him later to get him to sign the notice of hearing and at that time Mr. Morton then offered to,buy a strip of Mr. Rodgers lot which would be 10' x 100' in size if he needed the income off of the lot for he just didn't want an- other house placed there. Mr. Rodgers offered'to sell the strip of land for 12500 and later went down to $2000 but Mr. Morton refused because the price was too high. - - Mr. Marak then asked the protestants if another house placed on the lot would create a problem in regard to garabage dis- posal. - - They answered that it would. Mr. Marak made a motion that the petition be denied; seconded by Miss Penton. The motion carried. Docket No. 55-52 - E. E. Larrimore, 1308 Park Lane, de- scribed as Lot 10 & north 4' of Lot 9 of Bagley, Sanders & Brooks re -plat, Block 156, Original City of L.R., zoned "C" Two -Family District; requesting a waiver of yard space, lot area and two buildings on one lot in order to convert excessory building into a dwelling unit. Mr. Larrimore was present and stated that he wanted to -convert a garage and work shop on the rear of his lot into a dwelling. The structure would be used more or less as servants quarters. Mr. Larrimore stated that his wife is ill and has been for the past two years. She is highly nervous and actually doesn't need anyone with her over half a day at a time because of this condition. Mr. Larrimore said it was hard to keep help because they didn't like to stay in his home over night. He said he had been doing most of the cooking for the past two years and wanted to make a change. The person hired to care for his wife will be the occupant of the samll dwelling on the rear of the lot. Miss Penton made a motion that the petition be granted provided it is used for servants quarters only; seconded by Mr. Baldwin. The motion carried. Docket No. 56-52 - E. W. Kinkead, 1718 Magnolia Street, described as Lot 87, Riverside Addition, zoned "B" Re- sidence District; requesting a waiver of yard space in order to add carport on back of house. Miss Penton made a motion that the petition be approved; seconded by 111r. Baldwin. The motion carried. -3- Docket No. 57-52 - D. B. Bates, 1318 Center Street, de- scribed as Lot 8, Block 194, Original City of L. R., zoned "D" Apartment District; requesting a waiver of yard space. and two buildings on one lot in order to construct garage apartment on back of lot. Mr. Bates was present and stated that he wanted a waiver of yard space in order to construct a garage apartment on the rear of the lot. H He plans to have a two story apartment. The first floor will be built of concrete blocks and the 2nd floor will be built of lumber. At the present time a garage is located on the rear of the lot which Afr. Bates will remove and the apartments will replace it. There are four families living in the existing apartment already located on the lot. It was brought out that according to Mr. Bates lot area, he would be allowed to have only five families living on his lot. Mr. Pates felt it would be an improvment to the neighborhood. There were no objections. - - Mr. Marak then asked fi it would cause a hardship if the petition was denied. - - Mr. Bates stated that he had worked for the Veterans Administration for 21 years and was injured. He has been unable to work since that time and said that a 40% disability check each month plus his income off of his apartment was all he had to live on. His savings are invested in the apartment and he said he needed the added income. Mr. Baldwin made a motion that the petition be denied; seconded by Mr. Marak. The motion carried. Docket No. 58-52 - Robert F. Rowe, 1709 Green Meadow Drive, described as Lot 74, Pine Forest Addition, zoned "B" Re- sidence District; requesting a waiver of rear yard space in order to add onto back of existing house. Mr. Alexander was present to represent Mr. Rowe. Mr. Rowe plans to add a room 12' x 16' on the back of his house. The front of Mr. Rowe's house is set back 38' from his property line. After the room is added onto the rear of the house, it will be 18' from the rear property line. There isn't an alley behind his property. There were no protests. A 5' easement is at the back of Mr. Rowe's property. Mr. Marak made a motion that the petition be approved; seconded by Miss Penton; The motion carried. Docket No. 59-52 - John B. Bush, 1524 Ringo Street, de- scribed as west of Lot 7 & south 1 of Lot 8, Block 281, Original City of L.R., zoned "C" Two -Family District; requesting a waiver of yard space, lot area and two