OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room, City
Hall, Monday, April 21, 1952, at 2:00 p.m., with the following members
present:
Miss Emily Penton, Chairman
Mr. Warren Baldwin
Docket No. 8-52 T. R. McGuire, (by Mrs. T. R. McGuire),
2301 West Markham Street, described as Lot one (1), Block
two (2), Capitol View Addition, zoned "F" Commercial Dis-
trict; requesting a waiver of yerd space, lot area, and
two buildings on one lot so as to construct business build-
ing and apartments on top of building.
Mrs. McGuire was present and stated that she planned to tear
down the frame building and construct a brick one in its place. She
stated that she plans to build a business building with apartments on
top of the building. Her property is connected with several commercial
buildings on that block. There are apartments across the ally from Mrs.
McGuires property. Mrs. McGuire's property is next to the alley. Mrs.
McGuire stated that she didn't plan to tear down a garage on her property
which has a room over it because her husband uses it for a store and tool
room more or less.
The Board voted to approve this petition.
Docket No. 9-52 Max H. Ezell, 1101 Battery, described
as West 100 feet of Lot 1, Block 20, Marshall & Wolfe
Addition, zoned "F" Commercial District; requesting a
waiver of yard space in order to connect commercial build-
ing onto existing residence.
Mr. Ezell was present and stated that he planned to build a
commercial building on the front of the present apartment building which
is on the property. The building will be 14' x 22' and will more than
likely be built of an asbestos sheeting. The commercial building"All
face Battery Street. Mr. Ezell told the members that he planned to
build the building ,�s close to the property line as they will permit him
to. However, he also stated that he would keep his building in line
with the other buildings on the block. Mr. Ezell said that the build-
ing which he plans to extend onto the apartment will be used for a bar-
ber shop. His lot is 100' x 501. There were no protests.
The Board voted to approve this petition.

Docket No. 10-52 - Mrs. L. A. Ratley, 2027 No. Arthur
Street, described as Lot 18, Block 2, Altheimer Addi-
tion, zoned "A" One -Family District; requesting a waiver
of yard space.
Mrs. Ratley was present and stated that she wanted to build
a porch on the back of her house for the children to play on during the
hot summer months. It will be a breeze -way more or less. She stated
that there is also a guest house on the back of their property which
the children use as a play house and that it would in no way be rented.
The porch will be built in line with the house. There is also a drive-
way on the side of her house. There were no protests since Mrs. Ratlyy
made it clear thtLt the guest house was not to be rented at any time.
The Board voted to approve this petition.
Docket No. 11-52 - William T. Stover, (by J. F. Robertson),
Northeast corner of # 10 Highway and Lombardy Lane, de-
scribed as Lots 19 & 20, Normandy Addition, zoned "A" One -
Family District; requesting a waiver of ,yard space in order
to add to the building.
There was no one present to represent this petition. The
board members studied his plot plan and discussed it. The lot is an
irregular one however, Mr. Baldwin and Miss Penton agreed that they
felt that Mr. Stover would add a very nice extension to his home.
The Board voted to approved this petition.
Docket No. 12-52 - A. M. Belmont, 811 No. Van Buren Street,
described as Lot 3, Block 45, Fulaski Heights Addition,
zoned "A" One -Family District; requesting a waiver of front
yard space.
Mrs. Belmont was present and stated that she planned to con-
vert the front porch into a living room and build two bedrooms on the
house. She is asking a front yard space waiver because the house faces
the west and she wants to keep the back yard space for the children to
play in this summer for it will be cooler there. Mrs. Belmont stated
that she had six children and needed the room. There are two other
houses on the same side of the block as Mrs. Belmont's home and if a
waiver of yard space is granted then her home will be out of line with
the other two homes. Mrs. Belmont stated that she also plans to add a
bsth on the back of her house.
The Board voted to deny this petition.
Docket No. 13-52 - Bennie Stwwart, (by Terrell Marshall),
11+19 West 25th Street, described as Lot 8, Block 9, Brad -
dock's Boulevard Addition, zoned "F" Commercial District,

requesting a waiver of front yard space.

