OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room, City
Hall, Monday, August 18, 1952, at 2:00 p.m., with the following members
present:
Mr. Bruce Anderson, Chairman
Mr. Warren Baldwin
Miss Emily Penton
Docket No. 36-52 - Evelyn Pelford, 3117 Long Main Street,
described as South z of Lot 4, Block 1, Robinson Addition,
zoned "B" Residence District; requesting a waiver of general
yard space, lot area and two buildings on one lot.
Evelyn Pelford was present at the meeting. She already has the
foundation and floor built in the house. The school is located on
27th street <ust a, few blocks from Mrs. Pelford' s house. She stated
that there would be 12 feet between the houses.
Mr. Baldwin made a motion that the petition be approved; seconded
by MIiss Penton. The motion carried.
Docket No. 37-52 - Ernest S. Wild% 1815 Roosevelt Road - West,
described as East 46' of Lots 1 & 2, Block 15, McCarthy's Addi-
tion, zoned "B" Residence District; requesting a waiver of lot
area in order to add onto rear of existing house.
Mr. Wild was present at the rieeting and explained to the members
that he plans to tear down the old structure on the back of his lot and
build a new garage .and storage room in its place. it was brought out
that the .extra space in the new structure would be used for storage space
and not as a servants quarters or rental purposes. There were no ob-
jections.
Miss Penton made a motion that the petition be approved; seconded
by Mr. Baldwin. The motion carried.
Docket No. 38-52 - Goode Stewart, 41+01 Kenyon Street, described
as Lot 1, Block 13, Hillcrest Addition, zoned "A" One -Family
District; requesting a waiver of rear yard space in order to
add onto the existing house.
Since no one was present at the meeting to represent this petition,
the members discussed it and then voted on the petition. Mr. Baldwin
made a. motion that the petition be approved; seconded by Miss Penton.
The motion carried.

Docket No. 40-52 - Home Hodernizers of Ark., 110 No. Schiller,
described as Lot 12, Block 1, Union Depot Addition, zoned "B"
Residence District; requesting a waiver of rear yard space in
order to build house on rear of lot.
Mr. Stillman represented this petition. He stated that he is the
contractor for the building. Mr. Stillman said there is a gulley on
the front of the lot and therefore the house would have to be built on
the rear of the lot. He said that the house would be used strictly for
servants quarters. The lot is vacant at the present time. The owner
lives on the lot next door and the servant will live in the new struc-
ture and will care for the owner next door. He brought the fact that
the structure would never be used for rental purposes. X= tintlimm

Mr. Baldwin made a motion that the petition be approved; seconded
by Miss Fenton. The motion carried.
Docket No. 42-52 - Dr. L. Ii. Byrd, Jr., 3015 ',dolfe Street, de-
scribed as Lot 5, Block 8, Sunset Addition, zoned "B" Residence,
requesting a waiver of yard space in order to build storage
room and carport on house.
Dr. Byrd presented his plan requesting a waiver of yard space
in order to build a storage room and carport onto the house. The mem-
bers looked over the plans and discussed them. They agreed that the
plans met their approval.
Mr. Baldwin made a motion that the petition be approved; seconded
by Iliss Penton. The motion carried.
Docket No. 41-52 - Mrs. W. J. Hutto, 123 West 15th Street, de+-
scribed as Lots 1 & 2, Block 64, Original City Addition, zoned
I'D" Apartment District; requesting a waiver of front yard space
in order to remodel existing building and enclose the front porch.
Mrs. Hutto was not present at the meeting. The members looked
over the plans attached to her petition and discussed them throughly.
However, in enclosing the front porch of her house, ;Irs. I:utto would
be blocking the view of motorist since the house would be located six
feet from her front property line. The Board members felt that in
view of that fact the house would become a hazard to motorist.
14r. Baldwin made a motion that the petition be denied; seconded
by Miss Penton. The motion carried.
Docket No. 43-52 - Church of Our Lady of the IIoly Souls, F. A.
Allen, Southeast corner of Tyler and "H'I Street, described as
the West 901 of Lots 1 & 2 and all of Lots 3 & 4, Block 19
Lincoln Park Addition, zoned "B" Residence District; requesting
permission to construct a Sisters Residence.

