boa_08 15 1955MINUTES OF THE M=ING OF THE BOARD OF ADJU6TMWT The Board of Adjpsttment met in the Mayor's conference room on August 15, 1955 at 2100 P. M. The foll4wing members were present: Mr. W. H. Marak, Chairman Mr. T. V. Allen Mr. Warren Baldwin Miss Emily Penton A public hearing was -held on the following dockets: Rocket No. 32-55 - Alan J.. Rost, Lot 'twelve (12), Ranch Valley Road described as Lot Twelve (1.2), Ranch Valley Addition to the City of Little Rock, Arkansas, zoned "A" one -Family District; requesting interpretation of side and rear yard provisions of Section 119 of Ordinance No. 5420 as they effect the location of a new residential structure on a triangular lot,0 Mr. Rost was asked by Mr. Marak to explain his request. He explained that he wanted to build a house on a triangular lot located in the new Ranch Valley Additions but was denied a permit because of the triangular lot and the indeterminate yards, According to the plot plan the house would be within 81 of the side or rear property line, depending on the Board's interpretation. Mr. Groves, who owns the property to the rear, was present and stated that he had no objections to Mr. Rost building to within 81 of this line. Mr. Stephens explained that Mr, Rost needed an interpretation by the Board as to whether this is the rear lot line or side lot line and if it is interpreted as the rear lot line a waiver of rear yard space would be required before a building permit could be obtained. There were no objectors present. In the executive meetinE Mr. Baldwin moved that this lot line be interpreted as ..'sing the side lot line; Miss Penton seconded and the move carried. Docket No. -55 -- Mrs. Maggie Trout (by Fred Wingfield) 2019 South Elm Street, described as the North Fifty (50) feet of Lots Nine (9) and Ten (10), Block One (1), Nei.meyer's Addition to the City of Little Rock, Arkansas, zoned "B" Residence District; requesting variance from the rear yard provisions of Section 11 of Ordinance No. 51+20 to permit the construction of additional bedroom.to existing house. Neither Mrs. Trout nor Mr. Wingfield were present. Krs, Margaret Stierheim, who lives at 4008 Idest 215t Street, was present and stated that she objected to Mrs. T rout's revue st because she felt that, if granted, it would ever --crowd the lot and would decrease the value of her adjoining property, Page 2 of 3 Mrs. C. J. Bassham was, prepent And. stated #hat the lot is very small and the proposed extension to the house will over -crowd the lot, since the house had been added to before, Mr. Allen asked if the extension: could be made if the owner kept it at least 61 from the line. Mr. Stephens said not, because the rear yard area is presently in- sufficient. Miss Penton moved that this request'be denied; Mr. Allen seconded and the motioi carried. The following docket was referred from the Planning Commission: Docket No. 34=5� - d. M. Black, 2824 Lewis Street, described as Lots Lieven (11) emd Twelve (12), Block One (1), Riffle and Holder Ad- dition to the City of Little Rock, krkanse s; requesting a than je of zone from the present "B" Residence District to that of '$F'E Commercial District =.•iith waivers of lot arNp requirements, yard spaces and more than one structure on one lot,,so as to permit.construction of a new commercial building 501 x 601 to face Lewis Street. No one was present to present this request. Mr. Stephens stated that three matters should be considered in this requests 1. .lhethe r or not to extend the commercial zoning 1 to include the entire lots, 2. The location of the proposed new building, and 3. Whether or not three main buildings should be allowed on two lots. I.r. Burleigh wa.s asked for his recommendation. He recommended that the Board deny the extension of the business zone on the remainder of the lot unless the frame building is removed, off-street parking provided, and the lot re -subdivided. Mr. Baldwin moved that A:r. Black be asked to consider removing the frame house on Lot 110 re -subdividing the property and re -submitting it, -to the Board; Mr. Allen seconded and the motion carried. Wittenberg) 1521 `.lest 7th Street, described as the ire st Ten (10) feet of Lot Five (5) and Six (6), Block Four hundred Thirteen (413), Compton+s Subdivision, Lincoln's Addition to the City of Little Rock, Arkansas, zoned I'D" Apartment District; re- que-ting a waiver of front•and side yard space on said property. Mr. Stephens stated that no new information had been received from the applican since the last meeting. Baldwin moved that this be apnroved, subject to the action of the Planning Commission; Miss Penton seconded and the motion carried. Mr. Allen moved that in the future all plats submitted td the Board be prepared and certified by a. registered professional "engineer or architect; hiss Penton second- ed and the motion carried.
