boa_02 21 1955�ftRUTES OF THE MEETING OF THE BOARD OF ADJUSTMENT The Board of Adjustment met in the Council Chamber of the City hall on Monday, February 21, 1955 at 2:00 ". M,' with the following members being present: Mr. Paul Parks, Acting Chairman Miss Emily Penton Mr. W. H. Marak Mr, Parks acted as chairman in the absence of the Chairman and Vice -Chairman, Docket No. 3-55 - Mrs. Bynam Campbell, 2123 West 17th Street described as the East Twenty --six (26) feet of the North one hundred (loo)feet of Lot Three (3), Block Nineteen (19), Park Addition to the City of Little Rock, Arkansas, zoned "C" Two -Family District; re- questing a waiver of side yard space in order to add.nine (9).feet to existing room to the 'southeast corner of existing non -conforming apartment house. Mrs. Campbell. was present and. explained her plans. She stated that she in- tended to make the southeast corner of her house correspond to the southwest cor- ner by adding a small room which would extend to within one foot of her east property line. The Board permitted her to make the same change on the southwest corner about a year ago. She stated that none of her neighbors objected. Miss Penton moved that this request be granted, Mr. Marak seconded and the move carried. Docket No. 4-55 - Mr. Max H. Ezell, 1819 West llth Street, de- scribed as the West one hundred (100) feet of Lot One (1), Block Twenty (20), Marshall and Wolfels Addition to the City of Little Rock, Arkansas, zoned "Fly Commercial District; requesting a waiver of rear yard space in.order to erect concrete block building as shown on plot. In the absence.of Mr. Ezell, who was ill,,Mr. Robert Thorn and Mr. Jim Becker represented him. Mr. Stephens briefed the members on this request and re- minded them that a similar request was made when he built the barber shop on the corner of llth and Battery about a year ago. He is now requesting waivers to erect a concrete block building which will face West llth Street and will be used as a jewelry storey. The house on the property is now rented as a duplex. A con- crete block building will have to be built since it is in a fire district. There were no objectors present. Miss Penton moved that this be granted, Mr. Marak seconded -the move and it carried, Page 2of3 Docket No. 5-55 - Dr. George D. Thompson and his wife Mary Alice Thompson, 5701 Kavanaugh Boulevard, described as the North one hundred (100) feet of Lots One (1) and Two (2) , Block Six (6) , Mountain Park Addition to the City of Little hock, Arkansas, zoned "F" Commercial; requesting the approval of the erection of a fire -proof building on the south end of said property. This had already been approved tentatively by the Board, but was on the agenda for a matter of record. Docket No. 6-55 - Griffin Realty Company (by 0. C. c0l"e, Jr. agent), 208 Gaines Street,,described as Lot Ten (10� and the South one-half of Lot Eleven (11), Block one hundred thirty-four (134), Original City of Little Rock, Arkansas, zoned 'IG-1'1 Commercial District; re- questing waiver of front yard space on Gaines Street. This, also, had already received tentative approval of the Board and was on the agenda for the record. Docket No. 7-55 - Shiloh Seventh Day Adventist Church (by C.R. Proctor, pastor), described as part of Block Forty-- three (43), Wright's Addition to the City of Little Rock, Arkansas, zoned "C"-Two-Family District; re- questing waiver of rear yard space in order to con- struct new church. Rev. Proctor was present and explained that his church was requesting per- mission to build to face Wright Avenue instead of Pulaski and that they need a waiver of rear yard space in order to do this,. No objectors were present. Mr. Marak moved that this be granted, Miss Penton seconded and the move carried. Docket No. 8-55 - ESso Standard ail Company (by W. P4 Hamilton), Markham and Vernon Streets, described as Lots One (1) and Two (2), Block Four (4), Young's Park Addition to the City of Little Rock, Arkansas; zoned 'IF" Comme rci. al District; requesting waiver of rear yard space in order to place new Esso Station on Markham Street. Mr. W. P. Hamilton was present to represent the Esso oil Company. The 00- Company oems three lots, two zoned "F" Commercial and one residential. Sinae the residential lot is only a ditch the Board felt that no use could be made of it. The traiver is requested in order to have a set --back along D;arkh.am greet. Page 3 of 3 miss Penton moved that this waiver be granted, Mr. Marak seconded the moire and it carried. Docket No. 9-55 - Mary C. Foreman, 800 North Spruce Street, de- scribed as the East Eight --five (85) feet of Lots Four (4) and Five (5) Block Forty-seven (47), Pulaski Heights Addition to the City of Little Rock, Arkansas, 2oned "A" One Family District; requesting a waiver of yard space to permit construction of a carport to rear of residence structure. Mr. Cooper Jacoway was present to repre sent Mrs. Foreman, who was also present. Dr. Dick and Mrs. Turk were present to object to this request for waiver of rear yard space. Mr. Jacoway explained what Mrs. Foreman proposed to do. It was stated that Mrs. Foreman appeared before the City Council about a year and a half ago and was given permission to replace old garage with a carport. Due to financial difficulties she did not finish this. When she came for her permit she was told she could only replace the garage space with a carport and that to do as she planned would require a waiver of rear yard space. Mr,.Jacoway informed the Board that due to the fault of the contractor, work had been started without a permit, but was stopped by the building inspector. at present the proposed west wall is only about four or five feet high, Mrs. Foreman stated that the west wall of the carport would be about eight feet high with windows near the top and a flat sloping roof over the entire length. Mr. Stephens asked if she planned to use any of this for rooms? Mrs. Foreman answered no, but that she intends to use part of it for a pati❑ with barbecue pit, etc,, but not for rooms. Mr. Karak stated that in his opinion the solid concrete block wall with windows would not normally be called a carport. Mrs. Turk was allowed to speak and stated that she thought the structure should be kept back in line with the rest of the houses on the block and that th( carport should be an open structure with steel posts and a roof, since the solid wall would be adjacent to her front yard and would obstruct the air and view. Dr. flick stated that he was present mainly to learn just what this was goinf to be. He had heard of several different things it was to be used for. It was brought out again that the City Council had given permission to replace the old garage, only, and not to build a larger structure. In the executive meeting it was decided to defer this request until further study could be made. Mr. Stephens said he would make the study report available to the Board members as soon as possible.