build- ings on 1T lots in order to move a house on the property. John E. Bush was present and J. :. Booker, his attorney was also pre- sent to represent him. Mr. Booker stated that Mr. push ownes 1, lots on the corner of 16th and Ringo Streets. Mr. Bush is requesting permission to move a house located at 1709 Chester, which is in the redevelopment area, on his property. The house will face 16th Street. Mr. Bush's lot is 75' x 150' in size. The house in the redevelopment area is in good shape. Mr. Bush's home is in a two-family district. There were no object- ions. Dr. Powell is his nearest neighbor and he did not object. Mr. Marak made a motion that the petition be approved; seconded by Miss Penton. The motion carried. -4— Docket No. 60-52 - D. L. Harrison, 1424 High Street, de- scribed as Lot 7 and south L of Lot 8, Block 15, Centennial Addition, zoned "C" Two -Family District; requesting a waiver of yard space and two buildings on oenand a half lots in order to place house on rear of property. D. L. Harrison was present at the meeting with his attorney, Cooper Jacoway. Mr. Jacoway stated that Mr. Harrison has 1t-- lots at 15th and High Streets extending back 140' in depth. He is requesting permission to locate another house on the rear of his property. Mr. Harrison has bought a house from the redevelopment area which he plans to move on the back of his lot. The house will face west and the front of it will be even with the side of Mr. Harrison's home which faces High Street. Isar. Jacoway stated that Mr. Harrison owned a nice stone home and that the house which he plans to move on his property is also in good condition. Mr. Harrison will need a waiver of front yard space in order to keep the house in line with the side of his home and possibly rear yard space waived. However, Mr. Jacoway said that according to the zoning ordinance, Mr. Harrison would not need his rear yard space waived. Mr. Jacoway st ated that there are 77' from the back of Mr. Harrison's home to his rear pro- perty line. The house which he proposes to place on the rear of his lot is 38' wide. Mr. Jacoway said that Mr. Harrison plans to set the house back 12' from the front property line but could set it back 15' if the Board required it. The property owners of the lot directly in back of D. L. Harrison were present to object to the petition. They felt it would decrease the value of their property and would invade the privacy of their home. They also complained of the condition that Mr. Harrison's back yard Is in. It has just been cleaned up a little during the past few days, but as a rule they complained of chickens in the back yard and said the yard was in a mess. They stated that they had lived in their home seven years. (in Dec.) Mr. Jacoway stated that Mr. Harrison had built his home in 146 and at that time the city engineer explained to him that he would be able to place two houses on his property. He showed the original plat plan to the members. Actually, a house only 35' wide could be placed on the pro- perty and Harrison wouldn't need a waiver of yard space. However, he has an opportunity to buy a house in the redevelopment area cheap and then he would haven't to pay the price to build a house. The members voted to disapprove this petition. Docket No. 61-52 - Greater 2nd Baptist Church, (by G. B1 Banks), 1512 West 12th Street, described as Lot 7, Block 409, Lincoln Addition, zoned "C" Two -Family District; re- questing a waiver of yard space in order to add onto the church. Mr. Banks was present to represent this petition. He stated that they wanted to add at least 9' to the rear of the church. In doing so, it would make room for a new choir space and puplit, thus giving more room in the autidorium of the church. The church plans to tear down the buildin s on their property which has been used for Sunday School space. Miss Penton made a motion that the petition be approved; seconded by Mr. Marak. The motion carried. -5- Docket No. 62-52 - Charles Reid Henry, No. 4 Armistead Road, described as Lot 17, Edgehill Addition, zoned "A" One -Family District; requesting a waiver of side yard space for the purpose of erecting on the west sideyard a two -car -carport. Miss Penton made a motion that the petition be approved; seconded by Mr. Marak. The motion carried. Docket No. 63-52 - W. P. Bond, 4916 Hawthorne Road, de- scribed as Lots 2 & 3, Block 1, Newton Addition, zoned "Au One -Family District; requesting a waiver of front ysr4espgcbito.permit building to within 15 feet of front property line.