Mr. Marshall was present to represent this petition. He stated
that Mr. Stewart had started construction and that the city engineers
office had stopped him and told him that he would need a waiver of yard
space. Mr. Marshall said that Mr. Stewart had poured a concrete clab
measuring about 20' 30" which he plans to build a wall around if a waiver
is granted him. His property is located next door to a plumbing shop.
Mr. Marshall told the members that he contacted all property owners in
that area and had written a letter to one owner living out of town. There
were no protests.
The Board voted to approved this petition.
Docket No. 14-52 - L. W. Beavers, 5401 Southwood Street,
described as Plot 222, Prospect Terrace # 3 Addition,
zoned "A" One -Family District; requesting a waiver of side
yard space in order to build a house and car port.
Mr. Beavers was present and stated that he planned to build
a home and carport on his lot however, he would need a waiver of yard
space in order todo so. He i:as asking a waiver on the side of his
lot facing the park. There were no protests.
The Board voted to ap?.)rove this petition.
Docket No. 15-52 - T. W. Brett, 1711 No. Tyler Street,
described as Lot 13, Block 3, Englewood Addition, zoned
"B" Residence, District; requesting a waiver of side yard
space in order to extend back porch.
Mrs. Brett was present and stated that she wanted to build a
porch on the side of her house whichwoi.tld connect onto her back porch.
She said that she wants to build it there in order to put her washer
and dryer on it. There were no protests. The porch will be within
6 inches of the property line next door however, it would accua_l.ly be
about g' 4" from their neighbors house.
The Board voted to approve this petition.
Docket No. 16-52 - J. C. Bemberg, 1005 Barber Street, de-
scribed as Lot 11, Block 7, Masonic Addition, zoned "C"
Two -Family District; requesting a waiver of side yard space
in order to build a stairway on side of house.
Mr. Bemberg was present and stated that he planned to build
a stairway on the side of his house. He said that the house is used as
a convalescence home and that he wanted to build an extra stairway on
the side of his house for safty sake more than anything. Then in case
of a fire at any time it would give those in the building anothe r way
out of the house. However, Mr. Bemberg stated that the house was in
very good condition. There were no protests.
The Board voted to approved this petition.
Docket No. 17-52 - D. D. Cranford, 215 East 16th Street,
described as East z of Lots 10, 11, & 12, Block 17, Original
City of Little Rock, zoned "C" Two -Family District; request-
ing a waiver of yard space in order to extend building.
Mr. Cranford was present and stated that he planned to build
an apartment on the side of his house. He plans to extend his front
porch over some. Mr. Cranford stated that he would extend the apart-
ment over about 12' from his house. His porch extends out about 10,
from the front of the house. Mr. Cranford said that his house faces
the north and that his apartment will be X 7' out further than the house.
He said that he would have about 13' from the property line if he builds
the apartment as he plans to now.
The Board voted to approve this petition.
Docket No. 15-52 - Charles Piazza, 2201 Maple Street, de-
scribed as Lot 1, Block 5, Chesterfield Square Addition,
zoned "B" Residence District; requesting a waiver of yard
space in order to face house on 22nd Street.
Mr. Piazza was present and stated that he was requesting a
waiver of yard space in order to face his house on 22nd Street. He
said that he got all of the property owners to sign the notice )m of
hearing except three, and he wrote them letters. They were not too
near his property so he didn't feel that they would object. There is
a store facing the way that Mr. Piazza's house is suppose to face and
that is Mr. Piazza's reason for wanting to face the homes on 22nd Street.
The Board voted to approve this petition.
Docket No. 19-52 - Esso Standard Oil Co., (by W. 0. Martin),
1600 West 3rd Street, described as South 84' of Lots 1.1, &
12, Block 5, Deaf Mute Addition, zoned "G" Commercial District.
requesting a waiver of side and rear yard space in order to
build a new station.
Mr. W. 0. Martin was present to represent this petition. He
had some snap shots of the way that the Standard Oil Co. Station would
look upon completion. Mr. Martin said that his property is 100' x 841.
Mr. Martin stated that he was asking a waiver of rear yard space, to per-
mit him to build on the back of his station. Mr. Martin ssi d that he
plans to build a retaining wall on the back of his property line. He
said that there was a great deal of drainage of oil etc. and that they
want to build ing wall on the back of the property.

Mr. was present to represent Mr. Korenblat in protest-
ing against the petition. He was objecting because he said that Mr.
Martin would build back to his raar property line and since the South
84' of the lot is of higher elevation then he felt that X� it would
deprive the North 60' of the lot of lig'_�_t and air space. He was also
objecting because he felt that if the Standard Oil Company should buil*
to the rear of its property line then it would increase exposure and
explouinn hazards. He said that it would also result in an increase
in hazard insurance rates for the objector.
The Board voted to approve this petition.
Mr. Wallace Burnett was present at the meeting to talk to the
members about a piece of property at Kavanaugh and Country Club Road.
It is in a triangle shape and for some reason was over looked when the
zoning was placed through out the city. He plans.to buy the property
and use it for an ice cream pe►ler_ if the city will let him use the pro—
perty for that use. Mr. Baldwin stated that he felt that the city
should buy the property since it is more or less hazardous due to traffic.
However, they didn't take any definate action on the matter since they
weren't quite sure just what should be done and if they had the jurisdiction
to make a decision or not.
