OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room, City
Hall, Monday, June 16, 19622 at 2:00 p.m., with the following members
present:
Mr. Warren Baldwin, Chairman
Mr. Louis Tarlowski
Mr. W. H. Marak
Docket No. 25-52 - Dr. Jerome Levy & Dr. Allen G. Cazort,
1125 West 7th Street, described as Lot one (1), Block
402, Compton's Sub Addition, zoned "D" Apartment District;
requesting a waiver of front yard space in order to enlarge
present building.
Dr. Levy and Dr. Cazort presented their plans to the members
to look over. They were requesting permission to extend the front of
their clinic 101 on the front of the clinic. Dr. Rogers and Wicker
have a clinic next door to their's and didn't object to the extension
of the clinic. Dr. Levy explained to the members that the clinic would
almost be even with the apartments on that block. After the extension
is made on Dr. Levy's clinic, it will be approximately 15' from his front
property line. There were no protests. .
Mr. Tarlowski made a motion that the petition be approved;
seconded by Mr. Marak. The motion carried.
Docket No. 26-52 - First Church of God, (by Chief Powell),
1123 Thayer Street, described as Lot 6, Block /+, Capitol
Hill Extension Addition, zoned "C" Two Family District;
requesting a waiver of rear and side yard space in order
to add onto present building.
Mr. R. E. Hoffman, secretary of the First Church of God, was
present to represent this petition. He told the members that the build-
ing is brick, however, the extension to the building will be built of
frame. The addition will be made on the north isde of the building.
Mr. Hoffman stated that the church owns the property next door and that
the church comes within 21 of that property. He also said that the
church ownes the property on the other side with the house on the lot.
The church plans to build a frame building because they hope to expand
and build a large building there some day. It wis brought out that he
could build a frame building under the Building Code. There were no
protests.
Mr. Tarlowski made a motion that the petition be approved;
seconded by Mr. Marak. The motion carried.

Docket No. 27-52 - Greater New Hebron Baptist Church,
824 Maxwell Street, described as Lot 11, Block 44,
Industrial Park Addition, zoned "A" One -Family District;
requesting a waiver of yardspace in order to construct
a new building.
No one was present to represent this petition. Mr. Stephens
explained that the church plans to build a new building of concrete
blocks. He said that the building will be built on the back of the lotl
Mr. Tarlowski made amotion that the petition be approved;
seconded by Mr. Marak. The motion carried.
Docket No. 28-52 - Roger 0. Haggard, 4023 West 12th Street,
described as Lot 6, Block 4, Wcrthens Addition, zoned "F"
Commercial District; requesting a waiver of yard space,
lot area and two main structures on one lot.
Mr. Haggard and his son were present to represent this petition.
At the present time there is store, house and garage on the lot. Mr.
Haggard wants to tear down the metal garage on the back of his lot and
build two garages with a garage apartment over them for his son to live
in. His lot is 46' x 1301. Mr. haggard told the members that the gar-
age apartment would only take up 6 more feet than the present garage does.
There would be only one family living in the garage apartment. There
were no protests.
Mr. Tarlowski made a motion that the petition be denied;
seconded by Mr. Marak. The motion earried.
The petition of Lloyd Burkett was brought up once more and since
he wasn't present at the ;Y!eeting and hasn't checked with the Planning
Office to see about the outcome of his petition or turned in his notice
of hearing, his application was held up until the next meeting again in
hopes that he will appear before the commission at that time.
Mr. Tarlowski read a letter to the members from Bill Mitchell
which was making a direct attact on the Board of Adjustment and Question-
ing the right of the Board. This was in reference to a petition which
came before the Board of Adjustment in April. The case is being taken
to court. Mr. Tarlowski made a motion that the matter be referred to
the City Attorney for action; seconded by Mr. Marak. The motion carried.
The Board also asked Mr. Friday and :fir. Stephens to draw up
an ordinance amending some of the rules and regulations of Section 18
of Ordinance No. 5420.
The meeting then adjourned.
