BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room, City
Hall, Monday, July 21, 1952, at 2:00 p.m., with the following members
present:
Miss Emily Penton, Chairman
Mr. Louis Tarlowski
Mr. Warren Baldwin
Mr. W. H. Marak
Docket No. 29-52 - Ted Darragh, Forbes Place, described as
Lots 7, 8, & 9, zoned "A" One -Family District; requesting
a waiver of yard space and permission to face buildings
towards center of the lot.
This petition was represented by Mrs. Darragh and her lawyer. He
stated that Forbes Place is located Southeast of the intersection of
"W" Street and Beverly Place. Mr. Darragh is confvonted with an unusual
situation in that there is no street leading up to his house. He pro-
poses to build a drive in the shape of a half circle and face two houses
towards the drive. In doing so, this will cause the houses to face
the center of his lot. He stated that there wasn't a practical way for
the houses to face the street at all. There were no protests.
Mr. Baldwin made a motion that the petition be approved; seconded
by Mr. Marak. The motion carried.
Docket No. 30-52 - H. B. Myers, 1216 East 14th Street,
described as Part of Lots 5 & 6, Block 17, Masonic
Addition, zoned "C" Two -Family District requesting a
waiver of yard space in order to enlarge and enclose
the porch.
Mr. Myers was present at the meeting and told the members that the
house was built in 1926. He explained to the members that he was almost
forced to buy the house at the time that he bought it because of the
housing shortage. Mr. Myers needs additional space in his house and
wants a waiver of yard space in order to enlarge and enclose the porch.
He said there were no protests.
Mr. Marak made a motion that the petition be approved; seconded by

Docket No. 31-52 - F. J. Schmutz, 1422 West 4th Street, de-
scribed as Lot 17, Block 342, Bartons Sub Addition, zoned
"D" Apartment District; requesting permission to use ex-
isting building for offices for the Arkansas Association
for the Cripple. (a philanthropic use)

Mr. Schmutz, his son, and a spokesman from the Arkansas Asso. for
thr Cripple were present to represent this petition. Mr. Schmutz in-
formed the members that he planned to repair the house and convert it
into an office building.
Mrs. Liles was present to act as spokesman for the surrounding
property owners in protesting the petition. Mrs. Liles told the members
that she was a nurse and that she knew that if an office was allmied to
move there that it would also create a clinic sooner or later for she
had worked with those organizations before and knew how they operated.
She said that she felt the organization was a worthy one and she approved
it 100% but that she was protesting in behalf of the property owners be-
cause they didn't want the value of t eir property decreased. At the
present time the neighborhood is a quiet one with people who own their
homes living there and they don't want the zone changed now. Another
neighbor was also protesting for the same reason.
Mr. Schmutz explained to Mrs. Liles that she had been misinformed
when the notice of hearing was circulated because a mobile unit would
be stationed there one week out of each month which would create a
clinic and an office.
The Board then dismissed those parties interested in the petition
and discussed the application throughly. Then the persons were called
back into the meeting and Mr. Tarlowski explained to those protesting
that since the property is already zoned in "D" Apartment District the
owner would have a right according to the Zoning Ordinance No. 5420 to
operate a clinic or h6spital on that lot. Therefore the only question
that the Board of Adjustment had the jurisdiction to act upon was whether
or not permission to operate an office for a philothopic use shoul d be
granted on the lot. The protestants said that they understood Mr.
Tarloswki but that they still objected to a busines office being located
on the lot. The people were dismissed once more.
Mr. Marak made a motion that the petition be approved; seconded by
Mr. Baldwin. The motion carried.
Docket No. 33-52 - E. B. Compton, 1421 Marshall Street, de-
scribed as Lot 6 & the South 4' of Lot 5, Block 16,
Centennial Addition, zoned "C" Two -Family District; re-
questing a waiver of yard space as shown on plot plan.
Mr. Herbert Collins was present to represent this petition. He
stated that Mr. Compton plans to make improvements on his home by adding
a living room and car port on the side of the house. There are several
houses on the Block which extend out farther than Mr. Compton's so in
adding a living room on the front he will still be in line with the
other homes on the block. There were no protests.
Mr. T arlow ski made a motion that the petition be approved; seconded
by Mr. Baldwin. The motion carried.
Docket No. 34-52 - Henry Thomas, 807 East 9th Street, (by
T.J. 0. Martin), described as Lots 10 & 11, Block 3, Masonic
Addition, zoned "F" Commercial District; requesting a
waiver of rear yard space in order to construct a service
station.

Mr. W. 0. Martin was present to represent the petition for Mr.
Henry Thomas. He explained to the members that the property had been
rezoned for "F" Commercial use a month or so ago in order to operate
a service st-Aion there. The .first two lots on that side of the block
will be used for the station. He was asking for a waiver of rear yard
space. He needed a waiver of from 7 to 8 feet on the rear of the pro-
perty in order to construct a service station.
Mr. Karak made a motion that the petition be approved; seconded by
Mr. Tarlowski. The motion carried.
Docket No. 35-52 - W. D. Lucy, 1123 Rice Street, described
as Lot 6, Block 3, Capitol Hill Extension Addition, zoned
"C" Two -Family District; requesting permission to change
the address from Rice Street to 12th Street so alto face
duplex on 12th Street and requesting a waiver of yard space.
Mrs. Lucy was present and stated that she planned to enclose the
front porch of the house and also the back porch in and make a duplex
out of it. She said that each duplex would have four rooms and was
requesting permission to face the duplex on twelfth Street. She said
thatX there were no protests. The property owner living.next door to
her had no objections because he would rather see the house converted
into a duplex than used for commerci& purposes.
Mr. Baldwin made a motion that the petition be approved; seconded
by Mr. Marak. The motion carried.
Docket No. 22-52 - Lloyd Burkett, 1624 Monroe Street,
described as Lot 6, Block 6, Buhlers loth Addition,
zoned "B" Residence District; requesting a waiver of rear yard
space in order to construct a one -family home on said
property.
Mr. Burkett still wasn't present at the meeting so the Board
members suggested that Mr. Friday write him a registered letter stating
that the application would be dismissed after the next meeting if he
was not present then.
Mr. Allen was admitted to the meeting to explain an anusualX situation
to them. He is the achitect for the Holy Souls Church and is building
a dormitory for the sisters to live in. The property is zoned for "B"
Residence purposes however Mr. Allen explained that there would be only
one kitchen in the building and that in a sense the sisters would be
living together as a family. The building would be two stories and
will have space for fifteen persons to live there which would include
the maids and cooks. Mr. Allen had written a letter to the members
which Miss Penton read to the Board. The letter fully explained Mr.
Allens problems. The size of the building will be 90' x 140'.
The Board members suggested that Mr. Alen go through the legal pro-
cedure set up according to the Board of Adjustment Rules and appear at
their next meeting on August 18, 1952.
