OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Council Chamber, City Hall, on April 18,
1955 at 2:00 P. M. The following members were presents

Docket No. 12-55 - South Highland Church of Christ (H. L. Upton),
2716 Lewis Street, described as Lots Four (4)
and Five (5), Block Three (3), Oak Grove Square
Addition to the City of Little Rock, Arkansas,
zoned "B" Residence District; requesting waiver
of rear yard space in.order to extend church
auditorium and construct educational building
on said property.
Alderman Griffey was present and spoke in behalf of the church. He stated
that he had met with some of the members of the church and they asked him to tell
the Board of their need for a waiver, He explain& to the Board that the church.
planned to add approximately 251 to the rear of the existing church and to con-
struct an educational building approximately 28' x 36' on Lot 5, which is south
of the church. Mr. Baldwin stated that he had seen the property and had no ob-
jections. The -church owns five lots here.
Mr. Allen moved, that this be granted; Rise Penton seconded and the motion
carried.
Docket No. 13-55 - Magnolia Petroleum Company (H. W. Gunn) Kavanaugh
and Beech Streets, described as Lots Nine (9)
and the South -One-half ('*) of Ten (10), Block
Twenty (20), Pulaski Heights Addition to the
City of Little Rock, Arkansas, zoned nFII Com-
mercial District; requesting waiver of rear
and side yard apace.in order to construct service,
station building on said property.
Mr. George Bilheimer was present in behalf of the Magnolia Petroleum Company.
He explained that they planned to face Kavanaugh Boulevard with a new service
station and needed waiver of rear yard space since they proposed to locate on the
rear lot line. There were no questions from the Board and no objectors wem pre+
sent.
Mr. Anderson moved that this be granted; Miss Penton seconded and the motion
carried. '

Docket No. 14-�55 - Jack Holt, 115 North State Street, described as
the South Forty (40) feet of Lots Five (5) and
Six (6), Block One hundred thirty-six (136),
Original City of Little bock, Arkansas, zoned
nG-1° Commercial District; requesting waiver of
such portion of the 30% parking space or area,
required by ordinance to be reserved, as will
permit the building of the extension on the rear
and north side of the house located on said
property as shown by the plat.
Mr. Jack Holt was present and stated that he bought this property with the
idea of building a private law office for his son and himself. When his builder
consulted with city officials he was told that since the property is in the "G-l"
Commercial District he would have to have 30% of the lot area, exclusive of front
set backs, reserved for off-street parking. He stated that his proposed front
yard would take care of quite a few cars. He showed the Board an architects draw-
ing and explained that he could build the front porch smaller than now proposed in
order to have more parking space. He explained that the shacks on the rear of the
property at present will be torn down. It was decided that there would be room
for only seven cars, approximately. There was some discussion as to whether or not
the Riverfront Drive will close State Street. Mr. Holt offered to check with Mr,
Garver on this. There were no further questions asked.
Mr. Holt returned after consulting Mr. Garver by telephone, who confirmed
that the Drive would not close State Street.
In the executive meeting Nir. Anderson asked Mr. Stephens for his opinion.
Mr. Stephens was of the opinion that the parking requirement in the "G-1° Com-
merciel. District was not arbitrary and was planned to relieve congestion caused
by the Riverfront Drive in order to ease the flow of traffic. This district was
created for this specific purpose and yard space requirements were.ehanged to help
compensate for this. This request is the first one since the new district was
fQrmed.
No objectors were present.
Miss Penton moved that the request be denied; Mr. Anderson seconded and the
motion carried.
Docket No. 15-55 -- W. B. Sanders, 3210 3220 Marshall Street, described
as Lots Seven (7) through Twelve (12), inclusive,
Block Thirty-six (36), Braddock's Boulevard Addition
to the City of Little Rock, Arkansas; requesting a
waiver of yard space on fronts of all lots to con-
form to building line established to the north on
said property.
,Mr. Sanders was present and stated that he had six lots on leiarshall Street
and that the F. H. A. requires that the houses to be built on these lots be lined
up with the houses to the north. This would necesFitate waiver of the 25' set back
to enable construction to approximately 121 of the front line of the lots. There

was some discussion about the lay of the land of these lots and it was determined
that this was indeed a justifiable hardship due to the excessive slopes.
No objectors were preeentf ,
Mr. Anderson moved that this request be granted; Miss Fenton seconded and the
zkotion carried.
Docket No. 9-55 - Mary C. Foreman, 800 North Spruce Street, described
as the East Eight -five (85) feet of Lots Four (4)
and Five (5i, Block Forty-seven (47), Pulaski Heights
Addition to the City of Little Rock, Arkansas, zoned
"A" One Family District; requesting waiver of yard
space to permit construction of a carporte to rear of
residence structure.
The Board was familiar with this docket. Mr. Jacoway was present in behalf
of his client, Mrs. Foreman. He reviewed her request briefly and asked the Board
to tell them what they could do so that Mrs. Foreman could put windows in the .
garage, install posts or whatever would be agreeable with the Board. Mrs. Foreman
had a letter written .in 1953, signed by Mrs. Turk, saying she did not object to a
Carporte. Mrs.. Turk was not present at this tia1s, but came to the meeting later
to voice her objections to a closed garage running the entire length of Mrs. Fore-
man's house. There was some discussion about the drainage from this garage onto
Mrs. Turk's property, which was settled by saying it could be taken care of with
drainage gutters.
Mr. C. R. Douglas was present as one objecting to this request, since he
thought it would harm Mrs. Turk.
In the executive meeting the members felt that a carporte was needed and dis-
Cu'ssed what Mrs. Foreman should be allowed to do. It was decided that the
structure should be an open carports, maximum size 20' x 241 and set back to the'
north side of the lot.
Mr. Anderson moved that this request be granted on these conditions; Miss
Denton seconded and the motion carried. Air. Baldwin asked Mr. Stephens to notify
Mrs. Foreman of the Board's decision.
A petition by Mrs. Georgia Heiskell to rezone her property at 312-322 East
Capital Avenue from "D" Apartment District to "H" Business District in order to
use the property for a parking lot was presented to the Planning Commission on
March 17, 1955. Since the Board of Adjustment has the power to grant or deny this
request it was sent to the Council with this information and referred to the Board
by the Council.
This request was brought up at this time. Mr. George Fleischauer was present
to represent firs. Heiskell and explained that it was planned to execute a three
year lease on this property for parking purposes. The thought was that in a few
years this might be a commercial district and as the houses on the property at
present are no good for rental purposes that a parking lot would allow the owners

some transitional use until 'it becomes c6nkercial. mr, Stephens thought it was a
very good move and that no wiser use of the property could be made at the present
time.
Mr. Allen moved that this be granted•, Mr. Anderson seconded, and the motion
carried.
There was no further business to come before the Board, therefore, the meeting
adjourned.