The petition of the Church of Our Lady of the Holy Souls was
presented. Mrs. Harper was at the meeting to object to the petition
because she thought the building was being built on a half of a lot.
Mrs. Harper lives across the street from the building on the west side.
Actually, Mrs. Harper didn't understand exactly what the petition was
requesting. Since the building is being constructed within the correct
yard requirements, their reason for corning before the Board of Pdjustment
was to request permission to construct a Sisters Residence. The struc-
ture is being built on a lot which is 90' x 1201. Mrs. Harper said
that they are not building on the back 60' of the lot and she didn't
see how that was permissible. The members then explained to her that
due to the 90' frontage of the lot, the building could be constructed
wider than it is long. Mrs. Harper stated that she had no objections
to the sisters living in the home since that was the actual question
before the Board.
Miss Penton made a motion that the petition be approved; seconded
by Mr. Baldwin. The motion carried.
Docket No. 44-52 - W. F. Ashby, 1811 So. Van Buren & 1812 Franklin
Streetz, described as Lot 3, Block 2, H. F. Buhler's Tenth Addition,
and Lot 18, Block 2, H. F. Buhler's Tenth Addition, zoned "B" Res-
idence District; requesting a waiver of side yard space in order to
build carports on the side of the houses.
Mr. Ashby was present and presented a sketch of his plans to the
members. He said that there is a drainage ditch on the side of his
lots, which is about 10' wide. Air. I.shby proposes to cover the ditch
along his property. He was requesting a waiver of yard space in order
to construct two houses closer to the property lines than 51. These
buildings will come within one foot of the covered drainage ditch.
Actually, the covered ditch will be used for additional yard space and
will never have anything built on it. He stated that it would cost
around <;1/+00 to fix it.
Mr. Baldwin made a motion that the petition be approved; seconded
by bliss Penton. The motion carried.
Docket No. 45-52 - A. J. Griffin, Z�01 Valmar Street, described
as Lots 1 & 2, Block 6, Beach Addition, zoned "B" Residence
District; requesting a waiver of rear yard space in order to
construct a new house.
Mr. Griffin was present and presented his plans to the members.
He stated that he built a house on the back of the lot some time ago be-
cause of a large house sitting on the two lots at that time. He built
the house on a 52' x 98' space. Now he proposes to tear down the house
which is located on the lot facing Valmar and will construct a new home.
The house will be constructed on a 83' x 98' lot. Mr. Griffin said that
he could face the house on 4th Street but that the house s were nicer
ones on Valmar and he preferred to face the new structure on Valmar.
He plans to build either a carport on the side of the house or will have
-' a breeze-uray between the carport and house.
Miss Penton made a motion that the petition be approved; seconded
by Mr. Baldwin. The motion carried.

Docket No. 46-52 - The St. Paul Methodist Church, 2217 thru
2305 Durwood Road, described as Lots 5, 6, 7, 8, 4 9, Queen
Manor Addition, zoned "C" Two -Family District; requesting a
waiver of yard space in order to construct a church.
Mr. Bromwell, the contractor for the building, and Rev. Charles W.
Richards, the pastor, were present at the meeting. Mr. 1romwell told
the members that he was requesting a waiver of front yard space in order
to build a church on the property. At the present time, fir. Bromwell
stated that their plans are very indefinate because it may be several
years before the church will be constructed. It was brought out that
the building would probably come within 5' of the south property line.
Mr. 1 Jool sey was present to object to thepetition. He stated that
he lives next to the south property line of the churches property and
that he didn't want them building within 5' of his home. Mr. Woolsey
said that the church had gottne permission from all property owners
living in that area to amend the Bill of Assurance grantimg their church
the -right to build on that property. At that time, Mr. Woolsey gave
his approval provided that the church would not build too close to
their south property line. He said that he wasn't interested how close
the church was built to the other property lines just as long as the
building was not too close to his property. ]sir. Woolsey said that he
had the word of the pastor that the church would not be built too close
to the souuth line. Mr. Woolsey stated in the meeting that he didn't
want the church to build within 301 of his property. He also stated that
he would with -draw his approval to build a church in that area if they
should build that close.
Mr. Bromwell then stated that the church was within the cities
yard space requirements in buildi-:g within 5' of I,:r. Wool sey' s home and
that the reason the petition is before the Board of Adjustment is be-
cause they are requesting a waiver of front yard space. sir. Woolsey
t spoke up then and said that he thought it was in his Bill of
Assurance that a requirement of 7�1-' was necessary for the side yard
space. Mr. Stephens stated that the property is zoned in a Two -Family
District and according to the City Ordinance the side yard space re-
quirement is 5'. Mr. Stephens has just built a home in Queen Manor
and said that the 5' yard space requirement applied to his property.
He said that he didn't think a larger side yard space requirement would
be necessary for a few individual lots.
There was a, great deal of discussion among the members on this
petition. Iowever, they said that since the church was only asking for
a waiver of front yard space requirements and was complyinG- with the
Zoning Ordinance when they are building within 5' of the side property
line, they felt it was a matter for 1,Ir. Woolsey and the church to work
out as -to how close the church would build to the south line. The
Board felt that any agreement between the church and Mr. Joolsey was
strictly for them to handle themselves, and was not a matter for the
Board of Adjustment to enter into.
Miss Fenton made a motion that a waiver of front yard space be
granted; seconded by Mr. Bladwin. The motion carried.

Docket No. 4.7-52 - J. A. Kincannon, 30th & Madison Street, de-
scribed as Lots 1, 2, & 3, Block 2, Oakhurst Addition, zoned "B"
Residence District; requesting a waiver of rear yard space in
order to construct a home.
Mr. Kincannon was present and presented his plans to the Board.
After looking over the plans, the members felt that is was h hardship
and that Mr. Kincannon needed the waiver of yard space.
Miss Penton made a motion that the petition be approved; seconded
by Mr. Baldwin. The motion carried.
The meeting then adjourned.
