OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room, City
Hall, Monday, February 18, 1952, at 2:00 p.m., with the following members
present:
Mr. Warren Baldwin, Chairman
Mr. Louis Tarlowski
Mr. W. H. Marak
Docket No. 5-52 - W. C. Yates, 215 Johnson Street, de-
scribed as Lot 15, Block 2, C. S. Stifft's Addition, zoned
"C" Two -Family District; requesting variance permit to use
present building for a three family residence.
Mr. Yates was present and stated that he had an apartment up stairs
and one down stairs. He would like to convert the down stairs into two
apartments. He stated that there would be four rooms and a bath in each
apartment down stairs.
Judge Harper was present to protest against the petition. He said
that he owned property in that area and that it was zoned for one family.
Judge Harper said that Mr. Yates came to him and told him that he want-
ed to build a duplex in the house. Judge Harper was under the impression
that Mr. Yates intended to add a bath and maybe an additional room down
stairs. Judge Harper said that he agreed to it. However, he said that
he didn't want this petition granted because he felt that it would hurt
the surrounding property value and would decrease it. Judge Harper
stated that he wanted the property left zoned as one -family.
Dr. Smith was present and stated that he wished to protest to the
petition because he had been misinformed on the petition. He said that
Mr. Yates told him that he wanted to add a bath to the house when he
has it rezoned some time ago. Then the house was converted into a dup-
lex. Dr. Smith stated that he had a house the same size as that of Mr.
Yates and that he didn't have any trouble renting it. He said that his
drive way was close but you could still get in and out of it. Dr. Smith
said that he didn't want apartments put in Mir. Yates house.
Mrs. Fred B. Smith was protesting because she had been misinformed
and understood that all Mr. Yates wanted to do was to put a bath in the
house. However, she said that Mr. Yates had gone up in the attic and
converted it into an apartment. She said that the tenants had to go
through the living room to carry the garbage out and things like that.
Mr. Yates told Mr. Smith that he wanted a bath to take care of the
apartments down stairs and didn't even mention the attic to her.
Mrs. Spicer stated that she owned the apartment behind Mr. Yates
property. She stated that when Mr. Yates brought the petition around
some time ago that he said that he wanted to add a bath down stairs.
Mr. Spicer was also present and said that when Mr. Yates came around
with the second petition that he decided to look into the matter. He
said that Mr. Yates had misrepresented the petition to all of the pro-
perty owners. Mr. Spicer told the members that if it was possible in

any way that they would like to have the property of Mr. Yates zoned
back to One -Family.
Mr. Marak made a motion that the ptition be disapproved; seconded
by Mr. Tarlowski. The motion carried.
Docket No. 2-52 - Mrs. Nora J. Levy, 1401 Spring Street,
described as Lot 1, Block 193, Original City of Little
Rock, zoned "D" Apartment District; requesting waiver of
front and side yard space.
Mrs. Levy was present and stated that she would like to build a
little sleeping room onto her house. She stated that she has a three
room house and needed an extra room for her daughters children when
they visited her. Mrs. Levy is asking a waiver of front and side yard
space. She said that the house next door to her didn't have a front
porch and when she finished adding the room onto her house then her
house still won't come out even with the neighbors house.
Mr. Marak made a motion that the petition be approved; seconded
by Mr. Tarlowski. The motion carried.
Docket No. 3-52 - A. L. Enderlin, 1217 Fair Park Boulevard,
described as Lots 13 and 14, Block 2, Oak Forrest Addition,
zoned "F" Commercial District; requesting waiver of yard
space in order to extend buildings.
Mr. Enderlin was present and stated that he only had one building
on the lot. He wants to build a boiler room onto to his building. Mr.
Enderlin owner a cleaning and Dressing business. The lot in back of
his business had one house on it. Mr. Enderlin wants to build his boiler
room back to the alley. He said that there were 171 feet between his
building and the alley. There were no protests. His property is in a
business district.
Mr. Tarlowski made a motion that the petition be approved; seconded
by Mr. Marak. The motion carried.
Docket No. 4-52 - Fred M. Evans, 1202 Park Avenue, described
as Lots 1 and 2 and 3, Block 3 (43' x 1501), Park Addition,
zoned "C" Two -Family District; requesting w diver of yard
space, lot area and two buildings on 1 lot in order to con-
struct a garage apartment.
Mr. Fred M. Evans Jr. was present to represent the petition. He
stated that he wished to build a garage apartment on the back of his
lot and that he would also have two garages underneath the apartment.
He stated that his father, whom he is representing, would be retiring
in the next few years and thtL it would give him a source of income to
