OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room, City
Hall, Monday, March 17, 1952, at 2:00 p.m., with the following members
prosent:

Docket No. 6-52 - R. Kenneth Cavanaugh, (by Dan 0. Richardson)
307 North Jackson Street, described as middle 113 of West z
of South z of Lot 8 Howard Adams Subdivision of East 2 of No.
West � of No. East 4 Section 61 T-1-N, R-12 W, zoned "B" Res-
idence District; requesting waiver of front yard space in
order to enclose porch.
Mr. Cavanaagh was present and stated that he was requesting a waiver
of yard space in order to enclose his porch. P4r. Cavanaugh plans to en-
close his front porch and make it a part of his living room. He said
that his house wouldn't extend out further than the house next door to
him. Mr. Cavanaugh had talked with all of the neighbors about it and
there was no objection on their part.
Mr. Tarlowski made a motion that the petition be granted; seconded
by Mr. Anderson. The motion carried.
Docket No. 7-52 - Floyd L. Pumphrey, (Bert B. Berry), 1622
North Hayes Street, described as North half of lots 1, 2, 3,
and 4, Block 14, Springdale Addition, zoned "A" Ond-Family;
requesting waiver of yard space to permit construction of
residence within 1 foot of North property line on said
property.
Mr. Bob Rogers was present to represent this petition. Mr. Berry
was also there. Mr. Rogers stated that at the time the property was
plated, the lots were running north and south. However, now they are
facing Hays Street. He said that the street should be closed bgt the
people objected. Mr. Berry bought four lots on Hays Street, which run
back 200 feet. At the time Mr. Berry bought the proeprty he planned
to build an expensive home there. However, he found that there is a
sewer line running East and West for 36 feet in from the north boundary.
Mr. Berry isn't permitted to build his house over a sewer so he had
divided up the lots into 200 feet depth and wants to use the north half
to build his house on. Mr. Rogers stated that there is a 20 feot alley
north of Mr. Berry's property. Mr. Rogers stated that they were re-
questing a waiver of yard space to permit Mr. Berry to construct his
residence within one foot of the North property line.
Mr. Marak made a motion that the petition be granted; seconded by
Mr. Anderson. The motion carried.

There was a discussion on a lot in "Queen Manor" which involved
a house facing Blackwood Road and yet had the address of 601 Pine
Valley Road. The lot involved was a diamond shaped lot at an intersec—
tion which means that the house could face one of three different ways.
There were a number of people who live on Pine Valley Road present to
object to the house being built to face Blackwood Road because it
would place the back yard of the house facing their property and they
felt that it would decrease the value of their property. Mr. Ed Dobbs
was a spokesman for the group. The city engineer had issued a permit
to start building at the address of 601 Pine Valley Road. However,
when the building inspectors saw that the house was going to be built
to face Blackwood Road they stopped the building temporarily. The
property owners living on Pine Valley Road and who lived across the street
from the house being built signed a petition objecting to the way the
house was facing and presented it to the Board of Adjustment. The pro—
perty owners living on Pine Valley Road said that when the property was
platted, that it showed an address on Pine Valley Road at that inter—
section. They also said that they didn't think the house was being
built within the correct boundary line.
Mr. Holman the owner of the property at the intersection was pre—
sent and stated that he was within the law and -the boundary required
for his building. He is building a duplex however; he hasn't actually
stated construction on the duplex yet. Mr. Holman said that his
boundary had been checked by engineers and that he was correct in his
measurements. Mr. Holman said that he had drawn up two plans other than .
the one he had for the duplex now and that this was the only one that
he could use on that particular lot. Due to the sloping of the lot Mr.
Holman couldn't build a house on the lot unless he did face it to—
wards Blackwood Road. He stated that the address given on the building
permit was 601 Pine Valley Road but that the building inspector could
plainly see on the plat that he presented to him that the house would
face Blackwood Road.
Mr. Jan Carter, the city engineer, was called in the meeting. He
stated that he didn't issue the permit himself but that as soon as he
saw that the permit was made out for Pine Valley Road and that the house
was going to face Blackwood Road that he halted the permit. He advised
the petitioners against the building of that house to come before the
Board of Adjustment and so did -Mr. Stephens for they felt that perhaps
the Board had some jurisdiction over such matters which might scour.
Mr. Carter stated that he felt that perhaps the best way to face the
house would be facing the intersection which would place the back yard
of the house towards the back yards of the houses in back of the lot at
the intersection.
The people were then dismissed. There was a great deal of dis—
cussion about this matter among the members. Then Mr. Tarlowski made
a motion that the Board of Adjustment did not have the jurisdiction to
act on such a matter since it seems that Mr. Holman was complying with
all regulations. Mr. Anderson seconded the motion. The motion was
carried.
The meeting was then adjourned.
