boa_05 02 1952MINUTES OF THE MEETING OF THE BOARD OF ADJUSTMENT The Board of Adjustment met in the Mayor's Conference Room, City Hall, Friday, May 2, 1952, at 2:00 p.m., with the following mem— bers present: Miss Emily Penton, Chairman Mr. Warren Baldwin Mr. Anderson Docket No. 8-52 T. R. McGuire, (by Mrs. T. R. McGuire), 2301 west Markham Street, described as Lot one (1), Block two (2), Capitol View, Addition, zoned "F" Commercial Dis— trict; requesting a waiver of yard space, lot area, and two buildings on one lot so as to construct business build— ing and apartments on top of building. There was no one present to represent this petition. The mem— bers discussed the petition and then voted to approve it. Docket No. 9-52 Max H. Ezell, 1101 Battery, described as West 100 feet of Lot 11 Block 20, Marshall & Wolfe Addition, zoned "F" Commercial District; requesting a waiver of ,yard space in order to connect commercial build— ing onto existing residence. Mr. Ezell was present and stated that he planned to build a barber shop on the front of the apartment house located on the property. He said that the front of the shop would face Battery Street and the side of course would be on llth Street. Mr. Ezell asked the Board to permit him to come up to the property line, He said that most of the stores are built up to the property line on that block. The members voted to approve this petition. Docnket No. 11-52 William T. Stover, (by J. F. Robertson), Northeast corner of # 10 Highway and Lombardy Lane, de— scribed as Lots 19 & 201 Normandy Addition, zoned "A" One — Family District; requesting a waiver of yard space in order to add to the building. Mr. Stover was present and stated that he wanted to add onto his building. He asked the board for a rear yard space waiver. Mr. Stover said that his house faces Lombardy Lane. He has $ 30' from the back of his house to the house next to him. The members voted to approve this petition. -2- 7 Docket No. 10-52 Mrs. L. A. Ratley, 2027 No. Arthur Street, described as Lot 18, Block 2, Altheimer Addi- tion, zoned "A" One -Family District; requesting a waiver of yard space. Mrs. RatletT was _present and stated that she wanted to build a breeze-Qay onto her house. This breeze -way would lead out to a little guest house in her back yard. The members voted to approve this petition. ####*#*;11****_rT*** Docket No. 12-52 - A. M. Belmont, 811 No. Van Buren Street, described as Lot 3, Block 45, Pulaski Hdights Addition, zoned "A" One -Family District; requesting a waiver of front yard space. Mrs. Belmont was present and had her contractor, Mr. Hale with her also. Mr. Hale explained to the members that Mrs. Belmont couldn't add onto the back of her house without great difficulty. He said that the house rests on the around in the rear practically and that they would have to do a great deal of digging etc. in order to add onto the rear of the house. Mrs. Belmont stated that she contacted Mr. Wells who objected to her building out on the front of her lot. She said that Mr. Wells had studied over the matter after she had contacted him that first time and he decided that he didn't approve of the extension on the front of her property. He wasn't present to object to the petition however. Mrs. Belmont told the members that she had six children and her mother who also lived with her so that meant nine people in the family in all. She said that they need the extra bedrooms. She ex- plained that they could build onto the front of the lot because it had a slope to it. She stated that they own the store on the corner. Affter the rooms are added onto the house Mrs. Belmont said that they will only be about three feet closer to the property line than they are allowed. The members voted to approve this petition. Docket No. 13-52 - Bennie Stewart, (by Terrell Marshall), 1419 West 25th Street, described as Lot, 8, Block 9, Brad - dock's Boulevard Addition, zoned "F" Commercial District, requesting a waiver of front yard space. No one was present to represent this petition. After some discussion among the members, they voted to approve this petition. Docket No. 14-52 - L. W. Beavers, 5401 Southwood Street, described as Plot 222, Prospect Terrace #-3 Addition, zoned "A" One -Family District; requesting a waiver of side yard space in order to build a house and car port. Mr. Beavers was present and stated that he was asking for a waiver of side yard space. He said that he planned to build within 3' of the park which is located on the side of him. He said that the house next to him is 180' from his house. Mr. Beavers told the members that his carport will be next to the park. The members voted to approve this petition. -3- Docket No. 15-52 - T. W. Brett, 1711 No. Tyler Street, described as Lot 13, Block 3, Englewood Addition, zoned "B" Residence, District; requesting a waiver of side yard space in order to extend back porch. No one was present to represent this petition. After some discussion the members voted to approve the petition. Docket No. 16-52 - J. C. Bemberg, 1M05 Barber Street, de- scribed as Lot 11, Block 7, Masonic Addition, zoned "C" Two -Family District; requesting a waiver of side yard space in order to build a stairway on side of the house. No one was present to represent this petition. After some discussion, the members voted to approve it. Docket No. 17-52 - D. D. Cranford, 215 East 16th Street, described as Mast L of Lots 10, 11, & 12, Block 17, Original City of Little Rock, zoned "C" Two -Family District; request- ing a waiver of yard space in order to extend building. No. one was present to represent this petition. After some discussion the members voted to approve the petition. Docket No. 15-52 - Charles Piazza, 2201 Maple Street, de- scribed as Lot 1, Block 5, Chesterfield Square Addition, zoned "B" Residence District; requesting a waivet of yard space in order to face house on 22nd Street. No one was present to represent this petition_. After some discussion, the members voted to approve the petition. Docket No. 19-52 - Esso Standard Oil Co., (by W. 0. Martin), 1600 West 3rd Street, described as South 84' of Lots 11, & 12, Block 5, Deaf Mute Addition, zoned "G" Commercial Dis- trict; requesting a waiver of side and rear yard space in order to build a new station. Mr. W. 0. Martin was present and stated that he was asking f or a waiver of side and rear yard space. He told the members that he would build his station within 4' of the east side of his property line. His property is 84' in depth and Mr. Martin showed a picture of the station to the members and explained that the station required 79' to be con- structed. For that reason Mr. Martin is asking for a waiver of rear yard space. Mr. Martin explained to the Board that he plans to build a re- taining wall on the back of his property because of the drainage onto Mr. Korenblat's property. Asir. Korenb-"_at owns the property in back of Mr. Martin's station and a warehouse is located on that property. Mr. Martin said that some one lives in the warehouse also. He talked the matter over with I.Ir. Bric"-er, Mr. Korenblat's attorner, and said that he would be willing to off set his building 5' but that he would not s be willing to off set his retaining wall as Mr. Bricker wants him to. Mr. Bricker and P,s. Korenblat were present to object to the petition. Mr. Bricker stated that the Standard Oil Company should have realized that theywould be expanding before they sold part of that lot to Pair. Korenblat some years ago. He said that if the Standard Oil Co. hadn't sold that 60' then they wouldn't have to abk for this waiver of yard space now. Now 14r. Martin is having to ask for a waiver in order to build uo to Mr. Korenblat's property. Mr. Bricker stated that 1•3r. Korenblat would be willing for Mr. Martin to build back as close to him as 71' but that he would not be willing for him to come within 5' of his property. Mr. Bricker brought out the fact that t?-ie Standard Oil Dompany is a large company and that they could build other places in the city where Mr. Korenblat is a small business man. Mr. Bricker said that in 1939 when the Standard Oil Co. sold the north 60' of their pro- perty was of any value and now they are asking for a waiver of yard space to expand their business. Mr. Bricker also stated that his per- sonal opinion was that more members of the Board should be present. He said that it seemed to him that the members evidently weren't too inter- ested in the cases being discussed or they would have all been present. There was some discussion between Mr. Martin and Mr. .Bricker concerning the number of feet that Mr. Martin should set back; however, they still didn't come to any compromise on it. After the gentleman were dismissed, the members discussed the petition thoroughly. Mr. Baldwin told the members that eh has had calls concerning the cars that Mr. Korenblat had on his property and that the people would certainly object to it if there was any way that they could do anything about it. Mr. Anderson made a motion that the petition be approved and that Mr. Martin keeps within 5' of his rear property line in constructing his station; seconded by Mr. Baldwin. The motion carried. The members discussed the triangle located at Kavanaugh and Country Club Road which at the present time hasn't been zoned at all due to an over site when the entire city was zoned. However, they finally agreed that the Board of Adjustment had no jurisdiction over the matter at all. The meeting then ajourned. Board of Adjustment Little Rock, Arkansas
